Description

JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION FAR 6.302-5, 15 U.S.C. 657f - AUTHORIZED OR REQUIRED BY STATUTE CONTRACTOR - Leak Eliminators, LLC 1. Agency and Contracting Activity Identification: VA Medical Center, Lexington, Kentucky, VISN 9 will enter into a contract that requires justification for other than full and open competition. 2. Nature of Acquisition Being Approved: Contractor shall provide construction services for Project No. 596-11-104, Repair Sewer Lines in Crawl Space, Building 3. 3. Description of Requirement: VA Medical Center, Leestown Road Division, Lexington, Kentucky is requesting to sole source with Leak Eliminators, LLC to replace approximately 80 linear feet of sanitary waste piping, associated traps, elbows, and cleanouts beneath the ground floor of Building 3. 4. Statutory Authority Permitting Other Than Full and Open Competition: The service is being procured under the authority of 15 U.S.C. 631, FAR Part 6.302-5(b)(6). 5. The Demonstration that the Proposed Contractor's Unique Qualifications or the Nature of the Acquisition Requires Use of the Authority Cited: Leak Eliminators, LLC is a Service Disabled Veteran Owned Small Business (SDVOSB) who specializes in water and sewer line and related construction including plumbing and septic tank work. Leak Eliminators has successfully completed other similar projects for the Lexington VA and is recommended by the Engineering Department. The project is well suited for the type of work they do. Leak Eliminators, LLC has submitted their info for CVE verification. 6. A Description of Efforts Made to Ensure That Offers from as Many Potential Sources as Practicable and Whether a Notice Will Be Publicized: This procurement has not been competed/synopsized, as it is the Lexington VAMC's intent to conduct a sole source SDVOSB procurement. The J&A will be publicized within 14 days after an award is made. 7. Anticipated Cost: The cost of the construction is anticipated to be fair and reasonable to the Government. An IGE was prepared by Engineering, which will be utilized in any negotiations with the Contractor. 8. Results of Market Survey: Due to the intent to negotiate sole source with Leak Eliminators, market research was not conducted. Leak Eliminators have performed same or similar jobs at the facility before; thus it was known they had the ability to complete the project. 9. Any Other Facts Supporting the Use of Other Than Full and Open Competition: In accordance with VAAR 819.7007, the Contracting Officer may award contracts to SDVOSB concerns on a sole source basis provided that subparagraphs (1) through (4) can be met. It is the determination of the Contracting Officer that Leak Eliminators, LLC meets all the criteria. 10. Any Other Interested in the Acquisition: There has not been any interested expressed in this acquisition. 11. A Statement of the Actions, if any, the Agency May Take to Remove or Overcome Any Barriers to Competition Before Any Subsequent Acquisition is Required: Not Applicable 12. Contracting Officers Certification. The Contracting Officer has determined that the justification above is accurate and complete to the best of the CO's knowledge and belief.
