Description
Based on RFQ VA-69D-11-RQ-0348 entitled "LUMENIS SYSTEM" for the Edward Hines VA Hospital, Hines, IL," award has been made to TECHNICAL COMMUNITIES/DBA TESTMART INC at the total contract amount of $167,299.10 as lowest priced technically acceptable after a compatability statement and competitive quote was received from another company (See MFR below). Initial Sole Source justification (SSJ) also below. Thank you for your interest in this procurement. Sincerely, Scott Ivy Contracting Officer Great Lakes Acquisition Center (GLAC) Milwaukee, WI JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION Lumenis Powersuite 100W system, Technical Communities, Inc, DBA Testmart, for the Hines VA VA69D-11-RQ-0348 1.Identification of the Agency and the Contracting Activity: Department of Veterans Affairs, Great Lakes Acquisition Center, 5000 W National Avenue Bldg 5, Milwaukee WI 53295 2.Nature and/or description of the action being approved: Justification and approval for other than full and open competition for the delivery of a Lumenis Powersuite 100W system from Technical Communities, Inc, DBA Testmart. This procurement will proceed on a sole source basis with Technical Communities, Inc, DBA Testmart. 3.A description of supplies/services required (including the estimated value): The VA Hospital in Hines, IL, has a requirement for a system from Technical Communities, Inc, DBA Testmart To provide a high power holmium laser system that can be used to perform holmium laser enucleation of the prostate (HOLEP). This laser is the only laser source that can provide the required wattage to perform the HOLEP procedure on the Hines VA campus. This equipment is essential for surgery. The approximate cost for the equipment is $168,299.10 4.Statutory authority permitting other than full and open competition: FAR 6.302-2. The VA's minimum needs can only be satisfied by unique supplies or services available from only one source. (41 U.S.C. 253 (c)(1)) due to Unusual and compelling urgency. 5.Facilities Unique Qualifications: The VA Hospital in Hines, IL requires this equipment because it is essential for surgery. This product is the only product that has: "A high power holmium laser system that can be used to perform holmium laser enucleation of the prostate (HOLEP). "This laser is the only laser source that can provide the required wattage to perform the HOLEP procedure "System is compatible with current equipment 6.Efforts made to ensure that offers are solicited from as many potential sources as is practicable: The requesting activity noted that there is no other manufacturers of this type of equipment with the required amount of power. 7.Determination by the Contracting Officer that the anticipated cost to the Government will be fair and reasonable: Based on historical data this appears to be a reasonable cost. 8.Market survey conducted: Market research was conducted and only revealed systems in the range of 30 Watts. Go GSA vendor had a comparable system. 9.Other facts: To provide this procedure to veterans as a minimally invasive surgical approach for patient with large prostates we need to acquire this equipment. 10.Other sources expressing an interest: None sought as market research did not reveal a comparable system. 11.Actions to remove or overcome any barriers to competition: None JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION Lumenis Powersuite 100W system, Technical Communities, Inc, DBA Testmart, for the Hines VA VA69D-11-RQ-0348 12.Certification: I certify that this justification is accurate and complete to the best of my knowledge. I posted VA-69D-11-RQ-0348 as a sole source to Technical Communities/DBA Testmart. MD Medical submitted a compatability statement offering the same exact item and I requested a quote from them. 2. My technical expert determined that both companies were offering the same items. When comparing the quotes both companies offered the same exact items at the same exact dollar amount. 3. I contacted the manufacturer to verify both companies were authorized to sell to the government and Lumenis stated they were. I sent out 2 different requests for best and final offers (BAFO) as lowest priced technically acceptable. Round one both came back with the original quote and refused to lower their quote. I waited a week and conducted the 2nd round of BAFO (28 April 2011) MD Medical still refused to lower their quote but Technical Communities/DBA Testmart lowered their quote by $1,000. I Awarded to Testmart 28 April 2011. 4. Notice of non-award will be sent to the following on 28 April 2011 stating award at $167,299.10 to Technical Communities/DBA Testmart. A. Miller and Dickey (MD) Medical, $168,299.10. 5. It is my decision to award to Technical Communities/DBA Testmart. 6. A GSA Waiver was not required for this acquisition. 7.
