Description
JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITIONfor SIMPLIFIED ACQUISITIONS OVER $3,000 AND UP TO $100,000 (See FAR 13.106-1) Date: 5/31/11 PR Number: R1574110062 1. Nature and/or description of the item/service being procured and its intended use (include the anticipated cost):Two units- portable traffic signals. Solar powered. Delivery and setup will be $750.00 each. Rental for both units is $5,750.00 per month. The Make of the traffic signals is Horizon and the Model is SQ3. Supply lights with micro terminal, 3 extra lights and 1 controller. Lights are supplied with solar panels and will be programmed at time of delivery. 2. Sole Source Justification rationale (Check one and explain below): ______Only one responsible source. ____x__Urgent and compelling circumstances exist. Include critical delivery or performance dates, and when you became aware of the requirement. Provide a specific statement of the impact on Government operations, financial or otherwise, if the required delivery or performance dates are not met. Explain: An emergency situation occurred. A road slide failure on the East Entrance road narrowed the road to a single lane. The road was unsafe for travel and was closed. This road closure severely impacted government operations. Services to the public was greatly impacted. Businesses inside the park and in gateway communities such as Cody, Wyoming and government gate receipts and fees were greatly impacted. Flagging could not be done on a 24 hour basis. These portable traffic lights are needed on a temporary basis to control traffic through this one lane area so that the road can be reopened. The road was closed until this traffic light was set up and operational. The slide became severe on Saturday, May 14. It was not possible to contact suppliers until Monday, May 16. Delivery and setup needed to occur as soon as possible, no later than Wednesday May 18. The repair will require months to design and construct. In order to meet the delivery deadline a short term purchase was arranged and is being continued until Yellowstone National Park can purchase this equipment. This emergency limited the number of companies to those who could respond and meet the deadline. Many sources were contacted and it was determined that it was in the best interest of the Government to purchase these units. The time to process this bid, award and deliver will necessitate that these rental services be provided on an emergency basis until the delivery of the new equipment is made. 3. Market Research. Please explain the results or why one was not performed. State whether any other offers were received or anyone expressed interest:Several contracts for major road work have been administered by the Federal Highway Administration over the last 25 years in Yellowstone National Park. Our market research included contacting FHWA to identify sources for this immediate need. They identified Highway Technologies from Missoula, MT as the most responsive source. Another firm, United Rentals had been used in the past but this company has since been bought out by Highway Technologies.Also, CCR was used to locate contractors in the local area that might provide these units for rental, however when these companies were contacted they were not able to meet our immediate need. A short term rental agreement was necessary to buy enough time to fill the immediate need until the equipment can be purchased.__________________________________________________________________ 4. If this is a determination for sole source, the Contracting Officer certifies: a.Only one source is available, or urgent and compelling circumstances exist. b.The anticipated price will be determined fair and reasonable using the price analysis techniques described in FAR Part 13.106-3(a).
