Description
Below please find the National Park Service's (NPS) responses to questions submitted pertaining to the Prospectus for a Concession Contract to provide Dude Ranch Operations within Grand Teton National Park. 1) Under the Business Opportunity section (page 14) of the prospectus - The Service estimates the value of the Turners' possessory interest to be approximately $1,023,197. The Turners believe this estimate is not correct and significantly undervalues their possessory interest in the concession. Please specifically identify the method by which the Service calculated the Turners' estimated possessory interest value and a spread sheet showing the Service's estimated value of the Turners' possessory interest in each structure located on the Ranch. As stated in the Prospectus, the NPS' value for the Existing Concessioner's Possessory Interest is an estimate. The NPS developed its estimate in accordance with Section 13(b) of the Existing Contract, as amended, which sets forth formulas for calculating and depreciating Possessory Interest value. The NPS included in its estimate NPS-approved Capital Improvements made by the Concessioner during the term of the Existing Contract. 2) Why does the prospectus not recognize that the Turners own the name "Triangle X Ranch" as well as their historic brand? The NPS is aware that the Turners have registered the trade name and trademark for "Triangle X Ranch" and the TX2 brand, respectively. For this reason, the Prospectus does not suggest that the name of the ranch will be the same under a new contract, nor does it even mention the trademarked brand. Further, the Prospectus refers to the "current" Triangle X Ranch only in reference to the area. 3) Under the Proposed Operating Plan (Exhibit B), Section 5) J-1(c): Please clarify what the Service means by pack-trips and hunting-trips "based from the ranch?" Is the Service suggesting all pack-trips and hunting-trips being conducted entirely on National Forest Lands and currently being charged a franchise fee by the National Forest are also subject to the Park Franchise Fee. Triangle X Ranch uses NPS-owned facilities and lands to store equipment and supplies used in its wilderness pack trips and hunting trips. Bookings for such trips occur at the ranch and the personnel associated with these trips live there. In addition, hunters scheduled on such trips commonly overnight or stage at the ranch prior to departing. Thus, the use of NPS property to stage such trips indicates these trips are based from the ranch. The language in the contract (Exhibit B: Operating Plan IV. H.1.b ) states that, " [r]evenue earned on pack trips or hunting trips based from the ranch will be reported and appropriate franchise fees will apply." 4) Is the Service aware a majority of the horseback rides taken from Triangle X Ranch utilize National Forest Service lands and the National Forest permits authorizing horseback riding and other activities are held by individual Turners (incumbent concessioners); and should the Turners not be awarded the new concession contract, the permits will not automatically transfer to new owners? Yes, the Service is aware that the Existing Concessioner takes horseback rides from the Triangle X Ranch into properties owned by the USFS, and that any business operating on USFS land must have a permit issued by that Agency to do so. Errata #1 - Below please find the National Park Service's (NPS) changes to the Prospectus for a Concession Contract to provide Dude Ranch Operations within Grand Teton National Park. I. Draft Contract Exhibit B: Operating Plan, D) Guided Float Trips and Fishing Trips on the Snake River, on Page B-17Replace both (3) Launches, Takeouts, Stops and (4) Use Limits with the following text: (3) Launches, Takeouts, Stops a)Scenic trip launch points: Pacific Creek, Deadmans Bar, Snake River Cooksite launch area (meal floats only).b)Scenic trip takeout points: Deadmans Bar, Moose, Cooksite launch areac)Scenic trip meal stops: Deadmans Bar #2. Only gas grills may be used for cooking. Fires are permitted only at authorized meal stops.d)Passenger meeting points: Moose and Concession lodging with prior approval of the Concessioner. e)Fishing trips may launch and takeout at any Service established river launch point in Grand Teton National Park.f)Stopping at any other points along the river is not permitted except for fishing trips or emergencies (this includes stopping on the water or dragging anchor). (4) Use Limits(a) Daily scenic float quota: 18 launches.(b) Daily scenic float trip reserve: 5 launches.(c) Monthly scenic float trip reserve: 9 launches.(d) Daily fishing trip quota: 5 launches.(e) Monthly fishing trip quota: 28 launches.(f) Three fishing launches per day from Moose apply to the daily quota, but not the monthly cap. II. Draft Contract Exhibit D: Assigned Land & Real Property, Maps on Page D-4 and D-5.Replace both maps (GRTE004: Buildings and Land Assignments and GRTE 004 Land Assignments) with the following three (3) new maps: 1.GRTE004: Buildings and Land Assignment2.GRTE004 Land Assignments3.GRTE004: Triangle X Pastures The new maps will be available for download from NPS Commercial Services Website at this link: http://www.concessions.nps.gov/grte004-12.htm
