Description
JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION Puerto Rico Seismic Network Tsunami Warning Project This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in FAR Subpart 12.6 and as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; proposals are being requested and a written solicitation will not be issued. The request for proposals (RFP) is issued under Simplified Acquisition procedures (SAP), Subpart 13.5. The solicitation number is NWWB02001104695 and is issued as a request for proposal (RFP). The solicitation document and incorporated provisions and clauses are those in effect through Federal Acquisition Circular FAC 2005-53. The associated North American Industrial Classification System (NAICS) code for this procurement is 541712. This acquisition is not a small business set aside. The Department of Commerce (DOC), National Oceanic Atmospheric Administration (NOAA), National Weather Service (NWS), Marine and Coastal Weather Service intend to solicit on a non-competitive basis with the University of Puerto Rico at Mayaguez's Puerto Rico Seismic Network (PRSN) Observatory. Vendors who believe they can satisfy the Government's requirement are invited to submit an affirmative response. To be considered an affirmative response, vendors must submit written data and documentation which demonstrates they can meet the requirement set forth in the Statement of Work (SOW) titled, ‘Upgrade PRSN to Provide Local and Regional Tsunami Warning Capabilities Contract Extension' including detailed specification information and other literature sufficient to permit agency analysis to determine bona fide capability to meet the requirement. A determination by the Government not to compete this requirement on a full and open competitive basis is based on responses received to the synopsis, is solely within the discretion of the Government. All responsible sources will be considered in evaluating the determination to issue a sole source contract award. A firm fixed price purchase order is contemplated for this effort. Evaluation will be based on technically acceptable, low price with acceptable past performance. To be technically acceptable, the proposal must meet all the requirements set forth in the SOW. The following clauses are incorporated by reference and are applicable to this solicitation: FAR 52.212-1, Instructions to Offerors Commercial applies to this acquisition and a statement regarding any addenda to the provision; 52.212-3, Offeror Representations and Certifications - Commercial Items; 52.212-4, Contract Terms and Conditions - Commercial Items; 52.212-5, Contract Terms and Conditions Required to Implement Statues or Executive Orders - Commercial Items applies to this acquisition and a statement regarding which, if any, of the additional FAR clauses cited in the clause are applicable as follows; 52.222-3, 52.222-19, 52.222-26, 52.222-35, 52.222-36, 52.222-37, 52.232-33.
