Description
MEDICAL SERVICES BID SPECIFICATIONS I. PERIOD OF PERFORMANCE Offeror shall submit price quotes for the base period of 2 years, October 1, 2011 through September 30, 2013, as well as 3 one year extensions. Each extension year will be awarded based on an annual performance review, contingent on receiving Department of Labor approval and funds for payment of services. In accordance with the directions of the National Office of Job Corps, U.S. Department of Labor, yearly cost increases will be predicated upon U.S. Department of Labor. •II. STATEMENT OF WORK The medical services to be provided will include, but not be limited to those medical services enumerated in the Job Corps Federal Regulations (Title 20, Code of Federal Regulations, 638.510 amended) and the Policy and Requirements Handbook (PRH) Chapter 6 and appendices. •III. QUALIFICATIONS The Center Physician(s) must be able to provide, to the Center, all current and valid licenses, DEA numbers, and insurance coverage's needed to practice in the State of New Mexico. It is also required that the Medical Provider (s) be available to admit, refer for admittance into local Hospitals as warranted. •IV. SCOPE OF MEDICAL SERVICES •1. The services of the sub-contractor will be made available to the Center at it's medical facilities in Albuquerque, New Mexico as follows: •a. Such services will be provided for an average of twenty (20) hours per week (Monday through Friday) as mutually agreed upon. Excluding all designated Center Holidays. •b. The Physician will be fully supported by the Center's in-house medical staff and resources in providing the services for: •i. Physical examinations of all new students in order to establish and develop a base- line medical assessment record for each student. ii. Provide oversight for all routine skin (PPD), x- rays ( when indicated) and laboratory tests. •ii. Assessment and treatment of students who report to the Wellness area due to apparent illness. •iii. Treatment of and or consultation of emergency accidental situations. •iv. Provision for or the arrangement of administration of all required immunizations as directed in Chapter 6. •v. Provision of all necessary referrals for specialists and follow up on any student admissions to the hospitals. •vi. Provision for clinical oversight and utilizing of the PALS line to determine the status of students who are hospitalized for the purpose of continuity of care. •vii. Provision of 24 hour coverage utilizing the Emergency Room as deemed necessary by the MD or R.N. on call. ix. The physician (s) shall adhere to all HIPAA regulations and ensure that there is no violation in the law. 2. The Physician (s) may be called upon to offer "emergency" treatment or telephonic advice in the instances of extreme medical emergencies, at hours of the day other than those assigned above. •3. Medical Services shall be available: •a. At the Center •b. At the Physicians office or clinic •c. At such other places as directed by the Center Director and the Professional to meet the needs of the student. •d. Monitoring the health education program and implementing needed changes. •e. Provision of assistance to the Manager of the Wellness program in developing agreements with hospitals for inpatient care and other needed services. •V. Recitals for HIPAA •a. Covered entity and Business associate are parties to a Business Associate Agreement and/or business associate provisions within an agreement between the parties (the BAA) •b. The Amendment section of the BAA permits covered Entity to amend the BAA to comply with the law or regulation affecting the use and /or disclosure of PHI by providing 30 days written notice to either party. •c. The Health and Insurance portability and Accountability Act has promulgated Security Regulations which require additional obligations on both parties involved in the BAA. •d. The security amendment allows for both parties to comply with the security regulation of the HIPAA law. •VI. Amendments A. Agreements by Third Parties: The Business Associates (AJCC and xxxxx) will enter into an agreement with each other. Both will have access to PHI that is received from, or created, or received by, the Business Associates on behalf of the Covered Entities pursuant to which such agent or subcontractor agrees to be bound by the same restrictions, terms and conditions that apply to the Business Associates pursuant to the Agreement with respect to such PHI. B. Disclosure of PHI: The Business associates also known as the Albuquerque Job Corp Center (AJCC) and (xxxxx) will ensure that it's directors, officers, employees, contractors and agents do not disclose PHI received from the covered entities in any manner that would constitute a violation of HIPAA if disclosed by the covered entities, except that AJCC and xxxxx may disclose PHI in a manner permitted pursuant to the applicable Agreement or as required by law. To the extent the AJCC and xxxxx discloses PHI (including PHI in an electric format) to a third party, the AJCC and xxxxx facilities must obtain, prior to making any such disclosure: (a) written approval from the Covered Entities for such disclosure: (b) reasonable assurances from the third party that such PHI will be held confidential as provided pursuant to the applicable Agreement and only disclosed to such third party; and (c) an agreement from such party to immediately notify the Business Associate of any breaches of the confidentiality of the PHI, to the extent it has obtained knowledge of such breach. C. Safeguards against misuse of information: The parties agrees that it will implement appropriate safeguards to prevent the unauthorized use or disclosure of PHI in an electronic format, The involved parties will implement administrative, physical and technical safeguards that reasonably and appropriately protect the confidentiality, integrity, and availability of electronic PHI. All parties involved in the contract and sub-contract will ensure that any agent, including a subcontractor, to whom it provides electronic PHI agrees to implement reasonable and appropriate safeguards to protect such electronic PHI. D. Reporting of disclosures of PHI: The parties will, within five (5) days of becoming aware, report to covered entity and Security Incident or disclosure of PHI in violation of the Agreement by the Business Associates, it's officers, directors, employees, contractors or agents or a third party to which the Business Associate discloses PHI pursuant to section B, report any such security Incident or disclosure to the covered entity. E. Availability of books and records. Both Business Associates agree to make it's internal practices, books, records, policies and procedures and documentation relating to the use and disclosure of PHI (including electronic PHI) received from, or created or received by the Business Associate on behalf of the covered entities available to the Secretary for purposes of determining the covered entities and the Business Associate's compliance with HIPAA. •VII. PAYMENT FOR SERVICES The center will pay the independent contractor upon presentation of a monthly itemized invoice for services rendered within a 30 day period. The offeror will provide in detail price quotes for the base period of October 1, 2011 through September 30, 2013, as well as yearly extensions as predicated by Department of Labor. Each extension will be awarded based on annual reviews and contingent upon receipt of Department of Labor approval and funds for payment of services. •VIII. DOCUMENTS All publications and documents referenced herein are available for inspection (by appointment) here at the Albuquerque Job Corps Center. IX. TERMS OF THE AGREEMENT The independent contractor agrees to adhere to the policies, procedures and guidelines established by Job Corps including HIPAA as outlined. It is mutually agreed that the Medical Provider will have primary responsibility to implement the program outlined above. The medical provider will be assisted in the development, implementation and operation of the medical program by the Health and Wellness Manager, the Center Director, U.S. Department of Labor, Job Corps, Washington D.C. •IX. TERMS AND CONDITIONS Under the agreement, the individual or medical subcontractor shall be an independent contractor and not an employee or agent of DEL-JEN, INC. or the Departments of Labor, Job Corps. The contractor agrees to indemnify and save harmless the Center and the U.S. Department of Labor. Employment and Training Administration from any and all judgment orders, awards, cost and expenses, including attorney's fees, and also claims on account of damages to property or bodily injury, including death, which may be sustained by themselves or employees in connection with work performed. The indemnification shall be through provision of a certificate of Professional liability in the minimum of $1,000,000.00. The agreement may be terminated at any given time by either party upon a thirty (30) days after acknowledging receipt of the notice in writing. The independent contractor agrees to make no public statements concerning Job Corps students or Job Corps activities without prior written approval of the Center Director or the designated representative. All research and/or publications relating to Job Corps health activities will be cleared through the Center Director, and Health Office, U.S. Department of Labor, Job Corps, Washington, D.C. The agreement will contain the entire agreement between the parties, except when amended by a revision in the Law or as agreed upon by both parties in writing. It may not be modified or added to except by a written instrument signed by both parties. The agreement will, in general conform to the terms and conditions of this Invitation for Bids (IFB) with such additions and/or modifications as are mutually agreed upon by the two parties. The Agreement is subject to approval by the U.S. Department of Labor. XI. CONTRACT BIDS Bids must be submitted to the Purchasing Agent or Director of Administrative Services by August 26, 2011.
