- U.S. Department of Commerce, National Oceanic Atmospheric Administration (NOAA), on the behalf of NOAA The National Marine Fisheries Service (NMFS) Office of Protected Resources intends to negotiate on a non-competitive basis with Aperio Technologies, Inc. for the award of a Contract under FAR part 13 Simplified Acquisition Procedures. This Acquisition for Other Than Full and Open Competition is pursuant to the authority permitted under Federal Acquisition Regulations Subpart 6.302-1 (1) and 41.U.S.C. 253(a)(1), "Only responsible source and Aperio Technologies will satisfy agency requirements." This acquisition is being solicited using the Simplified Acquisition Procedures. NMFS wants to upgrade the software to version 11 with new features as stated in the terms on the technical support agreement. Since there is not an test environment to ensure that the upgrade does not affect the Coldfusion front end of the application, it is necessary for the NMFS PR MMHSRP office to purchase a test environment license, technical support agreement and installation services for a server to configure in the development infrastructure of the NMFS CIO. NMFS CIO will install a new server to test functionality and ensure that the system can interface with the Coldfusion front-end as well as the current infrastructure. Once the new server is fully operational, it will become the production server and the current server will migrate into the development environment. Contractor must set-up and configure the software via remote access via Virtual Private Network or WebEx. If the consultant is unable to access remotely, a fee for onsite services will be charged as well as corresponding travel. However, if any other interested party believes that it can meet the requirements, it may submit a statement of capabilities, which if timely received, will be considered by NOAA. The capability statement and any other information furnished must be in writing, and must contain material in sufficient detail to allow NOAA to determine if the party can meet all of the foregoing requirements. Responses must also be accompanied by descriptive literature, warranties, and/or other information that demonstrates that the quote meets all of the foregoing requirement. Capability statements and related materials must be e-mailed to Jean.Barrett@noaa.gov by August 23, 2011, 11:00am local time. The determination to compete or not compete the proposed contract based upon responses to this notice is solely within the discretion of the Government.
