This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in Subpart 12.6, as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; quotes are being requested and a written solicitation will not be issued. This solicitation is issued as a Request for Quotation (RFQ), solicitation number FA5240-11-R-0006. This solicitation document and incorporated provisions and clauses are those in effect through Federal Acquisition Circular FAC 2005-50, effective March 16, 2011. A site visit will be conducted on 3 May 2011. Contractors interested in attending the site visit must contact Mr. Brett Clark at 671-366-2921 or brett.clark@andersen.af.mil to make arrangements. THIS ACQUISITION IS SET ASIDE 100% FOR SERVICE-DISABLED VETERAN-OWNED SMALL BUSINESSES (SDVOSB). The North American Industrial Classification System (NAICS) code is 488119 and the small business size standard is $7.0M. The 36th Contracting Squadron has a requirement for Transient Alert services at Andersen AFB, Guam. The contractor provides all personnel, equipment, tools, materials, supervision, and other items and services necessary to perform transient aircraft services at Andersen AFB, Guam in accordance with the attached Performance Work Statement (PWS). The services performed include but are not limited to aircraft movement, aircraft operations, concurrent servicing operations, safety management, special events support, emergency and exercise support, ordering and turning in of parts from the Air Force supply system, vehicle escorts, and management of publications and forms. CLIN items are as follows: CLIN 0001. Transition Period. One month. Period of performance (PoP) 1-30 Sep 11. During this period, the contractor will monitor the contract performance of the incumbent to learn the duties and responsibilities of the contract. Upon conclusion of the transition period, the contractor will assume all duties from the incumbent. CLIN 0002. Transient Alert Services - Base year. Twelve months. PoP 1 Oct 11 - 30 Sep 12. The contractor must furnish all tools, labor, equipment, materials, and transportation to perform transient alert services on Andersen AFB IAW the attached PWS. CLIN 1002. Transient Alert Services - Option year I. Twelve months. PoP 1 Oct 12 - 30 Sep 13. CLIN 2002. Transient Alert Services - Option year II. Twelve months. PoP 1 Oct 13 - 30 Sep 14. All services are to be performed at Andersen AFB, Guam. The provision at FAR 52.212-1, Instructions to Offerors - Commercial Items, applies to this acquisition along with its addendum: ADDENDUM TO 52.212-1: (a) The contractor shall submit their quote on company letterhead to include the following: solicitation number, contact name, address, telephone number of the offeror, unit price, extended price, any discount terms, delivery terms, cage code, DUNS number, tax identification number, size of business, and acknowledgement of solicitation amendments, if required. Quotes are not to exceed 10 pages in length, exclusive of past performance information, offeror's representations and certifications, and the written continuation of essential contractor services plan required by provision 252.237-7024. (b) Quotes and past performance information must be received no later than 12:00 pm Chamorro Standard Time, 20 May 2011, to 36 CONS/LGCB, Attn: Daniel Sindorf, Unit 14040, Bldg 17000, APO AP 96543-4040. Quotes may also be submitted via e-mail to the Primary POC, however offerors are advised to confirm receipt with Mr. Sindorf via separate email at daniel.sindorf@andersen.af.mil or by phone at 671-366-7110. FAX submissions will not be accepted. Offers received after this date and time will be considered late in accordance with 52.212-1(f) and will not be considered. Questions should also be addressed to Mr. Sindorf. Alternate POC is Brett Clark, brett.clark@andersen.af.mil, 671-366-2921. (c) To assure timely and equitable evaluation of the quote, the offeror must follow the instructions contained herein. Offerors are required to meet all solicitation requirements. Failure to meet a requirement may result in an offer being ineligible for award. The response shall consist of two (2) separate parts; Part I - Price Quote and Part II - Past Performance Information. (d) The contracting officer has determined there is a high probability of adequate price competition in this acquisition. Upon examination of the initial offers, the contracting officer will review this determination and if, in the contracting officer's opinion, adequate price competition exists no additional cost information will be requested. However, if at any time during this competition the contracting officer determines that adequate price competition no longer exists; offerors may be required to submit information to the extent necessary for the contracting officer to determine price reasonableness. (e) Notice to Offerors: Funds are not presently available for this effort. No award will be made under this solicitation until funds are available. The government reserves the right to cancel this solicitation, either before or after the closing date. In the event the Government cancels this solicitation, the Government has no obligation to reimburse an offeror for any costs. (f) Specific Instructions: 1. PART I - PRICE QUOTE - Submit on company letterhead the unit price for each line item to include extended price with an overall total price, including the transition period, base year, and all option years. The extended amount must equal the whole dollar unit price multiplied by the quantity. a. The provision at FAR 52.212-3, Offeror Representations and Certifications - commercial Items and its Alternate I must be completed. Offerors are highly encouraged to complete all representations and certifications electronically on line at: (http://orca.bpn.gov/publicsearch.aspx). If not completed on-line, 52.212-3 shall be completed in hard copy and submitted with quote. b. In accordance with FAR 52.212-4(t), Central Contractor Registration (CCR) contractors must be registered with CCR to conduct business with the Department of Defense. No purchase order can be awarded to any company without this registration (www.ccr.gov). c. Offerors shall provide a written statement that the offeror's quote incorporates all amendments to the solicitation (if applicable). d. Quotes must be firm-fixed price. 2. PART II- PAST PERFORMANCE INFORMATION - Present and past performance information will be used to determine acceptable performance of the services proposed. (a) The offeror shall submit the Past Performance Questionnaire (see Attachment 3) from a minimum of two (2) recent and relevant federal agencies or military organizations that have used or are currently using the same or similar services proposed for this contract. The offeror shall include a list of the relevant customers (including contact information) in their quote. (b) Quality and satisfaction rating for contracts performed during the past three years: Provide information currently available (letters, metrics, customer surveys, independent surveys, etc.) which demonstrates customer satisfaction with overall job performance and quality of completed product for same or similar type contract. In addition, explain corrective actions taken in the past, if any, for substandard performance and any current performance problems such as cost overruns, extended performance periods, etc. (c) Past Performance Information: The government will evaluate the quality and extent of an offeror's performance deemed relevant to the requirements of this solicitation. The government will use information submitted by the offeror and other sources such as other Federal government offices and other military installations to assess performance. Relevancy is defined as: Relevant - Present/Past performance effort involved the same or similar Transient Alert services as those defined in the PWS with the same or similar scope, magnitude, and complexity this solicitation requires. Somewhat Relevant - Present/Past performance effort involved some of the same or similar Transient Alert services as those defined in the PWS with the same or similar scope, magnitude, and complexity this solicitation requires. Not Relevant - Present/Past performance effort did not involve any of the magnitude of effort and complexities this solicitation requires. If a teaming arrangement is contemplated, identify the work the subcontractor will be performing if you are relying on the subcontractor's past performance. (d) Subcontractor Consent: Past performance information pertaining to a subcontractor cannot be disclosed to the prime offeror without the subcontractor's consent. Provide with the quote a letter from all subcontractors that will perform major or critical aspects of the requirement, consenting to the release of their past performance information to the prime contractor. (e) The evaluation of past performance information will take into account past performance information regarding key personnel who have relevant experience or subcontractors that will perform major critical aspects of the requirement when such information is relevant to the instant acquisition. Contracts older than three years will not be considered. (f) Completed performance surveys are not to be reviewed by the offeror. The offeror should direct their customers to mail or email their completed survey to 36 CONS/LGCB, Attn: Daniel Sindorf, Unit 14040, Bldg 17000, APO AP 96543-4040, daniel.sindorf@andersen.af.mil. Once the survey is completed, it is considered For Official Use Only, and is only viewed by Government personnel directly involved in the evaluation process for this acquisition. PART III: CONTINUATION OF ESSENTIAL CONTRACTOR SERVICES PLAN: Offerors shall submit the plan required by FAR Provision 252.237-7024: 252.237-7024 NOTICE OF CONTINUATION OF ESSENTIAL CONTRACTOR SERVICES (OCT 2010) (a) Definitions. Essential contractor service and mission-essential functions have the meanings given in the clause at 252.237-7023, Continuation of Essential Contractor Services, in this solicitation. (b) The Government has identified all of the contractor services performed under this contract as essential contractor services in support of mission essential functions. The offeror shall provide with its offer a written plan describing how it will continue to perform the essential contractor services during periods of crisis. The offeror shall-- (1) Identify provisions made for the acquisition of essential personnel and resources, if necessary, for continuity of operations for up to 30 days or until normal operations can be resumed; (2) Address in the plan, at a minimum-- (i) Challenges associated with maintaining essential contractor services during an extended event, such as a pandemic that occurs in repeated waves; (ii) The time lapse associated with the initiation of the acquisition of essential personnel and resources and their actual availability on site; (iii) The components, processes, and requirements for the identification, training, and preparedness of personnel who are capable of relocating to alternate facilities or performing work from home; (iv) Any established alert and notification procedures for mobilizing identified ``essential contractor service'' personnel; and (v) The approach for communicating expectations to contractor employees regarding their roles and responsibilities during a crisis. (End of provision) The provision at FAR 52.212-2, Evaluation - Commercial Items, applies to this acquisition along with its addenda: 52.212-2 EVALUATION--COMMERCIAL ITEMS (JAN 1999) (a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate offers: (1) Past Performance (2) Price Past performance is significantly more important than price. (b) Options. The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s). (c) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer's specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award. ADDENDUM TO 52.212-2: BASIS FOR CONTRACT AWARD: This is a competitive best value source selection in accordance with FAR Parts 12 and 13 and subpart 13.5, Test Program for Certain Commercial Items, in which competing offerors' past performance history will be evaluated on a basis significantly more important than price. By submission of its offer in accordance with the instructions provided in clause FAR 52.212-1, Instructions to Offerors, the offeror accedes to all solicitation requirements, including terms and conditions and representations and certifications, in addition to those identified as evaluation factors. This combined synopsis/solicitation will result in a firm-fixed price contract. a. Price Evaluation. An offeror's proposed prices will be determined by multiplying the quantity by the contractor's proposed unit price to confirm the extended amount for each contract line item (CLIN). The price evaluation will document the reasonableness and affordability of the proposed total evaluated price. b. Past Performance: Using the information supplied per the addendum to 52.212-1, Part II, Past Performance Information, the contracting officer will evaluate each offeror's past performance. c. Using the procedures in FAR Part 13, the contracting officer will arrive at a best value determination combining an offeror's price and past performance, where past performance is significantly more important than price. d. In evaluating past performance, the government reserves the right to give greater consideration to information on those contracts deemed most relevant to the effort described in this solicitation. e. Offerors are cautioned to submit sufficient information and in the format specified in the proposal preparation instructions. Offerors may be asked to clarify certain aspects of their proposal or respond to adverse past performance information to which the offeror has not previously had an opportunity to respond. Adverse past performance is defined as past performance information that supports a less than satisfactory rating on any evaluation element or any unfavorable comments received from sources without a formal rating system. Communication conducted to resolve minor or clerical errors will not constitute discussions and the contracting officer reserves the right to award a contract without the opportunity for proposal revision. f. The government intends to award a contract without discussions with respective offerors. The government, however, reserves the right to conduct discussions if deemed in its best interest. BACKGROUND CHECKS: Background Checks for Contractor Personnel Requiring Entry/Access to Andersen Air Force Base (a) Contractor and subcontractor personnel requiring entry/access to Andersen Air Force Base, Guam, cited in the contract shall be governed by the requirements of this clause. The below requirements and procedures are prerequisites to the issuance of any government identification (i.e., pass/badge) or the registration of a privately owned or commercial vehicle and the issuance of a pass/decal. (b) Immediately upon contract award, the contractor shall submit the following documentation for personnel who will be performing work as a result of an awarded contracting instrument (contract, delivery order, purchase order, etc.) to the Contracting Officer/designee: (1) "Listing of personnel requiring access/entry" (See Note 1). (2) Completed consent forms (See Note 2). (3) Favorable Criminal Background Histories (See Note 3). This documentation shall be submitted no later than seven (7) calendar days prior to performance on the installation/location. (c) Subsequent to the contractor accomplishing (b), contractor personnel may report to the badge issuing activity and follow local installation/facility procedures to obtain identification passes/badges and vehicle passes/decals. (d) For contractor personnel to obtain entry to the installation/facility in order to request the issuance of government identification (i.e., pass/badge) or to register a privately owned/commercial vehicle and obtain a vehicle pass/decal, the contractor personnel shall report to the installation/location entry control point and badge issuing activity with a photo identification issued by a Federal/State activity. (e) To register a privately owned/commercial vehicle and obtain a vehicle pass/decal, contractor personnel shall provide a valid driver's license, current vehicle registration, and valid vehicle insurance certificate. (f) Contractor personnel shall follow local procedures for wearing and displaying government-issued identification passes/badges, vehicle passes/decals, and contractor-issued identification. In general, all identification passes/badges and vehicle passes/decals shall at all times be prominently worn/displayed in a visible manner to government personnel. (g) During the performance period of the contract, the Contractor shall: (1) Provide written notification of any additions to the "Listing of personnel requiring entry/access" and submit consent forms and criminal background histories for all new contractor personnel requiring entry/access to the Contracting Officer/designee. (2) No later than five (5) calendar days after a change in status for contractor personnel requiring entry/access (e.g., the personnel no longer require entry/access or the contractor becomes aware of a negative screening criteria (i.e., "disqualifying factor"), provide written notification of deletions of personnel to the Contractor's "Listing of personnel requiring entry/access" to the Contracting Officer/designee. The Contractor shall return all government-issued identification passes/badges and vehicle passes/decals to the badge-issuing agency not later than one (1) work day after retrieval from the employee and obtain a proof of return. The proof of badge return shall be provided to the Contracting Office for inclusion in the contract file. (3) Maintain a copy of all background checks for a 24-month period and ensure subsequently needed background checks are accomplished prior to the expiration of a 24-month period (See Note 3). (h) Given a reasonable cause, condition, or reason, this clause does not circumvent an installation/location commander's unilateral authority to deny or withdraw any individual's entry/access to an installation/location. (i) When work under this contract requires unescorted entry to controlled or restricted areas, the Contractor shall comply with AFI 31-101, The Air Force Installation Security Program, and AFI 31-501, Personnel Security Program Management, as applicable. (j) Contractor personnel are not covered by FAR 52.222-3, Convict Labor, for the purposes of entry/access to entry/access to installations/locations. Contractor personnel are covered by FAR 52.222-3 for the purposes of performance outside of installations/locations. (k) The Contractor shall insert this clause in any subcontract where the subcontractor will require entry/access to the installation(s)/location(s) cited in the contract. Note 1: "Listing of personnel requiring access/entry." The Contractor shall provide a "Listing of personnel requiring entry/access" to the Contracting Officer or the Contracting Officer's designee(s). This listing shall be submitted on company letterhead and, as a minimum, contain the following data elements: - Contract number. - Work site(s) or location(s). - Performance start and stop date(s). - As a minimum, the following information for Contractor personnel requiring entry/access: full name, social security number (or other identification number), and installation(s)/location(s) to be accessed. No Contractor personnel shall be granted or authorized entry/access until identified on the "Listing of personnel requiring entry/access." Note 2: Consent forms. Consent forms shall authorize the Air Force to fingerprint Contractor personnel and to conduct additional background checks. In general, the consent form will outline the following: (1) The Contractor has briefed the contractor personnel for the purpose of the consent form. (2) The information on the form is collected in accordance with 50 U.S.C. 797 and DoDD 5200.8 that permits installation commanders to limit access to installations for security reasons. (3) Completion of the form is voluntary. (4) Agreement to provide a specimen of fingerprints, if/when requested. (5) Awareness of a list of "disqualifying factors" and/or access to the list. (6) Consent and authorization for the Air Force to conduct additional background screening and to compare fingerprints against state and Federal criminal databases. (7) Knowing and willful false statements on the form can be punished by a fine or imprisonment, or both (10 U.S.C. 1001). (8) That the consent form shall remain valid for not less than a 24-month period. In summary, the consent forms authorize the Government to conduct additional background checks that may result in the identification of negative screening criteria (i.e., disqualifying factor(s)). If negative screening criteria is identified, the affected Contractor personnel shall be denied entry/access and the Contracting Officer/designee will notify the Contractor. Furthermore, the Contractor shall be responsible for immediately returning all issued identification passes/badges and vehicle passes/decals to the badge-issuing office and obtain a proof of return. Each background check shall be considered "current" for a 24-month period and valid for all contracts performed within the 24-month period of currency. Contractors shall ensure background checks are accomplished every 24 months to ensure no lapse in background check coverage. This requirement does not apply to Contractor personnel that have a favorable government personnel security background investigation that is valid for a period longer than 2 years. Contractor personnel who have a current, favorable Government personnel security background investigation that is electronically accessible and immediately verifiable by the Government within the Joint Personnel Adjudication System (JPAS) are not required to obtain an additional background check for the purposes of complying with this clause (i.e., existing current, favorable security background investigations may be used in lieu of the requirements of this clause). (End of clause) CONTRACTOR ACCESS: CONTRACTOR EMPLOYEES/SERVICE PROVIDERS ACCESS TO ANDERSEN AIR FORCE BASE 1.1. Background Checks. A favorable criminal background history (CBH) check must be completed and verified for all contractor employees/service providers prior to allowing unescorted access/entry to Andersen Air Force Base. CBH checks will be considered valid for a 24-month period from the date they are performed. Prospective contractor employees/service providers will request exceptions to these requirements and procedures through the contracting officer. The 36 AEW Commander must approve all exceptions to these requirements. 2.1. Conducting CBH Checks. The Guam Police Department/Records and ID Section may be used to conduct CBH checks. Prospective contractor employees/service providers may choose other available sources for conducting these checks as long as the checks meet the minimum requirements outlined in Section 3.1 below. 3.1. CBH Check Requirements. Background checks may be obtained from commercial vendors or local law enforcement authorities whose checks include a criminal background history (CBH). To be considered complete, background checks shall, as a minimum, cover the following information: - Individual's name. - Social Security Number. - Date of birth. - Criminal/Arrest record (felony/misdemeanor) since the 18th Birthday. - Information on the locality(ies) checked (i.e., local and/or federal). - List of outstanding wants and warrants. NOTE: As resource availability and technology improves, this list of minimum requirements may be modified. CBH checks are considered favorable if they do not contain any of the following disqualifiers. 3.1.1. U.S. citizenship, immigration status, or Social Security Account Number cannot be verified. 3.1.2. Barred from entry/access to any military installation or facility. 3.1.3. Wanted by federal or civil law enforcement authorities, regardless of offense/violation, (i.e., an "order to arrest" has been issued by a judge). 3.1.4. Conviction of firearms or explosives violation within the past three years. 3.1.5. Incarcerated for 12 months or longer within the past three years, regardless of offense/violation. 3.1.6. Conviction of espionage, sabotage, treason or terrorism, murder, sexual assault, armed assault/robbery, rape, child molestation, drug possession with intent to sell, or drug distribution. 3.1.7. Name appears on any federal agency's "watch list" or "hit list" for criminal behavior or terrorist activity. 3.1.8. The 36 MSG Commander also reserves the right to deny access to the installation if the subject has serious or multiple offenses not covered by other disqualifiers, but are not compatible with employment on Andersen Air Force Base. EXCEPTION: CBH checks are not required for contractors or contractor employees/service providers if they have a current, favorable government personnel security background investigation that is electronically available and verifiable through the Joint Personnel Adjudication System (JPAS). 3.2. Disqualifying Factor(s) Identified. If any disqualifying factors are identified on a CBH check, the subject of the CBH check in question will not be allowed access/entry to the installation/location. 3.3. Random Additional Background Checks. For validity of the program, the 36 SFS will conduct random background checks on approved contractor employees/service providers to ensure program intents are being met. NOTE: If any of the disqualifying factors listed above are identified during a background check or required information is absent, the subject of the check will not be allowed access/entry to the installation and, as appropriate, federal, local law enforcement, and responsible commanders will be notified. 4.1. Responsibilities of Base Agencies. The organization or base agency responsible for the prospective contractor employees/service providers (e.g. AAFES, DECA, Services) will be responsible for management of their employees in this program and will ensure all procedures in the program are followed. Specifically, responsible agencies will: 4.1.1. Verify only original CBH documentation; electronic versions and copies are not acceptable for original verification purposes. 4.1.2. Return original CBH documentation to prospective employee or contractor and maintain a copy of the favorable CBH paperwork for the duration of the civilian's employment with the base agency. NOTE: Current contractor employees/service providers are not required to obtain a CBH check, however a valid (conducted within last 24 months) CBH will be required for renewal of the employee's or contractor's unescorted access ID or Pass. 4.1.3. Submit request letters for unescorted access/entry of contractor employees/service providers with a copy of the favorable CBH through 36 SFS/SFO not later than 7 days prior to requested access, except contracts awarded and purchase orders issued under emergency conditions. The request letter and any unfavorable or questionable CBH paperwork will then be forwarded by 36 SFS/SFO to the 36 MSG Commander for final approval. 4.1.4. Agencies will also maintain a copy of a consent form from each employee for the duration of the civilian's employment with the base agency and ensure the consent form authorizes the Government to conduct additional background checks. 4.2. Additional Responsibilities of the Contracting Office. In accordance with Andersen AFB local contract clause, the contracting office will ensure CBH requirements are incorporated into all new or modified contracts. In general, contracts will not be modified solely to meet this requirement nor will these requirements be added to existing contracts unless the contract requires modification for other reasons and the contract has more than 6-months remaining life. 5.1. Information Provided to Contractors by the Contracting Office. During the contracting process, the contracting office will ensure contractors are aware of the CBH requirements and local installation procedures and access prerequisites. Contracting offices, through the insertion of a contract clause and during discussions with contractors, will highlight and discuss the following information with contractors: 5.1.1. A "Listing of personnel requiring access/entry" is required to identify all personnel requiring entry/access to the installation/location during the performance of the contract. 5.1.2. A CBH is required for each employee and the CBH must, as a minimum, cover the minimum requirements as outlined in Section 3.1 above. 5.1.3. A consent form is required from each employee and that the consent form authorizes the Government to conduct additional background checks. 5.1.4. The disqualifying factors will be highlighted and it will be emphasized that any employee with one or more disqualifying factors will not be allowed access/entry to the installation. 5.1.5. Location of the installation entry/badge issuing activity (Pass and ID) and procedures for obtaining passes/badges/vehicle decals for gaining access/entry to the installation. 6.1. Contractors. Contractors will brief affected employees on the requirements outlined in 5.2 above. Contractors will be responsible for the completion and submission of the "Listing of Personnel Requiring Entry/Access," employee CBHs, and employee consent forms to the contracting officer/designee. NOTE: Contractors may obtain the CBH checks on their employees or, pending local laws, may request each individual employee to obtain their own CBH check. 6.1.1. Contractors will collect the CBH checks from their employees and review them for disqualifying factors. If disqualifying factors are found, the contractors will inform the employee that they are not eligible for access/entry to the installation/location. 6.1.2. Contractors will collect all signed consent forms from their employees. 6.1.3. Contractors will prepare a "Listing of personnel requiring entry/access to the installation/location." This listing must be prepared on company letterhead and contain the contract number, work sites or locations, inclusive dates of the contract (start/stop dates), work schedule identifying days of the week and time periods contractors and employees will be performing work on the installation, and full names and social security numbers. 6.1.4. Contractors will forward the listing of personnel requiring access/entry to the installation, completed CBH checks, and signed consent forms to the contracting officer/designee for review. 6.1.5. Contractors are responsible for providing written notification (within 5 calendar days) to the contracting officer/designee of any changes in personnel who require access/entry to the installation. This includes newly hired or terminated personnel, or personnel identified by the contractor with disqualifying factors after a CBH and additional background checks are completed. 6.1.6. Contractors are responsible for retrieving government-issued identification passes/badges and vehicle passes/decals from employees who no longer require access/entry to the installation/location (regardless of reason access/entry is no longer required) and returning them to 36 SFS/Pass and ID for destruction. 7.1. Responsibilities of 36 SFS. The 36 SFS is responsible for the following: 7.1.1. Receiving listing of personnel requiring access/entry to the installation, CBH checks, and signed consent forms from the base agency (e.g. CONS, DECA, AAFES, Services). 7.1.2. Reviewing the listing of personnel requiring access/entry to the installation/location, CBH checks, and signed consent forms. NOTE: The request letter and any unfavorable or questionable CBH paperwork will then be forwarded by 36 SFS/SFO to the 36 MSG Commander or designated representative for final approval. 7.1.3. Verifying the identity of contractor and subcontractor employees using a valid Guam/state/federal issued photo identification credential and comparing it to the individual present and the information on the listing of personnel requiring access/entry to the installation. NOTE: The primary means of verifying identity is a picture ID such as drivers license or state issued ID card. If an individual does not possess a picture ID, the secondary means of verifying identity is two forms of ID without pictures such as birth certificate, social security card, etc. 7.1.4. Conducting random background checks on approved contractor employees/service providers to ensure program intents are being met. NOTE: If any of the disqualifying factors listed above are identified during a background check or required information is absent, the subject of the check will not be allowed access/entry to the installation and, as appropriate, federal, local law enforcement, and responsible commanders will be notified. 7.1.5. Entering all contractor employees' information into the Security Force Management Information System (SFMIS) and issuing identification passes/badges and vehicle passes/decals. NOTE: As a result of these procedures, identification badges and vehicle decals will be reissued every 24 months since the CBHs are only valid for 24 months. 7.1.6. Receiving and destroying employee identification passes/badges and vehicle passes/decals after contract is completed, an individual no longer requires access to the installation/location regardless of reason, or the employee has quit or been terminated by the contractor. NOTE: Delete the individual's data from SFMIS when identification passes/badges and vehicle passes/decals are destroyed. Andersen AFB Local Clause. The Contracting Officer shall insert the local clause, Andersen-002: Background Checks for Contractor Personnel Requiring Entry/Access to Installations/Locations, in all solicitations and contracts meeting the following conditions: (a) Performance will be in the United States or United States territorial possessions. Andersen-002: Background Checks for Contractor Personnel Requiring Entry/Access to Installations/Locations As prescribed by Andersen AFB local policy, insert a clause substantially the same as the following clause in solicitations and contracts: Background Checks for Contractor Personnel Requiring Entry/Access to Andersen Air Force Base, Guam (28 Jun 2004) (a) Contractor and subcontractor personnel requiring entry/access to Andersen Air Force Base, Guam, cited in the contract shall be governed by the requirements of this clause. The below requirements and procedures are prerequisites to the issuance of any government identification (i.e., pass/badge) or the registration of a privately owned or commercial vehicle and the issuance of a pass/decal. (b) Immediately upon contract award, the contractor shall submit the following documentation for personnel who will be performing work as a result of an awarded contracting instrument (contract, delivery order, purchase order, etc.) to the Contracting Officer/designee: (1) "Listing of personnel requiring access/entry" (See Note 1). (2) Completed consent forms (See Note 2). (3) Favorable Criminal Background Histories (See Note 3). This documentation shall be submitted no later than seven (7) calendar days prior to performance on the installation/location. (c) Subsequent to the contractor accomplishing (b), contractor personnel may report to the badge issuing activity and follow local installation/facility procedures to obtain identification passes/badges and vehicle passes/decals. (d) For contractor personnel to obtain entry to the installation/facility in order to request the issuance of government identification (i.e., pass/badge) or to register a privately owned/commercial vehicle and obtain a vehicle pass/decal, the contractor personnel shall report to the installation/location entry control point and badge issuing activity with a photo identification issued by a Federal/State activity. (e) To register a privately owned/commercial vehicle and obtain a vehicle pass/decal, contractor personnel shall provide a valid driver's license, current vehicle registration, and valid vehicle insurance certificate. (f) Contractor personnel shall follow local procedures for wearing and displaying government-issued identification passes/badges, vehicle passes/decals, and contractor-issued identification. In general, all identification passes/badges and vehicle passes/decals shall at all times be prominently worn/displayed in a visible manner to government personnel. (g) During the performance period of the contract, the Contractor shall: (1) Provide written notification of any additions to the "Listing of personnel requiring entry/access" and submit consent forms and criminal background histories for all new contractor personnel requiring entry/access to the Contracting Officer/designee. (2) No later than five (5) calendar days after a change in status for contractor personnel requiring entry/access (e.g., the personnel no longer require entry/access or the contractor becomes aware of a negative screening criteria (i.e., "disqualifying factor"), provide written notification of deletions of personnel to the Contractor's "Listing of personnel requiring entry/access" to the Contracting Officer/designee. The Contractor shall return all government-issued identification passes/badges and vehicle passes/decals to the badge-issuing agency not later than one (1) work day after retrieval from the employee and obtain a proof of return. The proof of badge return shall be provided to the Contracting Office for inclusion in the contract file. (3) Maintain a copy of all background checks for a 24-month period and ensure subsequently needed background checks are accomplished prior to the expiration of a 24-month period (See Note 3). (h) Given a reasonable cause, condition, or reason, this clause does not circumvent an installation/location commander's unilateral authority to deny or withdraw any individual's entry/access to an installation/location. (i) When work under this contract requires unescorted entry to controlled or restricted areas, the Contractor shall comply with AFI 31-101, The Air Force Installation Security Program, and AFI 31-501, Personnel Security Program Management, as applicable. (j) Contractor personnel are not covered by FAR 52.222-3, Convict Labor, for the purposes of entry/access to entry/access to installations/locations. Contractor personnel are covered by FAR 52.222-3 for the purposes of performance outside of installations/locations. (k) The Contractor shall insert this clause in any subcontract where the subcontractor will require entry/access to the installation(s)/location(s) cited in the contract. Note 1: "Listing of personnel requiring access/entry." The Contractor shall provide a "Listing of personnel requiring entry/access" to the Contracting Officer or the Contracting Officer's designee(s). Contact information for the Contracting Officer's designee follows: ______________________________________________________________________. (The contracting officer's designee may be personnel within Security Forces, inclusive of the badge issuing activity; or personnel within the organization that will be performing quality assurance functions for the contract.) This listing shall be submitted on company letterhead and, as a minimum, contain the following data elements: - Contract number. - Work site(s) or location(s). - Performance start and stop date(s). - As a minimum, the following information for Contractor personnel requiring entry/access: full name, social security number (or other identification number), and installation(s)/location(s) to be accessed. No Contractor personnel shall be granted or authorized entry/access until identified on the "Listing of personnel requiring entry/access." Note 2: Consent forms. Consent forms shall authorize the Air Force to fingerprint Contractor personnel and to conduct additional background checks. In general, the consent form will outline the following: (1) The Contractor has briefed the contractor personnel for the purpose of the consent form. (2) The information on the form is collected in accordance with 50 U.S.C. 797 and DoDD 5200.8 that permits installation commanders to limit access to installations for security reasons. (3) Completion of the form is voluntary. (4) Agreement to provide a specimen of fingerprints, if/when requested. (5) Awareness of a list of "disqualifying factors" and/or access to the list. (6) Consent and authorization for the Air Force to conduct additional background screening and to compare fingerprints against state and Federal criminal databases. (7) Knowing and willful false statements on the form can be punished by a fine or imprisonment, or both (10 U.S.C. 1001). (8) That the consent form shall remain valid for not less than a 24-month period. In summary, the consent forms authorize the Government to conduct additional background checks that may result in the identification of negative screening criteria (i.e., disqualifying factor(s)). If negative screening criteria is identified, the affected Contractor personnel shall be denied entry/access and the Contracting Officer/designee will notify the Contractor. Furthermore, the Contractor shall be responsible for immediately returning all issued identification passes/badges and vehicle passes/decals to the badge-issuing office and obtain a proof of return. Each background check shall be considered "current" for a 24-month period and valid for all contracts performed within the 24-month period of currency. Contractors shall ensure background checks are accomplished every 24 months to ensure no lapse in background check coverage. This requirement does not apply to Contractor personnel that have a favorable government personnel security background investigation that is valid for a period longer than 2 years. Contractor personnel who have a current, favorable Government personnel security background investigation that is electronically accessible and immediately verifiable by the Government within the Joint Personnel Adjudication System (JPAS) are not required to obtain an additional background check for the purposes of complying with this clause (i.e., existing current, favorable security background investigations may be used in lieu of the requirements of this clause). (End of Clause) OMBUDSMAN 5352.201-9101 OMBUDSMAN (AUG 2005) (a) An ombudsman has been appointed to hear and facilitate the resolution of concerns from offerors, potential offerors, and others for this acquisition. When requested, the ombudsman will maintain strict confidentiality as to the source of the concern. The existence of the ombudsman does not affect the authority of the program manager, contracting officer, or source selection official. Further, the ombudsman does not participate in the evaluation of proposals, the source selection process, or the adjudication of protests or formal contract disputes. The ombudsman may refer the party to another official who can resolve the concern. (b) Before consulting with an ombudsman, interested parties must first address their concerns, issues, disagreements, and/or recommendations to the contracting officer for resolution. Consulting an ombudsman does not alter or postpone the timelines for any other processes (e.g., agency level bid protests, GAO bid protests, requests for debriefings, employee-employer actions, contests of OMB Circular A-76 competition performance decisions). (c) If resolution cannot be made by the contracting officer, concerned parties may contact the Center/MAJCOM ombudsmen, 36 CONS/Commander, phone number: (671) 366-4214, facsimile number: (671) 366-1996. Concerns, issues, disagreements, and recommendations that cannot be resolved at the MAJCOM/DRU level, may be brought by the concerned party for further consideration to the Air Force ombudsman, Associate Deputy Assistant Secretary (ADAS) (Contracting), SAF/AQC, 1060 Air Force Pentagon, Washington DC 20330-1060, phone number (703) 588-7004, facsimile number (703) 588-1067. (d) The ombudsman has no authority to render a decision that binds the agency. (e) Do not contact the ombudsman to request copies of the solicitation, verify offer due date, or clarify technical requirements. Such inquiries shall be directed to the Contracting Officer.
