- JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION IAW FAR 6.203-2 VETERANS BENEFITS ADMINISTRATION Upon the basis of the following justification, I hereby approve the issuance of the contractual action described below using other than full and open competition, pursuant to the authority cited herein. 1. Contracting Activity Department of Veterans Affairs Veterans Benefits Administration Office of Facilities Management (20M31) Washington, DC 20420 2. Nature of Action Being Approved: The Department of Veterans Affairs (VA) intends to procure from C-CAT, Inc. for materials and labor to install cabling, security and AV infrastructure for the VA Regional Office in Indianapolis, IN. C-CAT, Inc. is an emerging small business with a GSA Schedule that was a subcontractor on phase I of our renovation project. It is in the government's best interest to sole source this task to C-CAT, Inc. We are currently in the phase II construction and due to unusual and compelling need, we don't have time to compete out this project. Per FAR 6.302(2) the delay would result in financial loss by having the Regional Office (RO) operational. They are the only responsible source that has current access to the Federal Campus and VA space would allow the VA to avoid unnecessary burdens to complete this requirement. We are expecting occupancy of this space by the end of November 2011. It was determined that C-CAT would use their GSA schedule to provide pricing for this project. 3. Description of Service and Supplies: This justification and approval sets forth the facts and request approval for a contract to be issued with a vendor that is certified and authorized on the GSA Schedule. The required services are mandatory to satisfy the relocation date and minimize any interruptions to the Regional Office. The proposed contract costs are estimated at $856,250.00 4. Statutory Authority: The statutory authority of this justification is FAR 6.302 (2). 5. Rationale Supporting Use of Authority Cited Above: The RO is currently located partially in two different swing space sites, 10 miles away from their permanent location at Federal Building which is under renovation and has to relocate on the above date to minimize additional charges. GSA has established an aggressive schedule for this relocation and the installation of the cabling, audiovisual and security equipment must coincide with the construction schedule for this project. The construction for this project has started and is scheduled for completion in November 2011. Any delays with this project will have a direct negative impact on the Regional Offices and the phase two of the VARO renovation project. Currently the Regional Office has taken partial occupancy of the office space and must be fully operational at the above date. 6. Description of Market Research: N/A 7. Determination of Fair and Reasonable: Prices are determined to be reasonable and are consistent with the contractor's GSA schedule pricing. 8.
