This proposed contract action is used for Orthopedics Department requesting Arthroscopic restocking supplies. The Naval Medical Center San Diego intends to solicit with only one source under the authority of FAR 13.106-1(b). The source is Depuy Mitek, Inc., CAGE Code: 0J723, NAICS: 339112. Justification: As required by FAR 13.106-1(b), the Contracting Officer has determined that Depuy Mitek, Inc. consumables is the only company that manufactures and distributes the supplies that is compatible with the equipment currently used by NMCSD. IAW FAR 5.207(c)(15)(ii), all responsible sources may submit a quotation, which shall be considered by the agency. The Government will only consider firm, fixed price quotations. The attached solicitation document and incorporated provisions and clauses are those in effect through FAC 2005-51. It is the contractor 冱 responsibility to be familiar with the applicable clauses and provisions. The clauses may be accessed in full text at www.acquisition.gov and / or www.acq.osd.mil.
