- The Fleet Logistics Center (FLC) Norfolk, Contracting Department, Philadelphia Office, intends to solicit, on an Other Than Full and Open Competition basis, for the acquisition of Litigation Support for Department of States Government defense of the Iranian Foreign Military Sales (FMS) claims against the US Government at the Iran- US Claims Tribunal. The services will be accomplished through the issuance a new contract which will extend the performance period under the existing contract W91CRB-06-F-0243. The extension will consist of a 3-month period to enable continued performance of the required services until a competitive follow-on contract is awarded. The extension is for non-commercial services for which the Government intends to solicit and negotiate with only one source (Avaya Government Solutions, 12730 Fair Lakes Circle, Fairfax, VA 22033), under the statutory authority permitting other than full and open competition, Section 4202 of the Clinger-Cohen Act of 1996, as implemented by FAR 13.501(a). The applicable NAICS code is 541611 with a size standard of $7M. Work performed under this extension will continue to support the Office of General Counsel and the Department of State. The work is performed primarily at the contractor ™s site. The contractor ™s efforts focus on providing litigation support to assist the Navy and Department of State in finalizing their factual arguments and evidentiary backup, including reviewing the written briefs and evidence for accuracy prior to the final product being filed with the Iran-U.S. Claims Tribunal in early 2012. The Government requires an extension for three (3) additional months through 31 December 2011. Avaya Government Solutions, as incumbent under Contract W91CRB-06-F-0243, is considered the only contractor that can provide all services in the required timeframe. This extension is necessary because award of the competitive follow-on contract is not anticipated to take place until approximately December 2011 and the Government has a continuing need for the services being provided under the current contract. This notice of intent is not a request for competitive proposals. However, the Government will consider all requests within forty-five days after the date of publication of this synopsis. The Government will not pay for information received.
