- GENERAL SERVICES ADMINISTRATION GREAT LAKES REGION Property Management Service Center - Michigan Service Center 1. JUSTIFICATION AND APPROVAL FOR OTHER THAN FULL AND OPEN COMPETITION This document constitutes justification and approval for other than full and open competition for the acquisition described herein, under the authority of FAR 6.302-2. It is executed on behalf of the General Services Administration (GSA) Michigan Service Center. 2. DESCRIPTION OF SUPPLIES OR SERVICES REQUIRED Utility - Electric Service 3. DESCRIPTION OF SUPPLIES OR SERVICES REQUIRED TO MEET THE AGENCY'S NEEDS Provide electric service for the Gerald Ford Federal Building and US Courthouse on 110 Michigan Street NW, Grand Rapids, MI for an annual estimated cost of $198,138.96 or $1,981,389.60 for ten years. 4. IDENTIFICATION OF STATUTORY AUTHORITY PERMITTING OTHER THAN FULL AND OPEN COMPETITION A. 41 U.S.C. 253(c)(1) and FAR 6.302-1, Only one responsible source and no other supplies or services will satisfy the agency requirements. 5. DEMONSTRATE THAT THE NATURE OF THE ACQUISITION REQUIRES USE OF THE AUTHORITY CITED. The statutory authority cited is FAR 6.302-1(b)(3), only one responsible source and no other supplies or services will satisfy agency requirements, is necessary because Consumers Energy controls the electric supply and distribution lines and therefore is entitled to compensation for their services. 6. DESCRIPTION OF EFFORTS MADE TO ENSURE THAT OFFERS ARE SOLICITED FROM AS MANY POTENTIAL SOURCES AS IS PRACTICABLE The exception is FAR 5.202(a)(5) as this action is for a regulated utility. 7. DETERMINATION BY THE CONTRACTING OFFICER THAT THE ANTICIPATED COST TO THE GOVERNMENT FOR THE PROPOSED ACQUISITION WILL BE FAIR AND REASONABLE The Michigan Public Service Commission is an independent government body which regulates all utility providers and approves the prices that Consumers Energy can charge. 8. DESCRIPTION OF MARKET SURVEY CONDUCTED AND THE RESULTS OR A STATEMENT OF THE REASONS THAT A MARKET SURVEY WAS NOT CONDUCTED N/A, this is for a regulated utility where there is only one source available. 9. ANY OTHER FACTS SUPPORTING THE USE OF OTHER THAN FULL AND OPEN COMPETITION - N/A 10. LISTING OF SOURCES THAT EXPRESSED AN INTEREST IN THE PROCUREMENT - N/A 11. STATEMENT OF THE ACTIONS, IF ANY, TO REMOVE OR OVERCOME ANY BARRIERS TO COMPETITION N/A CERTIFICATION: I hereby certify the facts and representations under my cognizance which are included in this justification are complete and accurate.
