- Description
- The Government intends to enter into a firm-fixed-price contract with CommVault Systems, Inc., 2 Crescent PL, Oceanport, New Jersey 07757. The Mission and Installation Contracting Command (MICC), Fort Campbell, KY, has a requirement for a license renewal for Network Enterprise Center (NEC). (See (1) attachment - Sole Source J&A) The procurement will be conducted on a sole source basis in accordance with the statutory authority of 10 U.S.C. 2304(c)(1) as implemented by FAR 13.106-1(b), Only one responsible source and no other supplies or services will satisfy agency requirements. The basis for restricting competition is CommVault installed the initial support 'F6C21 Galaxy software' used by NEC. It's required to archive and recover critical user data to and from SAN and Tape storage archives in the event of a catastrophic failure. CommVault software is currently used to manage the back-up and recovery infrastructure data. CommVault Systems, Inc. manufactures and has proprietary rights to CommVault software. CommVault is the only software that will meet the Government's requirement. NAICS code for this procurement is 511210 and the small business size standard is $25.0M. This sole source requirement will be procured under Simplified Acquisition Procedures using Other Than Full and Open Competition, and awarded on an unrestricted basis. THIS NOTICE IS NOT A REQUEST FOR COMPETITIVE OFFERS and solicitation will not be issued; however, any firm that believes it can meet the requirements may give written notification to the Contracting Officer within 5 days from the date of the publication of this synopsis. Supporting evidence must be furnished in sufficient detail to demonstrate the ability to comply with the requirements listed. Responses received will be evaluated; however, a determination by the Government not to compete the proposed procurement based upon responses to this notice is solely within the discretion of the Government. If no responses are received, the Government will proceed with the sole source negotiation with CommVault Systems, Inc. Responses are due by 17 June, 1000 (CST).
