- Questions and Concerns with Solicitation VA-263-11-RP-0162: Section B.3, Item 4. Documentation D. Contractor shall comply with any existing and new regulations regarding patient record keeping? We are wondering what this may entail as this is for autopsy services? This is not applicable. Section B.3, Item 6. Applicable VA Directives and Handbooks: Both A. and B. is there anything different in the VA materials vs. what would normally take place with an autopsy? The VA protocol for autopsies is consistent with private sector practice. However, bidders should review procedures for recovery of pacemakers and or implantable defibrillators and procedures for the return or disposal of such items. The reference is VHA Handbook 1106.1 (11.e). Section B.4, Item 1. Contract Performance Monitoring: Parts B. and C. are these applicable and what type of training or inspections? These assessments are performed by the Contracting Officer Technical Representative to verify the contractor is meeting the terms of the contract. Section B.4, Item 2. Quality Assurances: Both A. and B. is this even applicable to autopsy services or was this intended for Physician Services? Refer to the response to the question above. Section B.4, Item 3. Qualifications: as in the immediate above, Part A. are these even applicable to this solicitation? Change this to read simply " Physicians assigned by the Contractor to perform the services covered by this contract shall be board certified in Anatomic Pathology and possess appropriate state licensure." Section B.4, Item 4. Personnel Policy: Parts C., D., and E. Are these relevant to this solicitation? Both individuals associated with this work are Board Certified. Strike C, D and E. Section B.4, Item 6. Contractor Personnel Security Requirements: Part D. Contractor Responsibilities items (1), (3), (7), (9) what needs to be done here? If something needs to happen the VA will cover it? This item is not applicable to this contract. Section B.4, Item 7. Compliance Training Parts A. B. and C. I would question its relevance to this solicitation? This item is not applicable to this contract. Section C.7, 52.228-5 Insurance - Work on a Government Installation (Jan 1997) - We are a Instrumentality of the State of North Dakota and as a self insured entity we can not name additional insured. We would request this be deleted as the services will be completed at a UND facility. This item is not applicable to this contract and shall be removed from the solicitation. Section C.12 VAAR 852.237-7 Indemnification and Medical Liability Insurance (JAN 2008) Part (c) we can not comply with this as we are self insured. The clause has specific language addressing self-insured entities, " ¦if the Contractor is an entity or a subdivision of a State that either provides for self-insurance or limits the liability or the amount of insurance purchased by State entities, then the insurance requirement of this contract shall be fulfilled by incorporating the provisions of the applicable State law" - by providing the applicable state law in your proposal the interested party is compliant with this clause. Section D. 1 Purpose - What needs to be done (QASP) or does anything needs to be done? These assessments are performed by the Contracting Officer Technical Representative to verify the contractor is meeting the terms of the contract.
