Description
DENTAL HYGIENIST BID SPECIFICATIONS I. SERVICES REQUESTED Position Hours Period of Performance Dental Hygienist 16/week 10/01/11- 09/30/13 The Center Director shall have the authority to request that any contractor assigned staff member be replaced, with just reason or cause. II. PERIOD OF PERFORMANCE Offeror shall submit annual price quotes for the base period of 2 years, October 1, 2011 through September 30, 2013, as well as three (3) one year extensions. Each extension year will be awarded based on an annual performance review, contingent on receiving Department of Labor Approval and funds for payment of services. In accordance with the directions of the National Office of Job Corps, yearly cost increases will be predicated upon U.S. Department of Labor Direction. III. STATEMENT OF WORK The Dental services to be provided will include, but not be limited to those medical services enumerated in the Job Corps Federal Regulation (Title 20, Code of Federal Regulations, 638.510 amended) and Policy and Requirements Handbook (PRH) Chapter 6 and appendices. IV. QUALIFICATIONS The Dental Hygienist serving the Center must be licensed to practice in the State of New Mexico. A copy of their current license (s) must be provided to the Center, along with any renewals during the life of the contract. The dental hygienist will have the knowledge and ability to deliver all services normally available in a general dental practitioner's office. This Includes: •· Dental Health Education •· Diagnostic services, including x-rays V. SCOPE OF DENTAL HYGIENIST SERVICES 1. The Services of the dental hygienist will be as follows: a. Oral examinations, emergency and routine dental care to average a maximum of sixteen (16) hours per week on a schedule to be mutually agreed upon. b. All routine care will be performed on site. Emergency care may also be performed on site, or at a mutually agreed upon agency. Care will be given based on the type needed and according to the priority system listed in the Job Corps Regulation (Title 20, Code of Federal Regulations, 638.). c. Provision of services for routine high priority care as outlined by Dentist. d. Provision of an appropriate referral system to ensure the receipt of special care as defined by the PRH and in house protocols. e. Provision of necessary preventative dental health education to include instruction on brushing, flossing and other issues which will promote the oral hygiene of all students. f. Follow outlined care by care plan or Dentist's orders. 2. The services of the dental hygienist will include provision of dental prophylaxis, x-rays, oral exams, charting and chair side preventative counseling under the direction of the dentist in accordance with the State Laws, Professional Licensee and Job Corps Regulation. 3. The development, implementation and monitoring of the total Center dental health program will include, but not be limited to the following: a. Advise to the Dentist, Dental Assistant, Health Services Manager in all dental matters. b. Provision for assistance in developing the coordination and integration of the Dental Health program with the other health components and other Center activities. c. Identification and utilization of the most appropriate and least expensive source for obtaining necessary dental pharmaceutical supplies. d. Assistance in the development and implementation of the dental education component of the health education. e. Maintenance and confidentiality of all required dental records ( See Items 4, 5, 6, 7,and 8 below). 4. Recitals for HIPAA a. Covered entity and Business associate are parties to a Business Associate Agreement and/or business associate provisions within an agreement between the parties (the BAA) b. The Amendment section of the BAA permits covered Entity to amen d the BAA to comply with the law or regulation affecting the use and /or disclosure of PHI by providing 30 days written notice to either party. c. The Health and Insurance portability and Accountability Act has promulgated Security Regulations which require additional obligations on both parties involved in the BAA. d. The security amendment allows for both parties to comply with the security regulation of the HIPAA law. 5. Amendments: Agreements by Third Parties The Business Associates (AJCC and Dental Hygienist) will enter into an agreement with each other. Both will have access to PHI that is received from, or created, or received by, the Business Associates on behalf of the Covered Entities pursuant to which such agent or subcontractor agrees to be bound by the same restrictions, terms and conditions that apply to the Business Associates pursuant to the Agreement with respect to such PHI. 6. Disclosure of PHI The Business associates also known as the Albuquerque Job Corps Center (AJCC) and (Dental Hygienist) will ensure that contractors and agents do not disclose PHI received from the covered entities in any manner that would constitute a violation of HIPAA if disclosed by the covered entities, except that AJCC and RDH may disclose PHI in a manner permitted pursuant to the applicable Agreement or as required by law. To the extent the AJCC and RDH discloses PHI (including PHI in an electric format) to a third party, the AJCC and Registered Dental Hygienist must obtain, prior to making any such disclosure: (a) written approval from the Covered Entities for such disclosure: (b) reasonable assurances from the third party that such PHI will be held confidential as provided pursuant to the applicable Agreement and only disclosed to such third party; and (c) an agreement from such party to immediately notify the Business Associate of any breaches of the confidentiality of the PHI, to the extent it has obtained knowledge of such breach. 7. Safeguards against misuse of information. The parties agrees that it will implement appropriate safeguards to prevent the unauthorized use or disclosure of PHI in an electronic format, The involved parties will implement administrative, physical and technical safeguards that reasonably and appropriately protect the confidentiality, integrity, and availability of electronic PHI. All parties involved in the contract and sub-contract will ensure that any agent, including a subcontractor, to whom it provides electronic PHI agrees to implement reasonable and appropriate safeguards to protect such electronic PHI. 8. Reporting of disclosures of PHI. The parties will, within five (5) days of becoming aware, report to covered entity and Security Incident or disclosure of PHI in violation of the Agreement by the Business Associates, it's officers, directors, employees, contractors or agents or a third party to which the Business Associate discloses PHI pursuant to section B, report any such security Incident or disclosure to the covered entity. VI. DOCUMENTS All publications and documentations referenced herein are available for inspection (by appointment) at the Albuquerque Job Corps Center. VII. PAYMENT FOR SERVICES The Center will pay the independent contractor upon presentation of a monthly itemized invoice for services rendered. The offeror will provide in detail price quotes for the base period of October 1, 2011 through September 30, 2013, as well as yearly extensions. Each extension will be awarded based on annual review and contingent upon receipt of Department of Labor approval and funds for payment of said services. VIII. TERMS OF AGREEMENT The independent contractor agrees to adhere to the policies, procedures and guidelines established by Job Corps. It is mutually agreed that the dental hygienist will have primary responsibility to implement the program outlined above. The dental hygienist will be assisted in the development, implementation and operation of the dental program by the Health and Wellness Manager, the Center Director and the Regional Dental Consultant who will act under guidance and direction from the National Director, U.S. Department of Labor, Job Corps, Washington, D.C. IX. TERMS AND CONDITIONS Under the agreement, the individual or dental subcontractor shall be an independent contractor and not an employee or agent of DEL-JEN INC. OR THE Department of Labor, Job Corps. The contractor agrees to indemnify and save harmless the Center and the U.S. Department of Labor Employment and Training Administration from any and all judgments, orders, awards, cost and expenses, including attorney's fees, and also claims on account of damages to property or employees in connection with work performed. This indemnification shall be through the provision of a certificate of professional liability insured in the minimum of $1,000,000.00 The agreement may be terminated at any given time by either party upon a thirty (30) day written notice to the other, effective thirty (30) days after acknowledging receipt of the notice. The independent contractor agrees to make no public statements concerning Job Corps students or Job Corps activities without prior written approval of the Center Director of the designated representative. All research and/or publications relating to the Job Corps health activities will be cleared through the Center Director and the National Health Office, U.S. Department of Labor, Job Corps, Washington, D.C. This agreement will contain the entire agreement between the parties, except when amended by a revision in the Law or as agreed upon by both parties in writing. It may not be modified or added to except by a written instrument signed by both parties. The agreement will, in general conform to the terms and conditions of this Invitation for Bids (IFB) with such additions and/or modifications as are mutually agreed upon by the two parties. The Agreement is subject to approval by the U.S. Department of Labor. XI. CONTRACT BIDS Bids must be submitted to the Purchasing Agent or the Director of Administrative Services by August 26, 2011.
