- Justification and Approval for 63000-11-2377 The U.S. Securities and Exchange Commission (SEC) intends to negotiate on an other than full and open competitive basis with Oracle America, Inc. for annual maintenance license renewal of SEC's Oracle Middleware Software Suite. Oracle Middleware software is the only product that has been identified as capable of satisfying the SEC's requirement. This software supports the SEC's critical applications. Therefore, if this software is not renewed, the SEC will not be able to acquire support for the Oracle application suite, which is used by critical applications such as HUB and TCR. Due to licensing, warranty, and compatibility issues, it is not possible for another source to meet the SEC's requirement. The statutory authority permitting other than full and open competition is 41 U.S.C. 253 (c) (1), implemented by FAR 6.302-1 - Only one responsible source and no other supplies or services will satisfy agency requirements. The Justification and Approval for this action is attached to this notification. The SEC intends to award a contract to Oracle on or about September 20, 2011. This notice is not a competitive request for proposals. A competitive solicitation will not be issued. However, the government will give consideration to interested parties that identify their interest and capability to respond to the requirement or submit proposals by the response date of this notice.
