Description
DEPARTMENT OF VETERANS AFFAIRS Justification and Approval Under Simplified Acquisition Procedures for Restricting Competition 1.Contracting Activity: U.S. Department of Veterans Affairs, Contracting officer VISN20 Jonathan M. Wainwright Memorial VAMC, 77 Wainwright Dr., Walla Walla, Washington 99362 2.Nature and/or Description of the Action Being Processed: for PR # 687-11-2-020-0156. This procurement is for Reference Laboratory Services from Interpath Laboratory in accordance with FAR 13.5 Test Program for Certain Commercial Items and specifically FAR 13.501 Special Documentation Requirements, where acquisitions conducted under Simplified Acquisition Procedures are exempt from the requirements of FAR Part 6, but still require a justification using the format of FAR 6.303-2. a. This is a six (6) month, "Emergency-Stop Gap" contract, and includes the option to extend services IAW FAR 52.217-8 up to an additional six (6) months. This emergency contract will provide critical services during the solicitation and award process for the long term contract. 3.Description of Supplies or Services Required to Meet the Agency's Needs: The contract shall furnish all reference laboratory tests services and Laboratory testing at the rates specified in the billing agreement and transport (courier) of VA specimens from the Community Based Outpatient Clinic locations to the Core Lab in Walla Walla WA. Contractor shall provide courier services of VA laboratory specimens from the Community Based Outpatient Clinics (CBOC) (presently in Yakima Washington, Richland Washington, La Grande Oregon, Lewiston and Grangeville Idaho. Enterprise, Oregon and Boardman, Oregon to be added in 2011) associated with the Jonathan M. Wainwright Memorial VAMC to the Walla Walla Washington laboratory site at least daily Monday through Friday except Federal Holidays and by request of the Walla Walla Core Lab or the CBOC for training days, all other changes must be through the Walla Walla Core Lab Manager. Couriers shall provide services according to IATA transportation regulations. Specimens shall be transported according to Time and Temperature requirements (Room Temperature, Refrigerated and Frozen). Additional courier services may be added or subtracted as additional CBOC's are added or removed.. 4.Statutory Authority Permitting Restriction in Competition: The statutory authority allowing use of other than full and open competition for this requirement is FAR 13.106-1 and FAR 13.5 and specifically 13.501 under Simplified Acquisition Procedures Commercial Items Test Program, as is commensurate with the counterpart FAR Part 6.302-1 Only One Responsible Source, and FAR Part 6.302-2 Unusual and Compelling Urgency. This action is required due to urgent need to keep these vital service requirements met, since the most recent contract expired on March 31, 2011. 5.Demonstration that the Contractor's Unique Qualifications or Nature of the Acquisition Requires the Use of the Authority Cited Above (applicability of authority): Interpath Laboratory is the only vendor that services all the sites in our very rural catchment area. Interpath Lab is the only Reference lab that combines courier services and will drop the VA lab specimens at the WW core lab from the Community Clinics. The additional of this service reduces overall cost to the VA by not have an additional courier contract and provides for faster turnaround time for results to our providers. 6.Description of Efforts Made to Ensure that Offers are Solicited from As Many Potential Sources as Deemed Practicable IAW FAR 13.104: The following Vendors, Reference labs were researched Pathology Regional Lab (Lewiston), Quest/Specialty (Seattle), and Pathology Associates Medical Laboratory (PAML). None of the labs had service at all sites in our catchment area. Interpath was found to be the only Reference Lab to provide the additional courier services. 7.Determination by the Contracting Officer that the Anticipated Cost to the Government will be Fair and Reasonable - IAW FAR 13.106-3: In accordance with FAR 13.106-3(a)(2)(ii)(iii), the anticipated price to the government is $156,000.00 and is determined fair and reasonable based on the comparison to historical costs (PO# 687-C15057) for the most recent services provided by the vendor, which are the same as their FY 2009 pricing. It is determined that the pricing submitted by Interpath Lab represents the best interest of the Government. 8.Description of the Market Research Conducted and the Results, or Statement of Reasons Market Research was not Conducted (FAR 10): See #5. 9.Any Other Facts Supporting the Restriction of Competition: See #2 (a). 10.Listing of Sources that Expressed, in Writing, an Interest in the Acquisition: None 11. Statement of Actions, if any, the Agency May Take to Remove or Overcome any Barriers to Competition before Making Subsequent Acquisitions for the Supplies or Services Required: The anticipated date for the posting of the solicitation for the long term contract is, 1 October 2011; and the anticipated date of award is 1 November 2011. 12.
