Description
Justification and Approval for Sole Source Award An identification of the statutory authority permitting other than full and open competition. FAR 6.302 UNUSUAL AND COMPELLING URGENCY AS AUTHORIZED BY 41U.S.C 253(c)(2). This requirement is in support of Regional Security Office (RSO) Baghdad's mission to provide a safe and secure environment for the conduct of U.S. foreign policy in Iraq. Services provided under this contract will directly support the RSO personnel vetting program, which determines suitability for employment and authorization for access to the Embassy and other Chief of Mission properties. RSO Baghdad estimates approximately 9,700 locally employed staff (LES), third country nationals (TCNs), and U.S. citizen direct hire and contractor personnel will require vetting during the next six months. The vetting program is critical to Embassy operations as vital positions cannot be staffed until personnel are properly vetted. Delays in vetting can significantly impact the Embassy's ability to perform diplomatic missions in Iraq. Additionally, the award of the LOGCAP IV logistics support contract is imminent. Once awarded, LOGCAP IV personnel will require immediate vetting to ensure continued support for the Embassy. RSO Baghdad requires immediate support for vetting operations. The nominated vendor currently provides linguistic support for other RSO Baghdad programs, and has qualified personnel in Iraq, and that can provide immediate staffing for these critical support positions. The nominated firm is familiar with RSO Baghdad's requirements and operations, has a history of meeting contractual requirements in a timely manner, as well as has having an active presence in Baghdad. The vendor has logistics support capability and in-country program management in place. This existing infrastructure minimizes the risk of contract startup as well as mitigates potential issues relative to   non-performance. In addition, the identified firm's personnel have related experience in Iraq and are familiar with region-specific customs, norms, and culture. A sole source award eliminates the extensive delay of contract performance associated with the competitive selection process. It is reasonable to assume the Department, and the mission, would experience significant delays that are associated that would result from the need for other vendors to recruit, hire, train, and deploy personnel. These delays would have a detrimental impact on RSO Baghdad's ability to vet personnel in a timely manner and will have negative impact on all Department of State programs in Iraq.
