This announcement constitutes the only solicitation; proposals are being requested and a written solicitation will not be issued. (ii) This solicitation is issued as a Request for Quote (RFQ)/Request for Proposal (RFP) against solicitation number FA2550-11-T-2009 ; Tunable YIG Filters (iii) This solicitation document and incorporated provisions and clauses are those in effect through Federal Acquisition Circular (FAC) 2005-53 effective 05 July 2011. (iv) The North American Industrial Classification System (NAICS) Number is 334419 - Other Electronic Component Manufacturing. Size standard for this NAICS is 500 employees. This proposed acquisition is a 100% Small Business Set-Aside. Only information provided in the quote by the contractor will be used to determine technical acceptability. The contractor shall furnish all labor, parts materials, equipment, and transportation necessary to deliver the following within 45 days after contract award (this will keep consistency with the information in vii) (vii) Date(s) Period of performance is 45 days. Place of delivery and acceptance: FOB point is Schriever AFB, Colorado. (viii) Provision at 52.212-1, Instructions to Offerors -- Commercial, applies to this acquisition. Offerors must comply with all instructions contained in FAR 52.212-1, Instructions to Offerors--Commercial Items. FAR 52.212-1 is supplemented per following addenda: Contractor shall submit their quotation on company letterhead stationery, provide solicitation number, the time specified in the solicitation for receipt of offers, name, address, and telephone number of the offeror, unit price, and overall total price, a technical description of the item being offered in sufficient detail to evaluate compliance with the requirements in the solicitation, terms of any expressed warranty, price, any discount terms, cage code, DUNS number, size of business, acknowledgement of solicitation Amendments. (ix) Provision at 52.212-2, Evaluation -- Commercial Items shall be used. The Evaluation as Commercial Items applies to this acquisition and that the Government will award a contract resulting from this solicitation to the responsive responsible quoter whose technically acceptable quote conforming to the solicitation will be the most advantageous to the government, price and other factors considered. The Contractor shall comply with the provisions of this paragraph (a) if this contract was awarded using other than sealed bid, is in excess of the simplified acquisition threshold, and does not contain the clause at 52.215-2, Audit and Records -- Negotiation. (1) The Comptroller General of the United States, or an authorized representative of the Comptroller General, shall have access to and right to examine any of the Contractor's directly pertinent records involving transactions related to this contract. When requested, the ombudsman will maintain strict confidentiality as to the source of the concern. (End of clause) 5352.209-9000 ORGANIZATIONAL CONFLICT OF INTEREST (Oct 2010) - ALTERNATE III (Oct 2010) (a) The following restrictions and definitions apply to prevent conflicting roles which may bias the Contractor's judgment or objectivity, or to preclude the Contractor from obtaining an unfair competitive advantage in concurrent or future acquisitions. (1) Descriptions or definitions: "Proprietary Information" means all information designated as proprietary in accordance with law and regulation, and held in confidence or disclosed under restriction to prevent uncontrolled distribution. Examples include limited or restricted data, trade secrets, sensitive financial information, and computer software; and may appear in cost and pricing data or involve classified information. (b) The Contractor may gain access to proprietary information of other companies during contract performance. The Contractor agrees to enter into company-to-company agreements to (1) protect another company's information from unauthorized use or disclosure for as long as it is considered proprietary by the other company and (2) to refrain from using the information for any purpose other than that for which it was furnished. For information purposes, the Contractor shall furnish copies of these agreements to the Contracting Officer. These agreements are not intended to protect information which is available to the Government or to the Contractor from other sources and furnished voluntarily without restriction. 5352.209-9001 POTENTIAL ORGANIZATIONAL CONFLICT OF INTEREST (Oct 2010) (a) There is potential organizational conflict of interest (see FAR Subpart 9.5, Organizational and Consultant Conflicts of Interest) due to the nature of the work to be performed in Performance Work Statement paragraph 1.3.6, which requires the successful contractor to disseminate white papers and technical proposals submitted under the Broad Agency Announcement for the Information Institute. (The contractor will not be participating in evaluation of proposals.) (1) Restrictions are needed to ensure that the contractor does not gain an unfair competitive advantage by requiring company-to-company agreements to (1) protect another company's information from unauthorized use or disclosure for as long as it is considered proprietary by the other company and (2) to refrain from using the information for any purpose other than that for which it was furnished. (c) The organizational conflict of interest clause included in this solicitation may be modified or deleted during negotiations.
