- This is a notice of intent, not a request for a proposal. A solicitation document will not be issued and proposals will not be requested. The National Institute on Drug Abuse (NIDA), Intramural Research Program (IRP) intends to solicit, negotiate and award a purchase order on a noncompetitive basis with Bruker Biospin Corp., 15 Fortune Drive, Billerica, MA 01821. The National Institutes on Drug Abuse (NIDA), Division of Intramural Research in Baltimore, Maryland requires the following: Maintenance Agreement on BioSpec MRI - BT000503 System for a period of one year (9/1/2011 to 8/31/2012) to include Cryo Cooler Service and Extended Parts Service. The North American Industry Classification System (NAICS) Code is 334516, Analytical Laboratory Instrument Manufacturing. The appropriate statutory authority is 41 USC 253 (c) (1), as set forth in FAR 6.302-1(b)(1)(i). The cited authority is applicable because Bruker Biospin MRI Corporation is the only source that can fulfill the requirements of this contract. An award to any other source would result in substantial duplication of cost to the Government that is not expected to be recovered through competition. The acquisition is being conducted under simplified acquisition FAR 13 and is exempt from the requirements of FAR Part 6, Competition Requirement. This notice of intent is not a request for competitive proposals. Interested parties may identify their interest and capabilities in response to this synopsis. The determination by the Government not to compete the proposed contract based upon responses to this notice is solely with the discretion of the Government.
