- Justification for other than full and open competition FAR 6.303-2 1. Identification of the agency and contracting activity Requesting agency USDA/APHIS/PPQ 1398 West Truck Road Buzzards Bay, MA 02542 Contracting Activity USDA APHIS MRPBS ASD Minneapolis Procurement Branch Butler Square Suite 510 C 100 North 6th Street Minneapolis, MN 55403 2. Nature and/or description of the action being approved Purchase Horiba Instruments ELISA kits that determine pesticide content for the active ingredients dinotefuran, clothianidin, and emamectin. These kits quantity pesticide residue in plant samples that are collected from tree treated to control Asian Longhorned beetle and the Emerald Ash Borer and are a part of on-going research into treatment efficacy 3. A description of the supplies, equipment, or services required to meet agency needs (including the estimated value of the acquisition inclusive of options). Horiba's ELISA kits #3100176146, #310016052, and #3100176117 detect the above mentioned pesticides in leaves of trees treated as part of the ALB eradication program. It is the only commercially available kit using this technology. The ELIS method is less expensive that traditional analytical methods (HPLC, GC/MS) and is regularly used in the CPHST diagnostic laboratory. Total value approximately $38,000 4. Identification of the statutory authority permitting noncompetitive acquisitions: FAR 6.302-1(b)(1)(i) 5. A demonstration that the proposed contractor's unique qualifications or the nature of the acquisition requires use of the authority cited Search of GSA schedule, various industry publications, and program personnel knowledge found no other commercial ELISA test kits capable of analyzing for the aforementioned pesticides 6. A description of efforts made to ensure that offers are solicited from as many potential sources as is practicable, including whether a notice was or will be publicized as required by Subpart 5.2 and, if not, which exception under 5.202 applies. Market research indicates that there are no other commercial sources of these test kits. Certain companies can custom build ELISA tests but given program and contracting officer knowledge this would be more expensive than the commercial version. Notice publicized on fbo.gov. 7. A determination by the contracting officer that the anticipated cost to the Government will be fair and reasonable. Based on comparisons to other commercially available test kits and previous purchases show the price is fair and reasonable 8 A description of the market research conducted (see FAR Part 10) and the results or a statement of the reason market research was not conducted. Searched the GSA Advantage site for various test kits. Internet search of ELISA kit manufacturers, literature search of dinotefuran, clothianidin, and emamectin to see what tests researchers were using to detect those pesticides. The only commercial manufacturer of ELISA tests kits found was Horiba 9. Any other facts supporting the use of other than full and open competition. See sole source justification approved by USDA APHIS PPQ Otis Methods Laboratory Program manager. 10. A listing of the sources, if any, that expressed, in writing, an interest in the acquisition. 11. A statement of the actions, if any, the agency may take to remove or overcome any barriers to competition before any subsequent acquisition for the supplies or services required. As a commercial item, not further agency acquisitions are required 12. Contracting officer certification that the justification is accurate and complete to the best of the contracting officer's knowledge and belief.
