Description
THIS IS A COMBINED SYNOPSIS/SOLICITATION FOR COMMERCIAL ITEMS PREPARED IN ACCORDANCE WITH THE FORMAT IN SUBPART 12.6, AND THE TEST PROGRAM OUTLINED IN FAR 13.5, AS SUPPLEMENTED WITH ADDITIONAL INFORMATION INCLUDED IN THIS NOTICE. THIS ANNOUNCEMENT IS THE ONLY SOLICITATION; REFERENCES ARE BEING REQUESTED AND A WRITTEN SOLICITATION WILL NOT BE ISSUED. THE SOLICITATION NUMBER IS E11PCW0009 AND IS BEING ISSUED UNDER FAR PART 13 AS A REQUEST FOR PROPOSAL. THIS IS A 100% SMALL BUSINESS SET-ASIDE. THE NORTH AMERICAN INDUSTRY CLASSIFICATION SYSTEM (NAICS) FOR THIS PROCUREMENT IS 541990. THE AWARD WILL BE A LABOR HOUR CONTRACT FOR ONE BASE PERIOD. THE CONTRACTOR SHALL PROVIDE ALL THE MATERIALS AND LABOR FOR THE REQUIRED SERVICES IN THE ATTACHED STATEMENT OF WORK. PLACE OF PERFORMANCE SHALL BE THE OFFICES OF THE NATIONAL NAGPRA PROGRAM, 1201 EYE STREET, NW, WASHINGTON, D.C. THE FOLLOWING FAR PROVISIONS AND CLAUSES ARE APPLICABLE TO THIS ACQUISITION: FAR 52.212-01, INSTRUCTIONS TO OFFERORS-COMMERICIAL ITEMS, FAR 52.212-2, EVALUATION - COMMERCIAL ITEMS; FAR 212-3, OFFEROR REPRESENTATIONS AND CERTIFICATIONS - COMMERICAL ITEMS (OFFERORS SHALL PROVIDE A COMPLETED COPY WITH ITS SUBMISSION IF NOT ALREADY ON FILE WITH ORCA - HTTPS://ORCA.BPN.GOV); FAR 212-4, CONTRACT TERMS AND CONDITIONS - COMMERICAL ITEMS; FAR 52-212-5, CONTRACT TERMS AND CONDITIONS REQUIRED TO IMPLEMENT STATUES OR EXECUTIVE ORDERS - COMMERCIAL ITEMS, FAR 232-18, AVAILABILITY OF FUNDS, FAR 217-9, PAYMENT BY ELECTRONIC FUNDS TRANSFER - CENTRAL CONTRACTOR REGISTRATION; FAR 52.216-21, REQUIREMENTS; FAR 52.237-03 CONTINUITY OF SERVICES. THE FOLLOWING FACTORS SHALL BE USED TO EVALUATE OFFERS: 1) TECHNICAL CAPABILITY, 2) PAST PERFORMANCE; AND 3) PRICE. AS PAST PERFORMANCE, THE OFFEROR SHALL SUBMIT REFERENCES FROM THE PAST 3 YEARS FOR SIMILAR OR LIKE CONTRACTS INCLUDING POC, TELEPHONE NUMBER, CONTRACT NUMBER, CONTRACT VALUE, PERIOD OF PERFORMANCE. AS PART OF ITS TECHNICAL PROPOSAL, THE OFFEROR SHALL DESCRIBE ITS APPROACH TO THE STATEMENT OF WORK, AS WELL AS ANY APPLICABLE EXPERIENCE WITH SIMILAR REQUIREMENTS. FOR PRICE, THE OFFEROR SHALL PROVIDE ITS PROPOSED LABOR HOUR RATE, AS WELL AS A DESCRIPTION OF THE APPLICABLE LABOR CATEGORY. SECTION 1 - SCOPE OF SERVICES STATEMENT OF WORKNAGPRA Civil Penalty Analyst BackgroundThe service to be provided involves digesting the information provided in written allegations against museums for failure to comply with the requirements of the Native American Graves Protection and Repatriation Act (NAGPRA; 43 C.F.R. 10.12), and obtaining those facts needed to determine whether or not a particular allegation is substantiated or unsubstantiated. Decisions to accept or reject each of the contractor's deliverables will be made by the National NAGPRA civil penalty coordinator, a full-time NPS employee who staffs the Assistant Secretary for Fish and Wildlife and Parks (the Secretary's designee for NAGPRA civil enforcement) and works closely with the Office of the Solicitor's Division of Parks and Wildlife. Although the Manager of the National NAGPRA Program supervises the civil penalty coordinator for purposes of contracting, payment of invoices, and employment supervision, The National NAGPRA Program maintains a wall between the Department's NAGPRA civil enforcement function and the National NAGPRA Program's technical assistance function. Scope There are two parts to the scope of work in the services contract:a.Digesting allegations of museum failure to comply. The candidate will first review all the written allegations received from 1997 to date, and will: (1) give each allegation an identifier; and (2) for each allegation, identify which of the nine possible counts of museum failure to comply were alleged. After this work product is approved by the civil penalty coordinator, the candidate will begin to enter data in the civil penalty files into a National NAGPRA Program electronic data system. As additional data are obtained during the course of the contract, the candidate will update and supplement the data in the system. In addition, the candidate will produce a spread sheet of open cases that will identify the museum, counts alleged, year alleged, and status of the matter (i.e., open/under active investigation/under review and issuance at the Department/closed), and will annotate each of the counts alleged, as set forth at 43 C.F.R. 10.12. b.Obtaining those facts required in order to determine whether or not a particular allegation is substantiated or unsubstantiated. After the candidate's annotation of the counts alleged has been approved by the civil penalty coordinator, and working according to a prioritized plan of action, the candidate will gather the requisite facts to show that the counts alleged are either substantiated or unsubstantiated. This work will require the candidate to review the National NAGPRA Program's files and databases for the existence of compliance documents. In addition, some facts might need to be obtained from the museum alleged to have failed to comply, or from the party or parties alleging the failure to comply. If any travel is required, the costs will be reimbursed by the National NAGPRA program. Selection criteria The contractor must possess excellent speaking and writing abilities. The contractor must be able to comport himself/herself in a tactful and impartial manner when interacting with any museum that is the subject of an allegation and party alleging a failure to comply. Familiarity with both the process by which museums comply with NAGPRA and the records generated as a result of compliance are highly desired. Candidates having hands-on experience with NAGPRA compliance are preferred. The contractor must have some experience in identifying and gathering the facts required to prove a case. Analytic skills developed through the performance of duties as a law enforcement investigator, attorney, or researcher are highly desired. The contractor must have excellent organizational and data-entry skills. The contractor must possess the computer skills necessary for making charts and lists, and entering data into an existing database. The contractor must be able to uphold the integrity of the NAGPRA civil penalty process by securing and maintaining all civil penalty-related information, and acting in accordance with the Department of the Interior's policy and ethics requirements. The contractor must be able to successfully complete a background security check so as to enable access to the National NAGPRA Program's office, records, and databases. The contractor must be able to travel on occasion to perform contract functions. Any such travel shall be within federal travel regulations, and shall be invoiced on a reimburseable basis with submission of supporting receipts and documentation. Deliverables or delivery schedule The initial deliverable, constituting the bulk of the tasks in part (a) of this scope of work, is the production of organized files and a list of open allegations organized by type, date and other pertinent data, as indicated in the scope of work. The contractor will then enter data from the files into the internal National NAGPRA Program database. Next, the contractor will produce the reports, charts, and annotations from the data entered into the database, as indicated in the scope of work. Identifying and gathering facts to show that an alleged count is substantiated or unsubstantiated will require examination of National NAGPRA Program files and, in some cases, contacting the museum alleged to have failed to comply and the party or parties alleging the failure. The deliverable for this task will consist of a report of the requisite facts for each count alleged sufficient for a record to support a determination that the count alleged is substantiated or unsubstantiated. Government-furnished equipment and Government-furnished information The government will furnish the civil penalty files at the offices of the National NAGPRA Program, as well as a computer for entering data into the Program's database. All NAGPRA civil penalty-related information, and the database are, at all times, the property of the United States, and all information is subject to government information retention standards. Security HSPD 12 clearance is required, as the contractor might be onsite for more than 120 days, and will have access to government systems. The National NAGPRA Program will cover the cost of obtaining security clearance, and will work with the contractor to obtain security access to the worksite. The contractor is responsible for abiding by all security requirements and taking the necessary training for document and information protection. Place of performance Examination of hard-copy and electronic files, and entry of data in to the National NAGPRA Program's database shall be at the National NAGPRA Program office, at 1201 Eye St. NW, Washington, DC (or at any successor Program office in Washington, DC). Any required travel will not exceed an aggregate of one month during the 12-month period of performance. Period of Performance Twelve months, beginning on the contractor starting date. Approximately 600 hours is estimated, but not guaranteed, during the period of contract performance. The total value of this contract shall not exceed $100,000.00. Statement of Non-Personal Services No personal services shall be performed under this contract. No Contractor employee shall be directly supervised by the Government. The applicable employee supervisor shall give all individual employee assignments, and daily work direction. If the Contractor believes any Government action or communication has been given that would create a personal services relationship between the Government and any Contractor employee, the Contractor shall promptly notify the Contracting Officer of this communication or action. The Contractor shall not perform any inherently governmental actions under this contract. No Contractor employee shall hold him or herself out to be a Government employee, agent, or representative. No Contractor employee shall state orally or in writing at any time that he or she is acting on behalf of the Government. In all communications with third parties in connection with this contract, Contractor employees shall identify themselves as Contractor employees and specify the name of the company for which they work. In all communications with other Government contractors in connection with this contract, the Contractor employee shall state that he/she has no authority to, in any way, change the contract and that if the other contractor believes this communication to be a direction to change their contract, they should notify the contracting officer for that contract and not carry out the direction until a clarification has been issued by the Contracting Officer. The Contractor shall ensure that all of its employees working on this contract are informed of the substance of this article. Nothing in this article shall limit the Government's rights in any way under the other provisions of the contract, including those related to the Government's right to inspect and accept the services to be performed under this contract. The substance of this article shall be included in all subcontracts at any tier.
