Description
This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in Subpart 12.6, as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; proposals are being requested and a written solicitation will not be issued. This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in Subpart 12.6 of the Federal Acquisition Regulations (FAR), as supplemented with additional information included in this notice. This announcement constitutes the only solicitation. Offers are being requested and a written solicitation will not be issued. W9124D-11-WILYSWRENEWAL is issued as a Request for Quotation (RFQ), under the Simplified Acquisition Procedures (SAP), Part 13.5. The NAICS code is 511210. The small business size standard is $25M. This acquisition is unrestricted. This procurement is for a firm-fixed-price (FFP) contract. The resultant contract will have reinstatement fee, a base period and two, one-year option periods. CLAUSES INCORPORATED BY FULL TEXT 52.217-6 OPTION FOR INCREASED QUANTITY (MAR 1989) The Government may increase the quantity of supplies called for in the Schedule at the unit price specified. The Contracting Officer may exercise the option by written notice to the Contractor within 30. Delivery of the added items shall continue at the same rate as the like items called for under the contract, unless the parties otherwise agree. (End of clause) 52.217-9 OPTION TO EXTEND THE TERM OF THE CONTRACT (MAR 2000) (a) The Government may extend the term of this contract by written notice to the Contractor within 30 days of contract expiration; provided that the Government gives the Contractor a preliminary written notice of its intent to extend at least 60 days before the contract expires. The preliminary notice does not commit the Government to an extension. (b) If the Government exercises this option, the extended contract shall be considered to include this option clause. (c) The total duration of this contract, including the exercise of any options under this clause, shall not exceed 36 months. (End of clause) 5152.233-4000AMC-LEVEL PROTEST PROGRAM (NOV 2008) (LOCAL CLAUSE) If you have complaints about this procurement, it is preferable that you first attempt to resolve those concerns with the responsible contracting officer. However, you can also protest to Headquarters, AMC. The HQ, AMC-Level Protest Program is intended to encourage interested parties to seek resolution of their concerns within AMC as an Alternative Dispute Resolution forum, rather than filing a protest with the Government Accountability Office or other external forum. Contract award or performance is suspended during the protest to the same extent, and within the same time periods, as if filed at the GAO. The AMC protest decision goal is to resolve protests within 20 working days from filing. To be timely, protests must be filed within the periods specified in FAR 33.103. If you want to file a protest under the AMC-Level Protest Program, the protest must request resolution under that program and be sent to the address below. OVERALL BASIS-Award will be made in the aggregate to the lowest priced, responsive, responsible offeror. Failure to submit an offer on all items will render the offer non-responsive. RFQ NOTES. The government reserves the right to require written documentation from the successful contractor stating it is authorized to resell/distribute CA Wily Software products. Offeror is reminded to complete and return with its offer the certifications contained within this solicitation. The offeror shall include the cost of each deliverable in the appropriate contract line item number (CLIN). Each CLIN shall include ITEM BEING OFFERED; BRAND NAME; MAKE; MODEL; and P/N. The government reserves the right to conduct discussions if the Contracting Officer (KO) later determines them to be necessary. As set forth in FAR 52.215-1(f)(4), the government intends to evaluate offers and award a contract without discussions with offerors (i.e., except for clarifications as described in FAR 15.306(a), Clarifications and award without discussions). Therefore, the offeror's initial offer should contain its best terms from a price standpoint.
