- The Corps of Engineers Honolulu District is soliciting comments from the construction community addressing the potential use of Project Labor Agreements (PLA) on the Central Vehicle Wash Facility from large scale construction projects (exceeding $25 million) within the State of Hawaii. A PLA is defined as a pre-hire collective bargaining agreement with one or more labor organizations that establishes the terms and conditions of employment for a specific construction project and is an agreement described in 29 U.S.C. 158(f). Federal Acquisition Regulation (FAR) Policy: (a) Project Labor Agreement (PLA) is a tool that agencies may use to promote economy and efficiency in Federal procurement. Pursuant to Executive Order 13502, agencies are encouraged to consider requiring the use of project labor agreements in connection with large-scale construction projects. (b) An agency may, if appropriate, require that every contractor and subcontractor engaged in construction on the project agree, for that project, to negotiate or become a party to a project labor agreement with one or more labor organizations if the agency decides that the use of project labor agreements will (1) Advance the Federal Governments interest in achieving economy and efficiency in Federal procurement, producing labor-management stability, and ensuring compliance with laws and regulations governing safety and health, equal employment opportunity, labor and employment standards, and other matters; and (2) Be consistent with law. Reference: Provision: 52.222-33 Notice of Requirement for Project Labor Agreement Clause 52.222-34 Project Labor Agreement. Request responses to the following questions: (1) Should PLAs be executed on selected large dollar contracts in State of Hawaii? (2) Are there concerns by prime contractors on the availability of skilled construction labor? (3) Would a PLA benefit a project which contains a unique and compelling mission-critical schedule? (4) What type of project should not be considered for PLA clauses? (5) What is the time impact to the completion of the contract due to a PLA? (6) What is the cost impact to the bid due to a PLA? (7) What other factors should the Corps consider before deciding to include PLA provisions in a Honolulu Engineer District contract? The Corps of Engineers, Honolulu District, is soliciting project specific comments from the construction community addressing the potential use of Project Labor Agreements (PLA) on the FY12 PN59581 Central Vehicle Wash Facility, Schofield Barracks, Hawaii. Project Description: A design-bid-build construction solicitation for the construction of a Central Vehicle Wash Facility located at Schofield Barracks, Hawaii. The proposed facility will consist of a pre-wash bath; ten wash stations, consisting of 6 single and two tandem wash bays; and a separate four bay maintenance facility to allow detailed washing of tactical vehicles prior to maintenance. The wash process system will utilize a high-pressure wash system that will recycle water to reduce potable water consumption and minimize wastewater disposal. The recycled water will flow through a sedimentation basin, an oil-water separators, an equalization basin, an intermittent sand filter, and then into two 740,000 gallon storage tanks. Treatment will include oil and grease removal, grit removal, organic control, and chlorine disinfection. The facility will also consist of a mechanical pump building and control building which will house an operator's office, restroom, and equipment storage room Project will also demolish an existing pavilion, restroom and paved parking area. Supporting facilities include utilities, communications, storm drainage and erosion control measures, approximately 118,000 SF concrete paving, curbing, landscaping, fencing and site improvements. As part of the sewer utility, the project will install approximately 7,500 lf of sewer line. LEED Silver certification is required. Project Magnitude: $25 Million to 100 Million. Please provide project specific information. Clearly state which project(s) your response applies to: a. Should a PLA be executed on each project? b. Is the use of PLAs effective in achieving economy and efficiency on the central vehicle wash? What is the estimated relative cost impact, or any other economies or efficiencies derived by the Federal Government, if using PLAs? Will a PLA impact the cost of submitting an offer? c. Will a PLA produce labor-management stability on the barracks project? Have labor disputes or other labor issues contributed to project delays on barracks type projects in the local area? If so, please provide examples containing the date and a brief summary. d. Does the complexity of a design build vehicle wash project justify the use of PLAs? If yes, provide explanation. e. Please identify the shortages of skilled labor in the region (Oahu, Hawaii) for those crafts or trades required the barracks project? f. What is the anticipated volatility, one (1) to four (4) years, in the labor market for the trades required for the execution of the projects? g. Have PLAs been used on comparable projects undertaken by Federal, State, municipal, or private entities in the geographic area of this project? h. Would consideration of a small business set aside make a PLA more or less appropriate to meet the design build barracks project? Provide a brief explanation. The construction community is invited to comment on the use of PLAs for this project. Responses shall be submitted via email to POH-CECT@usace.army.mil no later than 1:00 PM Hawaii Standard Time on 18 July 2011. Title of the response is: "Central Vehicle Wash PLA Response". This is NOT a Request for Proposal and does not constitute any commitment by the Government. Responses to this labor market survey will be used by the Government to make appropriate acquisition decisions. All interested sources must respond to future solicitation announcements separately from responses to this market survey.
