- This is a NOTICE OF INTENT TO AWARD A SOLE SOURCE Purchase Order using Federal Acquisition Regulation FAR Part 13.5, Test. Program for Certain Commercial Items. This will be an acquisition under the authority of the test program for commercial items section 4202 of the Clinger-Cohen Act of 1996. Army Contracting Command, Aberdeen Installation Contracting Division, 4118 Susquehanna Avenue, Aberdeen, MD 21005 has a requirement to procure FTIR Spectrometer support, in support of Aberdeen Test Center, located at Aberdeen Proving Ground, Maryland 21005. CLIN 0001 The Government intends to award a firm-fixed price sole source purchase order to Midac Corporation 130 McCormick Avenue, STE 111, Costa Mesa CA, 92626. The proprietary software upgrades, ethernet upgrades, and annual maintenance/repair agreement for the following government owned equipment is only available from Midac Corporation. 1: FTIR Spectrometer-Model I4001-F; QTY 19; Serial #'s - 178, 190, 274, 330, 394, 396,477, 478, 512, 520, 521, 522, 523, 524, 525, 544, 545, 546 and 547. 2: FTIR Spectrometer-Model I1301-F; QTY 8; Serial #'s - 418, 419, 446, 447, 506, 507, 542 and 543. 3: Software-AutoQuant Pro software support. Midac Corporation is the manufacturer and the original source of the government owned FTIR spectrometers listed above, to be covered under the annual maintenance/repair agreement, which includes software upgrades and ethernet upgrades. The Ethernet hardware upgrade will include the modification of multiple (27) instrument temperature/pressure controllers with the addition of proprietary Midac hardware. This is a follow-on requirement for the continued provision of highly specialized services and upgrades. Midac Corporation is the only vendor able to provide the maintenance/repair services and/or spare parts, electrical components, software and Ethernet upgrades. The associated North America Industry Classification System (NAICS) Code is 811219 and the Business Size Standard is $7,000,000.00. All responses received within 10 days after date of publication of this notice will be considered by the Government. A determination by the Government not to compete this proposed purchase order based upon responses to this notice is solely within the discretion of the Government. Interested persons may identify their interest and capability to respond to the requirement no later than 9:00 AM Eastern Time, September 7, 2011. Any response to this notice must show clear and convincing evidence that competition would be advantageous to the Government in future procurements.
