- DESCRIPTION: This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in Subpart 12.6, as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; quotes are being requested as a Request for Quote (RFQ) and the intent is to award a firm fixed price for services. The solicitation document and incorporated provisions and clauses are those in effect through Federal Acquisition Circular 2005-26. This requirement is available as full and open competition for commercial items under the North Atlantic Industrial Classification System (NAICS) 562112. REQUIREMENTS: The Louis Stokes Cleveland Department of Veterans Affairs Medical Center (VAMC), 10000 Brecksville Rd, Brecksville, OH 44141, is seeking Quotes. Quotes with additional features will be considered, provided the minimum requirements of the Government have been met. Each line item must have a description and pricing information. Quote shall contain a proposed delivery, installation, and in-service timeline. Environmental Management is a service division of the Louis Stokes Cleveland Department of Veterans Affairs Medical Center, 10701 East Blvd., Cleveland, OH 44106 and 10000 Brecksville Road, Brecksville, OH 44141. There shall be no site visit for this procurement. PRICING: Offeror shall provide pricing for Pharmaceutical Waste Removal as described in the requirements below: LINE ITEMS: 1) Pharmaceutical Waste Management Services at the Wade Park Campus. 2) The period of performance will be from 10-1-2011 through 9-30-2012 PROVISIONS AND CLAUSES: This combined synopsis lists one or more clauses by reference with the same force and effect as if they were given in full text (FAR 52.252-2). The provisions at FAR 52.212-1, Instructions to Offerors-Commercial Items, apply to this acquisition with the following addendum to the provisions of the standard provisions. In accordance with Federal Acquisition Regulation FAR 52.212-2 Evaluation-Commercial Items all offers will be considered for BEST VALUE. The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate offers. (1) Technical capability. Additionally, any potential offerors quoting a brand equivalent must supply supporting documentation that the product quoted is of equal or greater technical capability matching the specified equipment in features, quality, warranty terms, compatibility with existing systems, and functionality to be considered. (2) Past performance: please include references of customers who have purchased a similar system. Past performance with VA or other Government agencies is preferred. Please include company name, point of contact information, purchase order or reference number, and dollar value. Those not submitting past performance references will be given a neutral rating. (3) Price: Quote for each line item, including but not limited to the requirements listed above. Technical and past performance when combined are significantly more important then price. The provision at VARR 852-211-77, Brand Name or Equal applies. The items called for by this RFQ have been identified in the schedule by a "brand name or equal" description, such identification is intended to be descriptive, but not restrictive, and is to indicate the quality and characteristics of products that will be satisfactory. Quotes offering "equal" products (including products of the brand name manufacturer other than the one described by brand name) will be considered for award if such products are clearly identified in the quote and are determined by the Government to meet fully the salient characteristics requirements listed in the RFQ. WARRENTY AND SERVICE: Indicate terms. DELIVERY AND INSTALLATION: F.O.B. Destination is preferred, please include any freight in the individual item pricing if applicable. The government will arrange for shipping if the estimated cost for handling is over $250. Please include an estimated date of arrival. NOTE: The Government reserves the right to award without discussions, vendors shall submit the most favorable terms. Small businesses, especially service-disabled veteran owned small businesses and veteran owned are encouraged to contract their nearest Procurement Technical Assistance Center (PTAC) if assistance is needed in preparing their quote. ELECTRONIC INVOICE SUBMISSION: The Department of Veterans Affairs (VA Financial Service Center (FSC) is the designated agency office for invoice receipt in accordance with the Prompt Payment Act (5 CFR part 1315). FSC or its designated representative may contact the vendor to provide specific instructions for electronic submission of invoices. The vendor will be responsible for any associated expenses. FSC may utilize third-party contractors to facilitate invoice processing. Prior to contact by FSC or its designated representative for electronic invoicing submissions, the vendor shall continue to submit all invoices to FSC at the following mailing address: Department of Veterans Affairs, Financial Services Center, P.O. Box 149971, Austin, TX 78714-8971. Offerors shall complete FAR 52.212-3 Offerors Representations and Certifications-Commercial Items available for online registration at http://orca.bpn.gov or include a written copy with the quote submitted. The clause at 52.212-4 Contract Terms and Conditions-Commercial Items, applies to this acquisition, to include the following addendum to the clause: 52.204-7 (CCR registration) the successful offeror must be registered with the Central Contractor Registration (CCR) to be awarded a contract, you may register easily and quickly on-line at http://www.ccr.gov, 52.232-34 (Payment by Electronic Funds), VAAR 852.237-70 (Contractor Responsibility) and 852.2370-4 (Commercial Advertising). The clause at 52.212-5, Contract Terms and Conditions Required to Implement Statues or Executive Orders-Commercial Items, applies to this acquisition which shall include the following clauses by reference. Clauses: 52.203-6, 52.219-4, 52.219-8, 52.219-23 alt1, 52.222-21, 52.222-26, 52.222-35, 52.22236, 52.222-37, 52.225-3 Alternate I. The preceding Federal Acquisition Regulations (FAR) clauses and provisions may be accessed on the Internet at http://www.arnet.gov/far. SCOPE OF WORK A VAMC pharmacy can easily have thousands of distinct pharmaceutical chemicals in its inventory that may end up in the wrong place when they can no longer be used. During several internal and external environmental audits of the Cleveland VAMC, improper disposal of pharmaceutical waste has been identified. This practice in general is having an adverse impact on the environment and human health worldwide. Pharmaceuticals are being found in our ground water because it's been common practice to flush them down the drain. Other illicit methods of disposing of pharmaceutical waste have been through the abuse of the reverse distribution system, discarding them in sharps containers, and into the trash. Mismanagement of pharmaceutical waste not only adversely impacts the environment and human health, but could also cost the VAMC hundreds of thousands of dollars in fines through Resource Conservation and Recovery Act (RCRA) violations. Pharmaceutical waste is a complex waste stream and therefore the Cleveland VAMC is seeking a Pharmaceutical Waste Management Service to manage this waste stream in accordance with the Code of Federal Regulations and applicable state regulatory agencies, Joint Commission Standards, and industry best management practices based on recommendations and published guidelines from the Occupational Safety and Health Administration (OSHA), American Society of Health-System Pharmacists (ASHP), National Institute of Occupational Safety and Health (NIOSH) and, Practice Green Health's "Managing Pharmaceutical Waste - A 10 Step Blueprint for Healthcare Facilities In The United States". The following features are needed from a pharmaceutical waste management service to successful comply with this initiative. 1.Facility Assessment "Review current process for determination of RCRA hazardous pharmaceutical waste. "Review current pharmaceutical waste accumulation, management and disposal practices. "Review the Cleveland VAMC's written plan for managing pharmaceutical waste and hazardous materials and waste. "Inspect current pharmaceutical waste accumulation locations including satellite accumulation and hazardous waste storage areas. "Review current pharmaceutical waste training programs including training materials and documentation employee training documentation. 2. Initial and On-going Pharmaceutical Waste Characterization. The following waste characterization activities shall be conducted IAW 40 CFR §262.11, §261.3, §265.177, and §265.17: "Initial and on-going waste characterization of the Cleveland VAMC's RX formulary by determining RCRA hazardous and non-RCRA hazardous pharmaceuticals at NDC level including, determination of DOT hazardous materials class for RCRA hazardous pharmaceuticals. "RCRA hazardous determinations must be based on both active and inactive/preservative ingredients. "Waste characterization should be determined upon service implementation and, for all pharmaceuticals added to the hospital's RX formulary thereafter. "Waste characterization should include identification of incompatible pharmaceutical wastes. 3.Logistics shall be provided IAW 40 CFR §262.34 (c)(1)), 265.177, §265.171, 265.172, and 265.173: "Will employ colored-containers. "Process will be designed to prevent incompatible pharmaceutical waste from being placed in the same container or commingled with any other pharmaceutical waste. "Process will include an easily implemented method or means to assist clinicians in identifying RCRA hazardous and incompatible pharmaceutical waste. "Process will include vendor provided point-of-use instructional posters. "Process will be designed to assure that colored-containers are in good condition, compatible with their waste stream contents, marked and labeled appropriately and, marked with instructions specific to container management requirements. 4.Training will be provided IAW 40 CFR §265.16), 49 CFR §172.702 & 172.704, 29 CFR §1910.1200): "On-site training is to be provided for all employees who are involved with or occupationally exposed to hazardous pharmaceutical waste including but not limited to: clinicians (pharmacists, pharmacy techs, nurses), personnel involved in moving partially-full or full pharmaceutical waste containers from points of accumulation to storage areas, personnel responsible for managing hazardous waste storage areas and, personnel responsible for performing or managing the packing and shipping of pharmaceutical waste. "Training is to meet EPA, DOT and OSHA training requirements. "Training material content is to be specific to job performance requirements in relation to RCRA hazardous pharmaceutical waste. "Training materials are to be provided in an electronic format adaptable to the hospital's internal employee training system. "Training is to include on-site review training at regulatory defined frequencies. "Training materials are to include a list of all hazardous pharmaceuticals in the hospital's RX formulary. 5.Hazardous Waste Storage IAW 40 CFR §265 Subpart I, §265.32, and §265.174: "Service must include assessment of existing hazardous waste storage area and assistance (as needed) to assure that the Cleveland VAMC has and maintains a regulatory compliant hazardous waste storage area. 6.Hazardous Waste Segregation IAW 40 CFR §262.30, 40 CFR §265.177, and §265.17: "Procedure used for segregation, storage, packing and disposal of RCRA hazardous pharmaceutical waste must comply with applicable EPA and DOT regulations and, the DOT Hazardous Materials table. "Procedure for packing hazardous pharmaceutical waste for transport and disposal must assure that incompatible wastes and materials are not placed in the same container. "If commingling of incompatible hazardous waste exists, define the procedure used to assure that commingled incompatible hazardous waste is packaged and stored in a manner that assures that storage and disposal container contents will not: a)generate extreme heat or pressure, fire or explosion, or violent reaction; b)produce uncontrolled toxic mists, fumes, dusts, or gases in sufficient quantities to threaten human health; c)produce uncontrolled flammable fumes or gases in sufficient quantities to pose a risk of fire or explosions; d)damage the structural integrity of the device or facility containing the waste or threaten human health or the environment. 7.Pre-Transport Requirements IAW 40 CFR §262.30, 262.32, 262.33, 49 CFR Parts 172, 173, 178 and 179: "Program must assure that RCRA hazardous pharmaceutical waste and/or DOT hazardous materials are packaged in accordance with applicable EPA and DOT regulations (49 CFR Parts 173, 178 and 179) before it is offered for transportation and/or transported off-site. "Program must assure that all packages of RCRA hazardous pharmaceutical waste and/or DOT hazardous materials are marked and labeled in accordance with applicable DOT regulations (49 CFR Part 172). "Program must assure that the waste generator has appropriate placards (according to DOT regulations) readily available to offer hazardous waste transporter (49 CFR Part 172, subpart F). 8.Vendor Due Diligence IAW 40 CFR Parts 262 - 265: "Hazardous Waste Transporter(s) NOTE: The following information should be required for any hazardous waste transporter that will be picking-up and transporting RCRA hazardous waste off-site: 1.Company name 2.Company address 3.EPA ID number 4.DOT number 5.Any State permit/license identification 6.Proof of required insurance "Waste Transfer, Storage and Disposal Facility (TSDF). NOTE: The following information should be required for any TSDF to which VAMC hazardous pharmaceutical waste is transported. 1.Company name 2.Company address 3.EPA ID number 4.Any State permit/license identification 5.Proof of required insurance "Waste Incinerator. NOTE: The following information should be required for any waste incinerator at which hospital generated waste is to be incinerated. 1.Company name 2.Company address 3.EPA ID number 4.Any State permit/license identification 5.Proof of required insurance 9.Disposal IAW 40 CFR Parts 262-265, Joint Commission Standard (MM.01.01.03), NIOSH, ASHP, OSHA, Practice GreenHealth's "10 Steps to Managing Pharmaceutical Waste" document. "RCRA hazardous pharmaceutical waste is to be incinerated at an EPA permitted hazardous waste incineration facility. "Mixed infectious/RCRA hazardous pharmaceutical waste (combined RCRA hazardous and infectious) is to be incinerated at an EPA permitted hazardous waste incineration facility that is permitted to incinerate both RCRA hazardous waste AND infectious waste. "NIOSH, OSHA and ASHP designated "high alert" non-hazardous pharmaceutical waste is to be incinerated. "All non-hazardous pharmaceutical waste is to be incinerated. 10. Annual Audit IAW Joint Commission Standard (EC.04.01.01) "Vendor will conduct an annual audit of the pharmaceutical waste management program based on applicable EPA, DOT and applicable State regulations. 11.Pricing "The following pricing components should be specified: oTransportation. NOTE: Due to hazardous waste incinerator EPA permit limitations, certain pharmaceutical hazardous waste streams may require transport to different incineration facilities. Thus, separate transportation pricing should be requested for the following waste types: RCRA hazardous, non-RCRA hazardous waste and, mixed infectious/RCRA hazardous waste. 1.Per pound pricing 2.Per unit pricing (combined transportation & disposal charges) per container size 3.Pricing minimum(s) per container size oDisposal. Start up container cost can be billed monthly for the term of the contract at $246.54/month or the hospital can pay a flat fee of $8,8785.30. Start up containers are: "8-2 gallon purple (dual waste) containers in counter top stabilizers "41-8 gallon blue (non-hazardous) containers with step on dollies "44-8 gallon black (hazardous) containers with step on dollies *THIS IS AN ESTIMATE ON CONTAINERS 4.Projected total number of containers (by size) needed per contract year including projected total cost. 1.Reusable colored RX waste containers (for internal collection of RX waste): $246.54/month 2.Disposable colored RX waste containers: 16-2 gallon black (hazardous non-compatible) containers with counter top stabilizers. The estimate per year on disposable containers it $280 3.DOT disposal containers (for packing, shipment and disposal of RX waste) 4.Mounting brackets/carts-Included in flat monthly fee of $246.54/month oMaterials installation labor: Installation of containers is Included in the flat monthly fee oInitial waste characterization fee: This is a monthly fee that will extend for the term of the contract (3 or 5 years) $723/month or $8,676/year.
