- Ethics Policies Business Associate Agreement Contractor Inserts Clauses Incorporated by Reference and in Full Text This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in Federal Acquisition Regulation (FAR) Subpart 12.6, as supplemented with additional information included in this notice. This procurement is being conducted under Simplified Acquisition procedures pursuant to the authority of FAR Subpart 13.5, Test Programs for Certain Commercial Items (10 U.S.C. 2304(g) & 2305 & 41 U.S.C. 253(g) & 253a & 253b), FAR Part 12, Acquisition of Commercial Items (Title VIII of the Federal Acquisition Streamlining Act of 1994 (Public Law 103-355)), & FAR Subpart 37.4, Non-personal Health Care Services (10 U.S.C. 2304 and 41 U.S.C. 253). This announcement constitutes the only solicitation; therefore, a written solicitation will not be issued. The Aberdeen Area Indian Health Service (IHS) intends to award a firm-fixed price commercial item purchase order in accordance with the Request for Quotation (RFQ) 12-043, for Physical Therapist services at the Pine Ridge IHS Hospital in Pine Ridge, South Dakota. The solicitation is issued as a 100% small business set-aside. The solicitation documents & incorporated provisions & clauses are those in effect through Federal Acquisition Circular 2005-54. The associated North American Industry Classification System code is 621340 and the small business size standard is $7.0 million. BID SCHEDULE: PHYSICAL THERAPIST SERVICES : the quoted pricing must be all inclusive (to include but not be limited to travel, lodging, per diem, fringe benefits, federal, state and local taxes) plus all other costs pertinent to the performance of this purchase order. Please complete the following pricing schedule utilizing your most competitive and reasonable rates which the IHS will use to the "Best Value" to the government. 1. Physical Therapist services (12/05/2011 through 03/05/ 2012) Regular Hours: 520 hours x $_____________ per hour STATEMENT OF WORK Purpose of Contract The mission of the Pine Ridge Service Unit is to provide the best possible health care services to the Native American population on the Pine Ridge Reservation in South Dakota. To meet the mission, the Pine Ridge Service Unit requires contractor support to assist the service unit in the recruitment and placement of a physical therapist into a temporary duty assignment in the Pine Ridge IHS Hospital/Clinic. The contract effort shall be tailored to provide physical therapy services. The purpose of the contract is for the recruitment, credentialing and placement of 1 physical therapist to provide physical therapy services while the current physical therapist is detailed to other duties. The care provided by the contractor shall be as comprehensive as the IHS supplied facilities, equipment, and support services permit. The Contractor shall furnish the necessary personnel to provide physical therapy services to the Pine Ridge Service Unit. The Indian Health Service requires physical therapy services upon request during the term of this contract. The contract resulting from this solicitation shall: 1. Be a non-personal health care services contract under which the Contractor is an independent contractor; 2. Allow the Government to evaluate the quality of professional and administrative services provided; 3. Require Contractor to adhere to the policies and procedures of the Pine Ridge IHS Hospital; 4. Require the Contractor to provide general and professional liability insurance for its employees and agents; the Contractor shall indemnify the Government for any liability producing act or omission by the Contractor, its employees and agents occurring during contract performance; 5. Require Contractor to assume sole and exclusive responsibility for withholding federal and state taxes, paying federal social security taxes, unemployment insurance and providing workman's compensation. 6. Require Contractor to reimburse travel and daily compensation to the employee. Government Furnished Property, Facilities, and Services The physical therapist shall be assigned to the physical therapy department in which space for personnel belongings shall be provided. The physical therapist will be authorized to use all areas of the medical treatment facility available to civil service and commissioned personnel in similar positions. The same restrictions apply to the contractor physical therapist as any other IHS personnel to use these areas for official business activities only. The contract physical therapist will be authorized to use all administrative and professional support available to IHS. This will include but is not limited to copy machines, telefax machines, medical library, and telephone services. The same restrictions to use these items for official IHS business apply. The contract physical therapist shall be provided with an orientation to the IHS and the Indian community being served. Service Unit personnel shall provide the initial orientation and continuing orientation. The Service Unit shall provide all medical and nonmedical equipment and supplies used in the Pine Ridge IHS Hospital for the care and management of patients. The Service Unit shall provide all required blank government forms applicable to the IHS. Service Unit personnel will provide an appropriate orientation to the necessity of such forms. The Service Unit shall provide an ongoing method of monitoring and evaluation of the quality and appropriateness of patient care and of identifying deficiencies in the quality of services performed before the level of performance becomes unacceptable. Contractor Furnished Equipment, Facilities, and Services The Indian Health Service does not anticipate a need for contractor furnished equipment. The Contractor will be responsible for providing his/her own uniform. Statement of Work The Contractor shall furnish a physical therapist to provide professional physical therapy services in the physical therapy department as directed by the Supervising physical therapist. The Contractor shall provide professional physical therapy services for the Indian Health Service beneficiaries served by the Pine Ridge Service Unit. Contract physical therapists shall cover the range of physical therapy service typically provided in a rural hospital/clinic of similar size. Contract performance shall be according to the requirements contained in this statement of work. The Contractor shall locate, credential and have available staff to provide physical therapy services during the period of Dec 5, 2011 to March 5, 2012. Assignments will require shifts of no less than eight (8) hours and no more than ten (10) hours. These shifts may range from 7:00am to 6:00pm, Monday through Friday for a total of 80 hours in a two week period. The contract physical therapist is responsible for scheduling all patients. The contract physical therapist will schedule a minimum of 10 patients per day but may schedule more as appropriate. When a patient calls to cancel, the contract physical therapist will attempt to fill that spot with another patient. The contract physical therapist will perform primary functions of a physical therapist in assessment, physical therapy diagnosis, outcome identification, planning, implementation, and evaluation of care provided to all patients in the physical therapy department, both outpatient and inpatient. The contract physical therapist is responsible for following the APTA Code of Ethics and the APTA Professional conduct policies, along with the state practice act of his/her state of licensure. The contract physical therapist is responsible for managing supplies and equipment in the physical therapy department and promoting teamwork with primary care providers, co-workers, personnel of other departments and the patient community. The contract physical therapist must have current Basic Life Support (BLS) certification. The contract physical therapist must provide a list of professional skills and abilities. The contract physical therapist must have at least one (1) year experience in physical therapy at either an outpatient or combination inpatient/outpatient setting. The contract physical therapist may be asked to provide mentorship to students as needed. The contract physical therapist shall speak, understand, read and write English fluently and communicate with sufficient clarity to be understood by the Pine Ridge Indian Health Service Hospital patients and personnel. The contract physical therapist shall possess sufficient initiative, interpersonal relationship skills and social sensitivity such that he/she can relate constructively to patients from the Native American community. Verification of Licensure To ensure that physical therapists providing services under this contract are properly licensed and that IHS is aware of any disciplinary actions taken against such physical therapists, the contractor shall: 1. Verify through the State Board(s) that regulates physical therapy in the state of licensure that the physical therapist holds a current, active physical therapy license that is in good standing. Inform IHS of the status of all licenses for each physical therapist who would provide services under this contract in this facility. 3. Certify that all information obtained on contract physical therapist has been reviewed and verified by the contractor. This certification must include a statement that the contractor has found no reason to reject the physical therapist's application. The names of the contracts, their titles, telephone number, dates of contracts, and the name(s) of the contractor's representative(s) collecting and reviewing such information must be recorded in writing and made available to the IHS by the contractor. All of the information required above must be provided by the contractor to the Supervising Physical Therapist no less than seven days before the physical therapist's actual report date. When the requirements of the IHS facility do not allow for hard copies of the information to be received at least seven days before the physical therapist's placement, the contractor may provide such assurances to the Supervising Physical Therapist via telephone. Hard copies of information must then be provided to the Supervising Physical Therapist within five (5) days after physical therapist placement. Such instances must be kept to a minimum and the reasons for each instance must be documented and well justified by the Supervising Physical Therapist. Character Investigation for Contractors who will have contact with Indian Children The contract physical therapist performing services under this contract will have regular contact with or control over Indian children and is subject to a character investigation in accordance with the "Indian Child Protection and Family Violence Prevention Act" P.L. 101-630. The contractor and its employees must perform in accordance with section 231 of the Crime Control Act of 1990, P.L. 101-647. Failure to comply with these statutes results in immediate removal. The contract physical therapist shall generate and maintain proper medical record information on beneficiaries to whom treatment is provided in accordance with IHS regulations. The contract physical therapist shall prepare all medical record documentation to meet or exceed the established standards of the IHS facility to include but not be limited to: timeliness, legibility, accuracy, content, and signature. All documentation will be done electronically unless the Electronic Health Record is unavailable due to technical difficulties. All medical record information generated in the performance of this contract will remain the property and subject to the exclusive control of the Indian Health Service. The contract physical therapist shall comply with all IHS facility infection control and safety procedures, practices, and standards. The contract physical therapist shall meet all applicable Joint Commission on Accreditation of Healthcare Organization/Centers for Medicare & Medicaid Services (CMS) standards during the performance of this contract. The contract physical therapist shall respect and maintain the basic rights of patients to include but not limited to personal dignity. Contract Physical Therapist Responsibilities Evaluate new physical therapy patients and determine a plan of care to resolve the patients' issue(s). Provide treatments for all established patients according to the plan of care. Adjust the physical therapy plan of care as needed to improve patients' functional level. Use all equipment available to provide appropriate treatment to patients. Document all evaluations and treatments provided to patients using the electronic health record. Follow established recording and cleaning procedures for the hydrocollator. Record hydrocollator temperature daily and clean hydrocollator every 2 weeks. Consult with primary care providers and other healthcare professionals on patients to coordinate diagnostic and therapeutic regimens for patients. Provides patient and family education which include counseling and assisting the patient/family to understand and accept implications of care, diagnosis, and treatment. Follow Pine Ridge Service Units procedures and policies. Physical Therapist Qualifications The contract physical therapist must hold a current, unrestricted state physical therapy license from any of the 50 United States or the Commonwealth of Puerto Rico. PERIOD OF PERFORMANCE : Performance of the contract shall be from December 5, 2011 through March 5, 2012. CONTRACTING OFFICER AUTHORITY : Authority to negotiate changes in the terms, conditions or amounts cited in this contract is reserved for the Contracting Officer. PRO-CHILDREN ACT OF 1994 : The Contractor certifies that it will comply with the provisions of Public Law 103-227, Pro-Children Act of 1994, which imposes restrictions on smoking where federally funded children's services are provided. INVOICE SUBMISSION AND PAYMENT : The Contractor shall submit its original invoice to the Aberdeen Area Indian Health Service, Financial Management branch, 115 4th Avenue SE, Aberdeen SD 57401. The Contractor agrees to include the following information on each invoice. (1) Contractors name, address; (2) Contract Number (entire contract number must be included); (3) Invoice number and date; (4) Cost or price; (5) Dates of Service including the number of hours worked; and (6) Remit to address. The Aberdeen Area Financial Management Branch, 115 4th Avenue SE, Aberdeen, SD 57401, shall make payment. Attached are the Federal Acquisition Regulations (FAR) & Health & Human Services Acquisition Regulation (HHSAR) clauses that are applicable including below. FAR 52.212-1 Instructions to Offerors-Commercial Items (June 2008). Quotes shall be submitted on company letterhead stationery. Signed and dated. And it shall include: 1. Solicitation number 2. Closing Date: November 21, 2011 at 4:00 pm CST 3. Name, address and telephone number of company and email address of contact person. 4. Technical description of the item/service being offered in sufficient detail to evaluate compliance with the requirements of the solicitation. This may include product literature, or other documents, if necessary 5. Terms of any express warranty 6. Price and any discount terms 7. "Remit to" address, if different from mailing address. 8. A completed copy of the representations and certifications at FAR 52.212-3 or a copy of the contractor's Online Representations and Certifications Application (ORCA). 9. Acknowledgment of Solicitation Amendments (if any issued) 10. Past performance information, when included as a "best value" factor, to include recent and relevant contracts for the same or similar items and other references (including contract numbers, points of contact with telephone numbers and other relevant information). FAR 52.212-2, Evaluation-Commercial Items (January 1999). The provision at 52.212-2 applies to this acquisition and is provided in full text. (a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and the following "best value" factors considered. (1) Past Performance - The government reserves the right to conduct their own investigation other than the contractors provided list. (2) Ability to meet the performance schedule (3) Ability to meet the requirements and qualifications in the statement of work. SECURITY CLEARANCE Performance of this contract will require routine access by employees of the Contractor or its subcontractors to facilities or systems controlled by the Indian Health Service (I.H.S.). Before starting work requiring routine access to I.H.S. facilities or systems each person must complete a FBI National Criminal History Check (Fingerprint Check) adjudicated by an I.H.S. employee using the Office of Personnel Management Personnel Investigations Processing System. Contractors shall allow five business days for I.H.S. processing of fingerprints taken electronically at an I.H.S. site and thirty business days for non-electronic processing of fingerprints using FBI Form FD-258. A list of I.H.S. sites with electronic fingerprint capability is available from the Contracting Officer. In addition, no Contractor or subcontractor employee shall be permitted to perform work under this contract if listed on the HHS Office of Inspector General List of Excluded Individuals/Entities (LEIE), http://exclusions.oig.hhs.gov. As soon as practicable prior to the start of work, the performance of the work the Contractor shall provide to the Contracting Officer the names of all individuals to be used in performance of work for screening against the LEIE. During the performance, the Contractor shall provide the Contracting Officer the names of any additional or substitute employees for screening before they begin work. The Contractor is responsible for conducting security preclearance investigations in sufficient depth to ensure that each Contractor or subcontractor employee referred to I.H.S. is not on the LEIE and can obtain a favorable fingerprint clearance. Each security preclearance shall be conducted sufficiently in advance of the start of performance to avoid delays caused by denial of access. If this is a Time and Materials, Labor-Hour or Cost Reimbursement contract, the contractor shall not charge for or be reimbursed for labor hours or other costs incurred for employees who are unable to perform due to denial or access or the excess time required to resolve and clear unfavorable security clearance findings. If this is a Fixed Price contract, denial of access due to security clearance findings shall not be a basis for excusable delay or an increase to the contract amount. Government will pay for the cost to process the contractor's suitability clearances. However, multiple investigations for the same position may, at the Contracting Officer's discretion, lead to reduction(s) in the contract price of no more than the cost of the extra investigation(s). ACCEPTANCE PERIOD: Your quotation must stipulate that it is predicated upon all the terms and conditions of this RFQ. In addition, it must contain a statement to the effect that it is firm for a period of at least 60 days from the date of receipt by the Government.
