If the offeror proposes the brand names listed in Exhibit A Table B-1, the offeror will need to contact a Authorized Selling Agent for those products (if applicable) and if GSA schedule pricing can be obtained, prices shall be no higher than GSA schedule pricing. Government and any other discounts to GSA schedule rates are requested. If items other than the stated name brands are proposed, they shall have the same salient physical, functional, and performance characteristics as stated in Exhibit A: Table B-1. If any of the proposed items do not meet the salient characteristics specified on Exhibit A: Table B-1, those items may not be awarded. The FRTIB may select all or some of the items quoted on Exhibit A: Table B-1 for the contract award. The Government reserves the right to request clarification for proposed items before making an award decision. (a) If an item in this solicitation is identified as "brand name or equal," the purchase description reflects the characteristics and level of quality that will satisfy the Government's needs. The salient physical, functional, or performance characteristics that "equal" products must meet are specified in the solicitation. (b) To be considered for award, offers of "equal" products, including "equal" products of the brand name manufacturer, must- (1) Meet the salient physical, functional, or performance characteristic specified in this solicitation; (2) Clearly identify the item by- (i) Brand name, if any; and (ii) Make or model number; (3) Include descriptive literature such as illustrations, drawings, or a clear reference to previously furnished descriptive data or information available to the Contracting Officer; and (4) Clearly describe any modifications the offeror plans to make in a product to make it conform to the solicitation requirements. Mark any descriptive material to clearly show the modifications. (c) The Contracting Officer will evaluate "equal" products on the basis of information furnished by the offeror or identified in the offer and reasonably available to the Contracting Officer. The Contracting Officer is not responsible for locating or obtaining any information not identified in the offer. (d) Unless the offeror clearly indicates in its offer that the product being offered is an "equal" product, the offeror shall provide the brand name product referenced in the solicitation. (End of provision) Addendum to 52.212-1 -- Instructions to Offerors -- Commercial Items (Jun 2008) Technical Factor : Proposed items shall meet the salient characteristics (requirements) listed in Exhibit A: Table B-1 Pricing table and all other attachments and exhibits. Price Factor : Offerors shall submit all requested pricing and information included in Exhibit A: Table B-1 Pricing Table to include unit prices, hourly rates for labor, number of hours for labor, and total proposed prices. GSA schedule pricing shall be requested when applicable. Offerors are responsible for ensuring that all entries are mathematically correct. Item 18: For the labor costs, insert the number of hours and hourly rate to come up with this figure. All items will be listed under Firm Fixed Price Contract Line Item Numbers (CLIN) in the contract. 52.212-2 -- Evaluation -- Commercial Items (Jan 1999) (a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate offers: (i) Technical Acceptability ; Technically Acceptable: Offerors may receive a rating of acceptable if proposed items meet the salient characteristics (requirements) listed in Exhibit A: table B-1 Pricing table and all other attachments and exhibits. Pricing has been submitted for all items listed in Exhibit A: Table B-1. Technically Unacceptable: Proposed items that do not meet the salient characteristics listed in Exhibit A: Table B-1 Pricing table and all other attachments and exhibits or Note: If an offeror takes exception to any terms and conditions in this combined synopsis/solicitation, the Government may consider the offeror non-responsive. (ii) Price ; If the offer has been rated technically acceptable in accordance with section (i) above, the price will be evaluated. If all requested pricing and information has been added to Exhibit A: Table B-1 Pricing Table to include unit prices, hourly rates for labor, number of hours for labor, total proposed prices, GSA rates have been requested for all applicable items, and the total evaluated price is the lowest of all technically acceptable offerors, the offeror will be eligible for award. (b) Options. The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s). (c) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer's specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.
