- Introduction: Pursuant to FAR Subpart 13.106-1(b)(1), the U.S. Army RDECOM Contracting Center, Natick Contracting Division, on behalf of the US Army Natick Soldiers Center (NSC), intends to award multiple firm fixed price purchase orders on a sole source basis to: Cohen, Pontani Lieberman & Pavane, LLP, New York, NY 10176, Ziegler IP Law Group, LLC, Westport, CT 06880, Frank Tolin & Associates, Ltd., Newark, NJ 07102, and PJR Associates, LLC, Granby, CT 06035. THIS IS NOT A REQUEST FOR PROPOSALS. NO SOLICITATION DOCUMENT IS AVAILABLE. INQUIRIES WILL BE USED FOR FUTURE ACQUISITIONS ONLY. 1. Nature and description of the supplies or services required to meet the agency's needs: Patent specification preparation suitable for meeting requirements for filing with the U.S. Patent & Trademark Office (MPEP and 35 USC 100 et seq.) and further meeting a quality level based on technical competence demonstrated through sufficiently related college degrees and experience to the technology assigned. 2. A demonstration that the proposed contractor is the only source available to provide these services or goods (i.e. unique qualifications, proprietary rights, etc.): Each of the four patent counsel firms have been picked to cover a specific legal and technological area based on their core competencies and experience which makes them uniquely qualified in their respective combined technological and legal fields. These technological areas include chemical, electrical, physics (optics/materials) and mechanical technologies. The technical insight arising from experience in these technological areas is essential to provide quality patent specifications. 3. A description of the market research that was conducted and the results, or a statement of the reason a market research was not conducted: A review of the history of these firms based on technical competence and experience was made. 4. Any other facts supporting the use of other than full and open competition: Delivery of a high quality product (patent specification) is necessary to avoid serious issues that prevent the granting of a valid patent by the U.S. Patent Office. 5. A statement of the actions, if any, the agency may take to remove or overcome any barriers to competition before any subsequent acquisition for the supplies or services required: Hire a supporting patent attorney that can gain experience in the specific technologies covered by the R&D work at Natick. 6.
