JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION Agency: Department of Veterans Affairs Contracting Activity: Network Contract Activity (VISN 9/90), 1639 Medical Center Parkway, Suite 400, Murfreesboro, TN 37129 THIS SECTION TO BE COMPLETED BY THE REQUESTING SERVICE. 1. Nature and/or description of the action being approved. Assessment of area in the Medical Center for potential hazards where water intrusion occurred. Must be done as an emergency due to OSHA complaint. 2. The supplies or services required to meet the agency's needs (including the estimated value). Consultant services include use of moisture meter and infrared camera to assess moisture content in walls and air sampling for mold spores. Cost is $5630.00 3. Demonstration that the proposed contractor's unique qualifications or the unique nature of the acquisition requires use of the authority cited. Contractor has been used in the past for urgent, short turnaround situations and has proven to be reliable, and accurate. 4. Other facts supporting the use of other than full and open competition. The timeframe of this action is so short; there is not adequate time for open competition. 5. Actions if any the agency may take to remove/overcome any barriers to competition before subsequent acquisitions. None 6. Technical or requirements personnel certification. OHST; CIH; CSP I hereby certify that the supporting data which is the responsibility of technical or requirements personnel (e.g. verifying the Government's minimum needs or schedule requirements or other rationale for other than full and open competition), and which forms a basis for the justification, are complete and accurate. THIS SECTION TO BE COMPLETED BY THE CONTRACTING OFFICER. 7. Statutory authority permitting other than full and open competition. 6.302-2 -- Unusual and Compelling Urgency. b) Application. This authority applies in those situations where (1) An unusual and compelling urgency precludes full and open competition, and (2) Delay in award of a contract would result in serious injury, financial or other, to the Government. The attached documentation demonstrates that potentially hazardous conditions exist to employees and /or patients at the Memphis VAMC in the emergency room area. The OSHA complaint notice cites dangers of electrocution and/or mold exposure. Due to the potential hazards, the Memphis VAMC must comply with the 3 day inspection deadline given by the Occupational Safety and Health Administration (OSHA) (see attachment #1) per 29 CFR 1960.28 (d)(3) which states the following : Executive Order 12196 requires that agency inspections be conducted within 24 hours for employee reports of imminent danger conditions, within three working days for potentially serious conditions, and within 20 working days for other than serious safety and health conditions. 8. Efforts made to ensure that offers are solicited from as many potential sources as is practicable, including whether a CBD notice was or will be publicized. No efforts were made to compete or publicize due to emergency nature of the situation. Inspection must be made immediately to address any potentially hazardous conditions that may exist due to water intrusion. 9. Determination by the contracting officer that the anticipated cost to the Government will be fair and reasonable. I Reviewed the GSA 899 Environmental Services Contract and found the prices quoted for each labor code to be close to that of the GSA pricing. Therefore, it is my determination that pricing is considered to be fair and reasonable. 10. Description of the market research conducted and its results, or a statement of the reason market research was not conducted (see Part 10). No market research was conducted as this is an emergency procurement that requires immediate action to resolve potentially hazardous condition(s) within the Memphis VAMC and to comply with OSHA requirement for inspection within 3 days of complaint. 11. A listing of the sources, if any, that expressed in writing an interest in the acquisition. None 12. Contracting Officer's certification. I hereby certify that the above justification for other than full and open competition is accurate and complete to the best of my knowledge and belief.
