- The National Institute of Standards (NIST) intends to negotiate, on a sole source basis, under authority of FAR 13.501(a) with Johnsons Controls, Inc. (JCI) of Milwaukee, Wisconsin a within scope modification to an existing Order (SB134110SE0754) for the repair of a 3,500 ton York refrigeration units (RU) at NIST's Gaithersburg, Maryland campus, identified as RU#1. The RU is a highly specialized chiller with refrigerant fluid under high pressure and complex electronic controls and sensors. The repair involves a major overhaul of the compressor internal components that includes complete disassembly of rotors and seals, replacement of seals, anti-rotation disks and internal components, reassembly of the compressor and restoration to full equipment operations. The compressor motor has been disassembled by JCI for complete trouble-shooting and identification of required repair parts and a detailed diagnostic report has been prepared for the internal component damages that were discovered. The required refurbishment work is required to be performed by a certified JCI technical trained mechanic, and all parts necessary for these service repairs are required to be provided by the equipment manufacturer. Failure to adhere to the manufacturer's requirements will void all future warranty provisions, incur significant financial liability (and safety risk) for the Government and potentially impact the mission of the agency as a result of unauthorized repairs. As a result the only source to perform the required repairs on this compressor are JCI certified technicians and those technicians are employed by JCI. The proposed contract modification is for parts and services for which the Government intends to solicit and negotiate with only one source under the authority of FAR 6.302. Interested persons may identify their interest and capability to respond to the requirement or submit proposals. This notice of intent is not a request for competitive proposals. However, proposals received within fifteen (15) days after date of publication of this synopsis will be considered by the Government. A determination by the Government not to compete with this proposed contract based upon responses to this notice is solely within the discretion of the Government. Information received will normally be considered solely for the purpose of determining whether to conduct a competitive procurement for this repair.
