- This is a NOTICE OF INTENT TO AWARD A SOLE SOURCE CONTRACT using Federal Acquisition Regulation FAR Part 13.5, Test Program for Certain Commercial Items. This will be an acquisition under the authority of the test program for commercial items section 4202 of the Clinger-Cohen Act of 1996. The US Army Contracting Command, Aberdeen Proving Grounds (Aberdeen Installation Contracting Division), 4118 Susquehanna Avenue, Aberdeen, MD 21005 has a requirement to procure the following: Annual Maintenance of Bruker Optics IFS66vs vacuum spectrometer The intended delivery date for the item(s) is September 30, 2011. The Government intends to award a Firm-Fixed Price sole source contract to Bruker Optics, Inc. This firm is the sole developer/manufacturer /distributor of the original equipment, and is the only company certified to service their systems. The associated North America Industry Classification System (NAICS) Code is 334516 and the Business Size Standard is 500 employees. All responses received within four (4) days after date of publication of this notice will be considered by the Government. A determination by the Government not to compete this proposed purchase order based upon responses to this notice is solely within the discretion of the Government. Interested persons may identify their interest and capability to respond to the requirement no later than 2:00 PM Eastern Daylight Time, September 19, 2011. Any response to this notice must show clear and convincing evidence that competition would be advantageous to the Government in future procurements.
