Description
The Contracts Department of the NAVSUP Fleet Logistics Center San Diego, in accordance with FAR Part 12 and FAR Part 13.5 intends to award a firm-fixed price requirement on a sole source basis to Oxford Instruments America, Inc. of Concord, MA for one (1) each Plasma Enhanced Chemical Vapor Deposition (PECVD) instrument in order to support the Naval Post Graduate School. This requirement is being issued on a sole source basis to Oxford Instruments America, as only Oxford Instruments America is able to provide a product including all of the required technical requirements and specifications and both PECVD and DRIE capabilities. Oxford Instruments America holds all copyrights and patents for this system. The proposed contract action is for commercial supplies for which the Government intends to solicit and negotiate with only one source under the authority of FAR 13.501(a)(1)(ii). This notice of intent is not a request for competitive quotes; however, all quotes received within seven (7) days (commercial purchase procedures are being used using FAR 13.5 procedures) after date of publication of this synopsis will be considered by the Government for the purpose of determining whether or not to compete the requirement. A determination by the Government not to compete this proposed purchase order based upon responses to this notice is solely within the discretion of the Government. An award is anticipated to be made on or about 29 July 2011. The applicable NAICS code for this requirement is 334513.
