- CA VM Manager Suite for Linux on System Z and CA MIM Resource Sharing for Linux on System Z. Justification for Other than Full and Open Competition: This Justification for Other Than Full and Open Competition is in response to a requirement from the Federal Bureau of Investigation (FBI), Finance Division, Financial Systems Implementation Office (FSIO), in furtherance of the Supply Chain Management system implementation. FSIO has a requirement to purchase 20 licenses under the FBI's Enterprise License Agreement with CA Inc. This procurement will be handled by the Contracting Center of Excellence, Procurement Section, Finance Division, in accordance with 41 U.S.C. 253 (c)(1). 1.0 Ordering Agency Federal Bureau of Investigation Directorate of Intelligence 935 Pennsylvania Ave Washington DC 20535 2.0 Nature and/or description of the action being approved: This Justification and Approval authorizes the purchase of 20 Licenses of CA Software. In accordance with Federal Acquisition Regulation (FAR) 11.105(a)(1), the particular brand name, product, or feature is essential to the Government's requirements, and market research indicates other companies' similar products, or products lacking the particular features, do not meet, or cannot be modified to meet, the agency's needs. 3.0 Description of the supplies required to meet the agency's needs: In 2010, the FBI entered into a contract with IBM for the purchase of a new Supply Chain Management system. In order to deploy the system bureau-wide, the FBI had to increase the capacity of its mainframe. Additional capacity was acquired, but in order to properly utilize this capacity, base software was also required. CA VA Manager assists the customer in better utilizing resources and is required, along with other software, as a platform to host systems like the Supply Chain Management System. 4.0 Identification of the statutory authority permitting other than full and open competition: The statutory authority for conducting this acquisition is 41 U.S.C. 253 (c)(1). The regulatory authority is FAR 6.302-1. 5.0 Demonstration that the proposed contractor's unique qualifications or the nature of the acquisition requires use of the authority cited: CA is the sole developer of the required software and has not licensed any other vendors to market the required software. 6.0 Description of efforts made to ensure that offers are solicited from as many potential sources as is practicable, including whether a notice was or will be publicized as required by FAR: At the conclusion of the Enterprise License Agreement, the FBI will conduct market research to determine whether equivalent products are available. If so, the FBI would consider conducting a new competitive procurement. 7.0 Determination by the contracting officer that the anticipated cost to the government will be fair and reasonable: The FBI was able to negotiate substantial discounts off CA Inc. GSA listed pricing and feels certain that, based on published pricing and the percent discount, the contracted for price is fair and reasonable. 8.0 Description of the market research conducted (see FAR Part 10) and the results or a statement of the reason market research was not conducted: Market Research was conducted concerning this product prior to the Bureau entering into the current Enterprise License Agreement. At that time, it was determined that the required software represented the best value to the government and was necessary to support the unit's mission. 9.0 Any other facts supporting the use of other than full and open competition: To date, the FBI has invested substantial time and resources in this product and in training its employees to respond to needs/issues involving this product. Based on the discounts received and the time/resources invested, any competition would be unlikely to achieve better value or cost savings for the Bureau. 10.0 Listing of the sources, if any, that expressed, in writing, an interest in the acquisition: N/A 11.0 Statement of actions the agency may take to remove or overcome any barriers to competition before any subsequent acquisition for the supplies or services required: See item 6.0 12.0 Contracting officer certification that the justification is accurate and complete to the best of the contracting officer's knowledge and belief Approval of the Brand Name Justification: The following FBI representatives have reviewed the data provided in support of the Justification and Approval to procure using Other Than Full and Open Competition and hereby certify that the data is accurate and complete to the best of their knowledge and belief.
