Attachment A: Request for Sole Source Memo Format DEPARTMENT OF VETERANS AFFAIRS Justification and Approval for Other than Full and Open Competition 1.Contracting Activity: Department of Veterans Affairs, VISN 1, Boston VA Medical Center VISN 1 Contracting Activity and surgical services are proposing the following contracting action. The request is for Justification for Other Than Full and Open Competition on purchase request 523-11-2-7910-0842 for Alliant Healthcare's Stryker products. 2.Nature and/or Description of the Action Being Processed: This is a sole source justification for Alliant Healthcare Stryker products needed for Orthopedic, Neurology, Cranial surgeries from Alliant Healthcare. Since December 1, 2008, Alliant Healthcare has been the only government authorized distributor of Stryker disposables products. 3.Description of Supplies/Services Required to Meet the Agency's Needs: The following supplies are being placed on a PO for the remaining of fiscal year 2011, ending 09/30/2011, while a full contract is being developed. Supplies are used in various total hip and knee replacements and orthopedic surgeries. These specific items are used with Stryker's equipment which ensure compatibility. Since December 1, 2008, Alliant Healthcare has been the only government authorized distributor of Stryker disposables products. 6.Description of Efforts Made to ensure that offers are solicited from as many potential sources as deemed practicable: An intent to sole source this requirement, VA-241-11-RQ-0549, was posted on FBO for 10 days and there were no responses received. Again, since December 1, 2008, Alliant Healthcare has been the only government authorized distributor of Stryker disposables products. 7.Determination by the Contracting Officer that the Anticipated Cost to the Government will be Fair and Reasonable: The estimated total cost of this order is $119,801.13. The contracting officer feels that the anticipated costs are fair and reasonable on the basis that pricing is in line with previous orders and there will be no charge for regular ground shipping. Also, since December 1, 2008, Alliant Healthcare, who is a SDVOSB, has been the only government authorized distributor of Stryker disposables products. Establishing a standing order with the vendor, who is the only authorized dealer of Stryker disposable products to the government, will allow the requesting service to order their own supplies, thus relieving the need for repetitive purchase orders to be issued. 8.Description of the Market Research Conducted and the Results, or a Statement of the Reasons Market Research Was Not Conducted: As described in Section VI above, market research, in accordance with FAR Part 10, was conducted by synopsis of the proposed acquisition, advising industry of the pending acquisition and soliciting inquiries from interested parties. There were no responses received. Again, since December 1, 2008, Alliant Healthcare, who is a SDVOSB, has been the only government authorized distributor of Stryker disposables products. 9.Any Other Facts Supporting the Use of Other than Full and Open Competition: Since December 1, 2008, Alliant Healthcare has been the only government authorized distributor of Stryker disposables products. 10.Listing of Sources that Expressed, in Writing, an Interest in the Acquisition: See Section VI above 11.A Statement of the Actions, if any, the Agency May Take to Remove or Overcome any Barriers to Competition before Making subsequent acquisitions for the supplies or services required: Contracting activity will continue to encourage brand name or equivalent specifications.
