Description
This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in Subpart 12.6, as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; proposals are being requested and a written solicitation will not be issued. The solicitation number for this procurement is A12PS000135 and this is a Request for Proposal (RFP). This requirement is a 100% set-aside for Native American Small Business. The anticipated award will be a Firm Fixed Price Contract; the award will be made based on the best offer that is most advantageous to the government. The solicitation shall incorporate provisions and clauses that are in effect through Federal Acquisition Circular FAC 2005-50. The suggested North American Industry Classification System (NAICS) code is 541611. BACKGROUND: This requirement shall provide individualized hands-on training for tribal government personnel on the development of Federal Corporate Charters under Section 17 of the Indian Reorganization Act (IRA) of 1936. In order to promote a higher level of participation training will be conducted at the identified Indian tribal locations. REQUIREMENTS: The Office of Indian Energy and Economic Development (IEED) will identify and determine four (4) to seven (7) tribes that will be candidates as recipients of individualized training for the development of Federal Corporate Charters for economic development purposes under Section 17 of the Indian Reorganization Act of 1936. The contractor will work in consultation with various tribal governments. The tentative list of tribes is: Red Lake Tribe (Minnesota), Oneida (Wisconsin), Kickapoo (Kansas), Fond du Lac (Minnesota), Ysleta Del Sur Pueblo (Texas), Three Affiliated Tribes (North Dakota), and San Carlos Apache (Arizona). IEED will specify the time and date in which the contractor will conduct the training sessions on the development of the Federal Corporate Charters.IEED will determine a timeline for completion of the each training session and completion of the project in coordination with the contractor. IEED will assist in the coordination of the logistics with the identified tribal entities for the training session(s).IEED will identify and determine the targeted tribal governments and provide the names of tribal entities to the contractor to begin development of the training curriculum and logistics for each tribe. DELIVERABLES: The contractor will initiate the development and production of all training materials to be delivered on-site for the training session. The following course materials for the training sessions will consist of, but are not limited to: (1) Presentation of recent BIA direction, memoranda, and guidance; (2) Presentation of Updated ? 17 processing guidelines for Federal charters; (3) Presentation of a sample Federal Charter for the Tribal government; (4) Compilation of material camera-ready for training purposes; (5) Development of a PowerPoint for presentation at the training session.The contractor will develop a three-ring binder for each participant and delivered on-site, which will contain: (1) Guidelines for the processing of ? 17 Federal Charters for attendee; (2) Sample Federal Charter; (3) Recent Central Office memoranda regarding the processing of Federal Charters; (4) CDs containing electronic copies of relevant training materials for all attendees; (5) Other relevant documentation concerning tribal Federal Charters; (6) Certificates of completion for attendees who complete course.This material will be used as a desk book or processing and procedure guide, which will be used by tribal government entity personnel and BIA agency personnel to developing a Federal Corporate Charter, under Section 17 of the IRA for the promotion of tribal economic development. Place of Performance: The training sessions for the development of Federal Corporate Charters will be at the tribal location specified by IEED as developed in coordination with the contractor. Period of Performance: The anticipated start date is after award, tentatively set for December 05, 2011 and shall last no longer than 90 days. Scheduling the session dates shall be proposed by the contractor and submitted to IEED for final acceptance. After exact dates are established, the contractor shall proceed with the following four day schedule; Day 01: Travel to tribal site; Day 02: On-site final coordination and logistical set-up with the tribe at the tribal locations; Day 03: Conduct a one-day, 8-9 hour training session. Day agenda must be submitted to IEED prior to training; Day 04: Travel return. Instructions for Quote: The Quoter shall prepare a firm fixed price quote that contains all information necessary to allow for a comprehensive evaluation of the costs proposed. Please include a cover page to indicate Duns, TIN, and Point of Contact. Evaluation Criteria: (a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate offers: (In order of importance) (1) Past Performance, (2) Key Personnel, (3) Price, (4) knowledge of development and delivery of training of Federal Corporate Charters in accordance with Section 17 of the Indian Reorganization Act of 1936, (5) Native American/Indian Owned Business. The Government may award a contract without discussions with offeror's. Award will be made based on "best value" to the government via the tradeoff process. "Best value" is defined as the offer that results in the most advantageous solution for the Government, in consideration of the evaluation criteria.All evaluation factors other than price, when combined are significantly more important than price. (a) A written notice of award or acceptance of an offer mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer's specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.(b) Options. The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s).(c) A written notice of award or acceptance of an offer mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer's specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award. The Government may award a contract without discussions with offeror's. Award will be made based on "best value" to the government via the trade-off process. "Best value" is defined as the offer that results in the most advantageous solution for the Government, in consideration of the evaluation criteria. EVALUATION FACTORS: (1) Past Performance-Relevant/similar contracts and past projects. Only past performance data regarding relevant past performance completed within the last three years, or work that is ongoing, is evaluated. (Limit 2 pages) (2) Key Personnel-Resumes of all personnel expected to work this effort. (Limit 1 page per resume, max 2 resumes). Organizational chart to include descriptions of the duties and responsibilities of each contractor employee proposed. (Limit 2 pages) (3) Price-breakdown as required on the solicitation form 1449. Which may use any or all of several bases of comparison including the independent government estimate, current or recent prices for the same or substantially the same services purchased in comparable quantities under similar terms and conditions, comparisons with market prices of commercial services, and the GSA contracts. Award of this contract may be made using best value. (Limit 1 pages) (4) The general familiarity and general knowledge of the contractor with federally recognized Indian tribes, development of Federal Corporate Charters under Section 17 of the Indian Reorganization Act of 1936, and familiarity of the process for approval of Federal Charters. (Limit 1 page) (5) Native American/Indian Owned Business-BIA encourages the participation of Native American/American Owned vendors in accordance with FAR 52.226-1; Utilization of Indian Organizations and Indian-Owned Economic Enterprises & DIAPR 1452.226-70/71; Indian Preference and Indian Preference Program. BIA 1452.280-3; Subcontracting limitations, A contractor shall not subcontract to other than Indian Firms more than 50 percent of the work under a prime contract award pursuant to the Buy Indian Act. For this purpose work to be performed does not include the provision of technical assistances, materials, supplies, or equipment.
