Description
Based on a requirement for the Zablocki VA Hospital, Milwaukee, WI a sole source award has been made to Synthes at the total contract amount of $96,340.50 as a sole source procurement for implant supplies. Market Research was conducted and awardee was the only company with the required items. Thank you for your interest in this procurement. Sincerely, Scott Ivy Contracting Officer Great Lakes Acquisition Center (GLAC) Milwaukee, WI DEPARTMENT OF VETERANS AFFAIRS Justification and Approval For Other Than Full and Open Competition 1.Contracting Activity: Department of Veterans Affairs, VISN 12, Great Lakes Acquisition Center, 5000 W. National Avenue, Milwaukee, WI 53295. 695-11-4-081-8202 2. Nature and/or Description of the Action Being Processed: Justification and approval for Other Than Full and Open Competition for purchasing implant supplies. 3. Description of Supplies/Services Required to Meet the Agency's Needs: These products, implantable screws and plates, are the only products that will work with the current instrumentation in place at the VA. Implantable screws and plates are proprietary to the instrument set with which they belong. The VA currently has 17 instrument sets from Synthes totaling over $1,000,000. The VA has had extensive training and education in the usage of these instrument sets and the implantables that go along with them. 4. Statutory Authority Permitting Other than Full and Open Competition: FAR 6.302-1(a)(2). The VA's minimum needs can only be satisfied by unique supplies or services available from only one source (41 USC 253 (c)(1)). 5. Demonstration that the Contractor's Unique Qualifications or Nature of the Acquisition Requires the Use of the Authority Cited Above (applicability of authority): There are two other competitors in this market, Stryker and Smith & Nephew, and VA trialed these sets when the initial instrument sets were purchased. The Synthes sets were chosen because of the ability to be used across services (Ortho, Trauma, etc.). The implantables from other vendors like Stryker and Smith & Nephew are not compatible with the Synthes instruments sets. 6. Description of Efforts Made to ensure that offers are solicited from as many potential sources as deemed practicable: The Contract Service Center conducted research and the facility concluded there were no viable GSA contracts for the product and a GSA waiver was obtained. 7. Determination by the Contracting Officer that the Anticipated Cost to the Government will be Fair and Reasonable: Price was compared and confirmed with the end user on past purchases for the same or similar type equipment and is comparable. 8. Description of the Market Research Conducted and the Results, or a Statement of the Reasons Market Research Was Not Conducted: Searched Dynamic Small Business Search, VetBiz, and GSA which revealed no small buisnesses. 9. Any Other Facts Supporting the Use of Other than Full and Open Competition: GSA waiver approved by NAC. 10. Listing of Sources that Expressed, in Writing, an Interest in the Acquisition: None. 11. A Statement of the Actions, if any, the Agency May Take to Remove or Overcome any Barriers to Competition before Making subsequent acquisitions for the supplies or services required: The end user and contracting officer conducted market research in advance. 12. Requirements Certification: I certify that the requirement outlined in this justification is a Bona Fide Need of the Department of Veterans Affairs and that the supporting data under my cognizance, which are included in the justification, are accurate and complete to the best of my knowledge and belief.
