Description
JUSTIFICATION AND APPROVAL FOR OTHER THAN FULL AND OPEN COMPETITION - 1. The Office of Acquisition Management is conducting this acquisition for Continuing Medical Education (CME) services from The Cleveland Clinic on behalf of The Office of Medical Services. 2. Nature and/or description of the action being approved. This order was prepared in order to allow training and allow us to organize and present medical content at our annual CME. This procurement is being conducted under FAR Part 13 Simplified Acquisition Procedures. 3. A description of the supplies or services required to meet the Department's needs. The estimated cost is $99,950.00. The Office of Medical Services requests a sole source contract with The Cleveland Clinic to provide Continuing Education to foreign and domestic Office of Medical Services' health practitioners at sites in the U.S and overseas. The Cleveland Clinic will provide presentations over the course of two days to Department of State, health care professionals at two locations (Buenos Aires and Zagreb) for their CME credits and to medical providers at the same two locations for their CME credits. This training will be held over a total of eight days. There will be 4 to 7 presenters at each conference. The presenters will provide medical updates and hold discussions for four general topics regarding primary care in the out-patient (i.e., our overseas health unit) settings: pediatric trauma and other acute care; obstetric and gynecologic acute care; oncology prevention, education, and identification; and wellness and healthy habits including nutrition, exercise physiology, sleep apnea and sleep habits, and travel medicine guidance. Each topic will last on-half day. There will be approximately 600 medical personnel in attendance over the course of the eight days. The medical professionals include Foreign Service Health practitioners, Regional Medical Physicians and Psychiatrists, and locally hired physicians and nurses. 4. An identification of the statutory authority permitting other than full and open competition. 41 USC 253(g) and FAR 13.106-1(b), Only one responsible source and no other supplies or services will satisfy agency requirements. 5. A demonstration that the proposed contractor's unique qualifications or the nature of the acquisition requires use of the authority cited. Cleveland Clinic has a team of presenters including physicians, a registered dietitian, clinical nurse specialists, and nurse practitioners who are experts in their fields and who have developed training specifically geared to remote, overseas settings. Past experience between the Office of Medical Services (MED) Foreign Programs and Cleveland Clinic has established an excellent working relationship. Individual Specialists at Cleveland Clinic have worked extensively with the Director of Foreign Programs in coordinating all aspects of the care and treatment of our patients who are medevaced to Cleveland Clinic for treatment. Cleveland Clinic has provided our patients and MED overall superb service over the course of the last five years and is very familiar with many of our medical providers and the concerns that present our patients and medical staff in the field. The Cleveland Clinic's Continuing Medical Education Program would offer MED a specially focused and unique understanding and perspective of our medical subject matter needs. Collaboration with Cleveland Clinic would enhance the overall working relationship of our main Medevac Center Provider in the U.S. while providing state-of-the-art Continuing Medical Education a vital component of the licensing and credentialing of our Medical Providers. 6. A description of efforts made to ensure that offers are solicited from as many potential sources as is practicable. A Combined Synopsis solicitation will be issued under FAR Part 12.6 procedures. The Combined Synopsis/Solicitation will include this Justification, and will be publicized on FedBizOpps in accordance with FAR 5.102(a)(6). 7. A determination by the Contracting Officer that the anticipated cost to the Government will be fair and reasonable. The Contracting Officer will make a fair and reasonable price determination in accordance with FAR 13.106-3, and will be based on market research, comparison of previous purchase prices found reasonable, or a comparison with similar items in related industry. 8. A description of the market survey conducted and the results or a statement of the reasons a market survey was not conducted. A market survey was not conducted, because we have found that, through Past Experience, The Cleveland Clinic has provided outstanding content to their program. The Office of Medical Services would like to continue their contract with a company that we have past experience with and who has a world-renowned, state of the art program which will enhance the knowledge and skills of our health care providers serving at American Embassies, Consulates, and Missions overseas. This will ensure that our medical providers are receiving the very best up to date instruction available and are able to continue their professional licenses and credentials. 9. Any other facts supporting the use of other than full and open competition. CME is essential and required for our medical professional staff. In the past, we have worked to accomplish our mission by working in collaboration with the Cleveland Clinic. For reference, our last purchase order number was SAQMMA10M2597. This order was prepared in order to allow training and allow us to organize and present medical content at our annual CME. 10. A listing of sources, if any, that expressed, in writing, an interest in the acquisition. None. 11. A statement of the actions, if any, the agency may take to remove or overcome any barriers to competition before any subsequent acquisition for the supplies or services required. Include a statement that this J&A for other than full and open competition will be published on FedBizOpps in accordance with FAR Section 6.305 within 14 days of award (or within 30 days if the J&A is for unusual and compelling urgency.) Acquisitions conducted under simplified acquisition procedures are exempt from the requirements in FAR Part 6. Nonetheless, this Justification will be publicized on FedBizOpps with the Combined Synopsis/Solicitation, in accordance with FAR 5.102(a)(6).
