- JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION (i) This is a combined synopsis/solicitation for commercial items, prepared in accordance with the format in subpart 12.6 of the FAR and as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; quotes are being requested and a separate written solicitation will not be issued. (ii) Solicitation number 11-236-SOL-00082 applies, and is issued as a Request for Quote. (iii) This solicitation document and incorporated provisions and clauses are those in effect through Federal Acquisition Circular 2005-53. (iv) The North American Industry Classification System (NAICS) code is 339999 with a small business size standard of 500 employees. The Indian Health Service (IHS) intends to award a Firm Fixed Price Contract on the basis of other than full and open competition. (v) The Contract Line Items (CLIN) are as shown below. CLIN 0001 - Medela Preemie+ Basic Education Package, 1 EA Includes: Symphony breast pumps, Item# 0240108 18 EA Preemie+ Cards, Item# 67227, 18 EA Trolleys, Item# 6007092, 18 EA Symphony/Lactina BMI Kit, Item# 67340S, 40 Cases CLIN 0002 - Medela Harmony Manual Breatpump, Item# 67186S, 45 Cases Delivery Term: FOB DESTINATION (vi) The Government intends to negotiate and award an order to Medela Inc., 1101 Corporate Drive, McHenry, IL 60050, or to its authorized dealers, for the purchase that includes package of 18 hospital quality pumps and 45 cases of manual breast pumps. It is the Government's belief that only Medela Inc., or its authorized dealers can provide the required Items. See the attached Justification for Other than Full and Open Competition. Interested parties may identify their interest and capability to respond to the requirement or submit proposals. This notice of intent is not a request for competitive quotations however; all responses received within five (5) days from the date of publication of this synopsis will be considered by the Government. (vii) n/a (viii) FAR 52.212-1 - Instructions to Offerors - Commercial Items (June 2008): Quotes shall be submitted on company letterhead stationery, signed and dated; it shall include: 1. Solicitation number. 2. Name, address, telephone number of the offeror and email address of the contact person. 3. Technical description of the item/service being offered in sufficient detail to evaluate compliance with the requirements in the solicitation. This may include product literature, or other documents, if necessary. 4. Price and any discount terms. 5. "Remit to" address, if different than mailing address. 6. A completed copy of the representations and certifications at FAR 52.212-3. 7. A statement specifying the extent of agreement with all terms, conditions, and provisions included in the solicitation. Offers that fail to furnish required representations or information, or reject the terms and conditions of the solicitation may be excluded from consideration. (ix) 52.212-2, Evaluation - Commercial Items (Jan 1999) (a) The award will be made to the lowest priced technically acceptable offer. The offeror must include in their quotation, the unit price, the list price, the performance period after contract award, the prompt payment discount terms, the Dun & Bradstreet Number (DUNS), the Taxpayer Identification Number (TIN), and the certification of business size. Note: In order to receive an award from the Indian Health Service, contractors must have a valid registration in the Central Contractor Registration (CCR) www.ccr.gov. (xiv) n/a (xv) Quotations must be receipted by the IHS no later than September 16, 2010, 11:30am Eastern Standard Time. (xvi) Interested vendors capable of furnishing the government with the item specified in this combined synopsis/solicitation should submit their quotation to the below address or email address.
