- Notice Type:Special Notice Title: Notice of Intent to Award Other than Full and Open Competition for FAA approved Maintenance Steering Group -3 (MSG-3) Low Utilization Maintenance Program (LUMP) for one DC-9 aircraft with Boeing of Seattle Washington. The purpose of this special notice is to post a Justification for Other Than Full and Open Competition. The National Nuclear Security Administration (NNSA) Service Center in Albuquerque, New Mexico, plans to contract by means other than full and open competition per the Competition in Contracting Act (CICA) on behalf of the Office of Secure Transportation (OST), Program Office for Aviation Operations (POAO) with The Boeing Company (Boeing) for the Federal Aviation Administration (FAA) approved Maintenance Steering Group -3 (MSG-3) Low Utilization Maintenance Program (LUMP) which includes FAA approved aircraft maintenance manuals and publications to maintain one (1) Government Douglass Corporation -9 (DC-9) Aircraft. This document sets forth the justification and approval for an exception to full and open competition allowed under the Competition in Contracting Act of 1984 (CICA) and FAR 6.302-1 entitled ?Only one responsible source and no other supplies or services will satisfy agency requirements.? This is a sole source acquisition with Boeing of Seattle, Washington, for the FAA approved MSG-3 LUMP which includes FAA approved aircraft maintenance manuals and publications, which are required to maintain one (1) Government DC-9 Aircraft. Boeing owns the Douglas Corporation and they are the Original Equipment Manufacturer (OEM) of the aircraft and the only company with both the FAA approved MSG-3 LUMP inspection program and FAA approved aircraft maintenance manuals and publications. Regardless of the aircraft flight operating rules, the Government is required by Title 14 CFR 91.409(e) to establish a FAA approved aircraft maintenance program prior to operating fleet aircraft. Title 14 CFR 91.409 (f) (3) requires the Government to select an inspection program that is recommended by the aircraft manufacturer, Boeing Aircraft Company (Boeing) recommends the MSG-3 inspection program for maintaining the DC-9 aircraft and produces and provides revisions to the FAA for this inspection program. This approved inspection is referred to as the MSG-3 inspection program. To be in compliance with the aforementioned Title 14 CFR requirements, this inspection program meets the regulatory requirement. The Government does not have the resources to develop, maintain, and submit for approval (to the FAA) an inspection program that meets Title 14 CFR 91.409 requirements and therefore, will procure the inspection program from Boeing, the OEM. In addition to the standard MSG-3 inspection program, Boeing has a low utilization maintenance program that can be tailored to meet the user?s requirements when aircraft are operated in what is considered to be low utilization situations. This LUMP will allow for longer intervals between maintenance events on certain critical aircraft components effectively reducing the overall long term cost of maintenance support on the aircraft. The most cost effective maintenance program for the NNSA/OST/POAO aircraft based upon anticipated aircraft usage has been determined to be the Boeing MSG-3 LUMP. The procurement will be a firm fixed price contract for the MSG-3 LUMP, and funds are currently available. The Government will provide the anticip ated annual aircraft usage to Boeing and they will provide an MSG-3 LUMP specifically tailored to the NNSA/OST/POAO needs. The FAA approved manufacturer?s Inspection Program is required to maintain the aircraft to the Title 14 Code of Federal Regulation requirements. The aircraft manufacturer, Boeing is the only source for this FAA approved Inspection Program. The manufacturer also provides the frequent Inspection Program updates. The DC-9 aircraft is currently and in the past has been maintained by a contract under its FAA 121 maintenance certificate, but that contract expires in November 2011, and the contractor owns the maintenance program. This contract will allow the Government to own the DC-9 aircraft inspections program to maintain the aircraft to the 14 CFR requirements. The statutory authority for other than full and open competition is 10 U.S.C. 2304 (c) (1), Only One Responsible Source and No Other Supplies or Services will Satisfy Agency Requirement. The applicable NAICS code is 488190 Other Support Activities for Air Transportation. THIS NOTICE IS NOT A REQUEST FOR COMPETITIVE QUOTES OR A SOLICITATION FOR OFFERS. However, any firm that believes it can meet the requirements, as outlined above may give written notification prior to the response due date. Responses are required to be submitted before August 3, 2011, 2:00 p.m. Mountain Time. Responses shall be submitted via e-mail to corinne.sisneros@doeal.gov and supporting evidence must be furnished in sufficient detail to demonstrate the ability to perform the requirements listed. Responses received will be evaluated; however, a determination by the Government not to compete the proposed procurement based upon responses to this notice is solely within the discretion of the Government.
