- This is a special notice to inform that NPS MWR Missouri MABO, Springfield, IL Contracting Office issued a purchase order to J.A. Riggs Tractor Company on September 1, 2011. The award was made for repair of a Caterpillar 977 Track Loader under NAICS Code 811310. This procurement was made pursuant to 10 U.S.C. 2304(c)(2) and FAR Part 6.302-2, Unusual and Compelling Urgency. (2) When the agency's need for the supplies or services is of such an unusual and compelling urgency that the Government would be seriously injured unless the agency is permitted to limit the number of sources from which it solicits bids or proposals, full and open competition need not be provided for. 1. Nature and/or description of the item/service being procured and its intended use (include the anticipated cost):The Caterpillar 977 Track Loader was leaking hydraulic fluid and could not be operated until it was repaired. It was estimated by the Government the repair would not exceed $2,500 and therefore payment would be made by government charge card. It was then taken into a CAT servicing center in Little Rock, AR - J.A. Riggs Tractor Company. While troubleshooting and removing the lift/dozer cylinder and repairing the leak, it was found the cylinder arm was also bent. In further assessing other repairs it was discovered the battery cables needed repaired, battery post and cable ends were damaged and disconnect switch was bypassed. Total cost of repairs was quoted at $5,450.62. 2. Sole Source Justification rationale (Check one and explain below): ______Only one responsible source. __X___Urgent and compelling circumstances exist. Include critical delivery or performance dates, and when you became aware of the requirement. Provide a specific statement of the impact on Government operations, financial or otherwise, if the required delivery or performance dates are not met. ______ Other _____________________________________________________ The loader was being used extensively for the loading of materials for completion of the Dam Repair Project. It is with a great deal of urgency that the loader be repaired as soon as possible so as not to cause further delay to the Dam project. 3. Market Research. Please explain the results or why one was not performed. State whether any other offers were received or anyone expressed interest:No market research was initially conducted as the initial cost to repair the leak was estimated at under $2,500. It was not until the loader was being disassembled to repair the leak that it was found the cylinder arm was bent and needed repaired before the loader would become functional. There was no consideration given to taking it to any other service center other than a CAT servicing center due to the expertise, certifications, reliability and knowledge of their heavy equipment and hydraulics mechanics. All five of the CAT Service Centers in Arkansas located within 100 miles of the Park are owned and operated by the same company; and all are within 100 miles of the Park. The loader was taken to the nearest CAT servicing center which is located 36.7 miles from the Park. This notice is not a request for quotes or proposals.
