- SOLICITATION 2011-Q-14031 The Centers for Disease Control and Prevention (CDC) Office on Smoking and Health (OSH) intends to procure services from the American Nonsmokers' Rights Foundation, (ANRF) under a sole source contract. The contractor shall provide the following services: Track trends in local tobacco control policies over time; and provide detailed quarterly reports on local ordinances that restrict youth access to tobacco products, restrict tobacco advertising, govern conditional use permits, levy local excise taxes on tobacco products, and restrict smoking in workplaces and public places; provide quarterly reports on the proportion of the US population covered by State and Local Smoke-Free Laws; and finally, the contractor shall provide four briefs or fact sheets on trends in selected policy topics, collaborate with CDC in preparing the Morbidity and Mortality Weekly Report (MMWR) on local policy trend and analyze specific provisions of local laws. The Contractor must have a minimum of 5 years of experience in tobacco control policy tracking. The contractor must have extensive experience and expertise in collecting, analyzing, coding, categorizing, and tracking local tobacco control ordinances and policies on a nationwide basis, as well as housing and maintaining records of this information, and must clearly demonstrate the capacity to track several different types of tobacco control policies in every local jurisdiction in the United States over time. Specifically, the contractor must demonstrate a full understanding of the different types of local jurisdictions in the United States (municipalities, counties, etc.), the different areas and populations covered by different jurisdictions (e.g., incorporated vs. unincorporated areas of counties), the different types of government bodies that can adopt policies (city councils, county commissions, boards of health, etc.), the different possible types of local tobacco control policies (smoking restrictions, restrictions on youth access to tobacco products, advertising restrictions, tobacco taxes, etc.), approaches to coding these policies (including interpreting and categorizing their provisions and exemptions), the evidence for effectiveness of different types of policy, and their evolution over time. The contractor must further demonstrate that it possesses the capacity to use this information to generate estimates of the proportion of the national and state populations covered by various types of local tobacco control policies. Finally, the contractor must demonstrate that it has established suitable contacts in every state to obtain and verify information on newly adopted local policies. The North American Industry Classification (NAICS) Code is 813920. The contractor shall provide all labor, materials, supplies and other services necessary to complete the requirement. Place of Performance shall be at the contractor's facility. The Period of Performance shall continue for twelve (12) months after award of the contract. The requirement is not set aside for small businesses. It is being procured under simplified acquisition procedures, found in Federal Acquisition Regulations (FAR) Part 13. The sole source authority is FAR Section 13.106-1(b)(1). The service is available from only one source capable of providing and satisfying the agency requirement. Market research confirmed that the ANRF is the only organization that conducts the required tracking. ANRF is a non-lobbying, educational nonprofit organization 501(C)(3) which creates comprehensive programs for youth of all ages on issues of smoking prevention, the benefits of smoke free air, and the right to breathe smoke free air. ANRF provides educational resources for schools, health departments, medical organizations, and others interested in the issues surrounding smoking and secondhand smoke health dangers. All responsible sources may submit a bid, proposal, or quotation by 12:00 Noon, EST, September 26, 2011, to the attention of Maria Nichols, by Email at mkn2@cdc.gov which shall be considered by the agency. Determination not to compete the proposed action based on responses to this notice is solely within the discretion of the Government. Information received will be considered for the purpose of determining whether to conduct a future competitive procurement. Respondents will assume all financial costs for preparing a response to this notice. The U.S. Government assumes no financial obligation for responses
