- Solicitation # W912PX-11-T-0007 is hereby cancelled. The basis for the cancellation follows: 1) The requiring activity advised the contracting officer after the receipt of quotations that, based on the currently planned installation locations, the height limitations expressed in the solicitation are not necessary restrictions for all of the identified items. The contracting officer has determined that these height limitations constitute unnecessarily restrictive specifications that exceed the agency's legitimate minimum needs. Additional agency effort is required at this time to a) describe adequately the agency's minimum performance requirements, b) promote competition, and c) remove restrictive specifications that are not necessary to satisfy the legitimate needs of the agency. 2) The time of delivery is an essential contract element. The requiring activity advised the contracting officer after receipt of quotations that the delivery schedule expressed in the RFQ (30 days ARO) does not reflect the legitimate needs of the agency. The delivery schedule, as expressed in the solicitation, is, in the opinion of the contracting officer, unnecessarily short. The contracting officer is concerned that this short delivery schedule may have restricted competition and denied maximum practicable opportunity to small businesses. Additional agency effort is needed to establish a reasonable contract delivery schedule, giving due consideration to the urgency of the need, industry practices, market conditions, transportation time, production time, the capabilities of small business concerns, procurement administrative lead time, time for contractors to comply with any conditions precedent to contract performance, and time for the Government to ready the warehouse and installation sites. 3) Cancellation is in the Government's interest and the public interest. An amendment necessary to correct this Request for Quotation based on the aforementioned information would be of such magnitude that a new solicitation has become necessary and desirable.
