Contractor Performance Data Sheet Vicinity Map 2 Vicinity Map 1 Statement of Work - Janitorial and Garbage Collection Services This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in FAR Subpart 12.6, as supplemented with additional information included in this notice. This announcement constitutes the only solicitaiton; quotes are being requested and a written solicitation will not be issued. The solicitation number AG-04N0-S-11-9027 is issued as a Request for Quotations (RFQ). The solicitation document and incorporated provisions and clauses are those in effect through Federal Acquisition Circular 2005-53. This is a small business set-aside with an associated NAICS code of 561720 and the small business size standard is $16.5million. The following are this solicitation's list of contract line items, quantities, and units of measure: 01 - Janitorial/Garbage Collection Services, Base Year commencing October 1, 2011 through September 30, 2012: MONTH (12) $_________YEAR$___________ 02 - Janitorial/Garbage Collection Services,Option Year commencing October 1, 2012 through September 30, 2013: MONTH (12) $_________YEAR$___________ The provision FAR 52.212-1 Instructions to Offerors-Commercial Items applies to this solicitation and the following are provided as addenda to this provision: The DOL Wage Determination applying to this solicitation is WD 05-2436, available from http://www.wdol.gov/wdol/scafiles/std/05-2439.txt. Statement of Work, Vicinity Maps, and Contractor Performance Data Sheet are included in "Attachment" section of this solicitation. All offerors must provide a complete copy of FAR 52.212-3 Offerors Representations and Certifications-Commercial Items, OR the offeror must have completed their annual Representations and Certifications electronically at https://orca.bpn.gov. If the offeror has not completed ORCA on-line, a copy of FAR 52.212-3 can be downloaded from the ORCA website. Include copies of Contractor Performance Data Sheet to certify past performance (attachment) Far Clause 52.212-4 Contract Terms and Conditions - Commercial Items, applies to this solicitation with the following addenda: ADDENDA TO FAR 52.212-4 FAR 52.252-2 CLAUSES INCORPORATED BY REFERENCE (FEB 1998)This contract incorporates one or more clauses by reference, with the same force and effect as if they were given in full text. Upon request, the Contracting Officer will make their full text available. Also, the full text of a clause may be accessed electronically at this/these address(es): www.arnet.gov/far/ www.usda.gov/procurement/policy/agar.html AGAR 452.211-74 PERIOD OF PERFORMANCE (FEB 1988)The period of performance of this contract is from the effective date of the Notice to Proceed (10/01/11) through 09/30/13. AGAR 42.215-73 POST AWARD CONFERENCE (NOV 1996) (a) A post award conference with the successful offeror(s) is required. It will be scheduled after the date of contract award. The conference will be held at: (to be announced) unless otherwise changed by mutual agreement.(b) Contractor designated representative or foreman (whomever the Contractor will have on the site) shall be present at the post award conference. FAR 52.217-8 OPTION TO EXTEND SERVICES (NOV 1999)The Government may require continued performance of any services within the limits and at the rates specified in the contract. These rates may be adjusted only as a result of revisions to prevailing labor rates provided by the Secretary of Labor. The option provision may be exercised more than once, but the total extension of performance hereunder shall not exceed 6 months. The Contracting Officer may exercise the option by written notice to the Contractor prior to the end of Base Year/Option Year 1. FAR 52.217-9 OPTION TO EXTEND THE TERM OF THE CONTRACT (MAR 2000)(a) The Government may extend the term of this contract by written notice to the Contractor prior to the end of the contract period, provided that the Government gives the Contractor a preliminary written notice of its intent before the contract expires. The preliminary notice does not commit the Government to an extension. (b) If the Government exercises this option, the extended contract shall be considered to include this option clause. (c) The total duration of this contract, including the exercise of any options under this clause, shall not exceed 3 years. FAR 52.204-9 PERSONAL IDENTITY VERIFICATION OF CONTRACTOR PERSONNEL. PERSONAL IDENTITY VERIFICATION OF CONTRACTOR PERSONNEL (JAN 2011) (a) The Contractor shall comply with agency personal identity verification procedures identified in the contract that implement Homeland Security Presidential Directive-12 (HSPD-12), Office of Management and Budget (OMB) guidance M-05-24 and Federal Information Processing Standards Publication (FIPS PUB) Number 201. (b) The Contractor shall account for all forms of Government-provided identification issued to the Contractor employees in connection with performance under this contract. The Contractor shall return such identification to the issuing agency at the earliest of any of the following, unless otherwise determined by the Government: (1) When no longer needed for contract performance. (2) Upon completion of the Contractor employee's employment. (3) Upon contract completion or termination. (c) The Contracting Officer may delay final payment under a contract if the Contractor fails to comply with these requirements. (d) The Contractor shall insert the substance of this clause, including this paragraph (d), in all subcontracts when the subcontractor's employees are required to have routine physical access to a Federally-controlled facility and/or routine access to a Federally-controlled information system. It shall be the responsibility of the prime Contractor to return such identification to the issuing agency in accordance with the terms set forth in paragraph (b) of this section, unless otherwise approved in writing by the Contracting Officer. 52.223-2 AFFIRMATIVE PROCUREMENT OF BIOBASED PRODUCTS UNDER SERVICE AND CONSTRUCTION CONTRACTS. AFFIRMATIVE PROCUREMENT OF BIOBASED PRODUCTS UNDER SERVICE AND CONSTRUCTION CONTRACTS (DEC 2007) (a) In the performance of this contract, the contractor shall make maximum use of biobased products that are United States Department of Agriculture (USDA)-designated items unless- (1) The product cannot be acquired- (i) Competitively within a time frame providing for compliance with the contract performance schedule; (ii) Meeting contract performance requirements; or (iii) At a reasonable price. (2) The product is to be used in an application covered by a USDA categorical exemption (see 7 CFR 2902.10 et seq.). For example, some USDA-designated items such as mobile equipment hydraulic fluids, diesel fuel additives, and penetrating lubricants are excluded from the preferred procurement requirement for the application of the USDA-designated item to one or both of the following: (i) Spacecraft system and launch support equipment. (ii) Military equipment, i.e., a product or system designed or procured for combat or combat-related missions. (b) Information about this requirement and these products is available at http://www.usda.gov/biopreferred. FAR 52.237-1 SITE VISIT (APR 1984)Offerors or quoters are urged and expected to inspect the site where services are to be performed and to satisfy themselves regarding all general and local conditions that may affect the cost of contract performance, to the extent that the information is reasonably obtainable. In no event shall failure to inspect the site constitute grounds for a claim after contract award. FAR 52.217-5 EVALUATION OF OPTIONS (JUL 1990) Except when it is determined in accordance with FAR 17.206(b) not to be in the Government's best interests, the Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. Evaluation of options will not obligate the Government to exercise the option(s). FAR 52.232-18 AVAILABILITY OF FUNDS APR 1984) Funds are not presently available for this contract. The Government's obligation under this contract is contingent upon the availability of appropriated funds from which payment for contract purposes can be made. No legal liability on the part of the Government for any payment may arise until funds are made available to the Contracting Officer for this contract and until the Contractor receives notice of such availability, to be confirmed in writing by the Contracting Officer. FAR 52.232-19 AVAILABILITY OF FUNDS FOR THE NEXT FISCAL YEAR (APR 1984) Funds are not presently available for performance under this contract beyond 09/30/11. The Government's obligation for performance of this contract beyond that date is contingent upon the availability of appropriated funds from which payment for contract purposes can be made. No legal liability on the part of the Government for any payment may arise for performance under this contract beyond 09/30/11, until funds are made available to the Contracting Officer for performance and until the Contractor receives notice of availability, to be confirmed in writing by the Contracting Officer. FAR 52.216-1 TYPE OF CONTRACT (APR 1984) The Government contemplates award of a firm fixed price, single-award contract resulting from this solicitation. FAR 52.233-2 SERVICE OF PROTEST (SEP 2006) (a) Protests, as defined in section 31.101 of the Federal Acquisition Regulation, that are filed directly with an agency, and copies of any protests that are filed with the Government Accountability Office (GAO), shall be served on the Contracting Officer (addressed as follows) by obtaining written and dated acknowledgment of receipt from Cyndy Armour, Ochoco National Forest, 3160 NE Third St., Prineville OR 97754.(b) The copy of any protest shall be received in the office designated above within one day of filing a protest with the GAO. PUBLIC OFFICIALS NOT PERSONALLY LIABLE There shall be no personal liability upon the Contracting Officer or officer in charge, their agents or employees, for any act performed in the discharge of any duty imposed or the exercise of any power or authority conferred upon them by, or within the scope of the contract, it being understood that in all such matters they act solely as agents and representatives of the Government. DESIGNATION OF CONTRACTING OFFICER'S REPRESENTATIVE The Contracting Officer designates the Contracting Officer's Representative(s) (COR). The COR is responsible for administering the performance of work under this contract. In no event, however, will any understanding, agreement, modification, change order, or other matter deviating from the terms of this contract be effective or binding upon the Government unless formalized by proper contractual documents executed by the Contracting Officer prior to completion of the contract. The Contracting Officer should be informed as soon as possible of any actions or inactions by the Contractor or the Government, which will change the required delivery or completion times stated in the contract, and the contract will be modified accordingly. (This does not apply to individual task assignments which were issued by the COR provided they do not affect the delivery schedule or performance period stated in the contract.) On all matters that pertain to the contract terms, the Contractor must communicate with the Contracting Officer. Whenever, in the opinion of the Contractor, the COR requests effort outside the scope of the contract, the Contractor should so advise the COR. If the COR persists and there still exists a disagreement as to proper contractual coverage, the Contracting Officer should be notified immediately, preferably in writing if time permits. Proceeding with work without proper contractual coverage could result in nonpayment or necessitate submittal of a contract claim. APPROVAL OF SUBCONTRACTING The Contractor shall request approval from the Contracting Officer prior to entering into any subcontract arrangement. The subcontractor shall have the experience and be equipped for such work. The written notification shall include as a minimum: A. The name, address and telephone number of the subcontractor. B. The date upon which the subcontract was entered into and its duration C. A detailed description of the work being subcontracted including a listing of contract items, units, etc., as appropriate. D. Documentation of the subcontractor's representative authority. Subcontracting any portion of the contract shall not relieve the Prime Contractor of any responsibility under this contract. Any subcontract agreement shall contain all terms and conditions of the prime contract. CONTRACTOR'S REPRESENTATIVE The Contractor or Authorized Representative shall be on the project area where work is in progress. In the absence of the Contractor, the Contractor's Authorized Representative shall receive orders from the COR and take such action as is required to keep the job in progress under the terms of the contract. The Contractor's Authorized Representative shall be conversant in the English language and able to read and understand the contract.
