HSHQDC-12-R-00007 Draft RFP Attachment 4, past performance questionnaire HSHQDC-12-R-00007 Draft RFP Attachment 3, labor category descriptions HSHQDC-12-R-00007 Draft RFP Attachment 2, letter HSHQDC-12-R-00007 Draft RFP Attachment 1, pricing model HSHQDC-12-R-00007, Draft RFP for OPO's BioWatch SETA requirement for OHA This is a pre-solicitation notice in accordance with FAR 5.203(a) as well as a draft Request for Proposal. The Department of Homeland Security (DHS), Office of Procurement Operations (OPO) anticipates soliciting proposals to procure Systems Engineering and Technical Assistance (SETA) support for the BioWatch Systems Program Office (SPO) for the DHS Office of Health Affairs (OHA). This pre-solicitation notice includes a draft solicitation (see attachments). Any questions about the draft RFP shall be submitted in writing by Monday, December 5, 2011 at 3:30PM Eastern Time to Margaret.Tse@dhs.gov. An Industry Day is anticipated and the estimated date is Wednesday, December 14, 2011; however, the time and location is to be determined. Further information will be posted as an amendment at a later time. The anticipated acquisition strategy for this requirement is a small business set-aside under NAICS code 514690 - Other Scientific and Technical Consulting Services with a size standard of $7 million. The contract type is anticipated to be a hybrid with part of it being a cost-plus-incentive-fee (CPIF) type contract; therefore, the offeror must have an approved cost accounting system. In addition, contract performance must take place at offices located in the greater Washington, D.C. metropolitan area and the offeror must have a secret facility clearance. Teaming arrangements are encouraged. In accordance with FAR 19.101(7) if the anticipated value of a contract exceeds one-half the size standard for a NAICS that carries a revenue based size standard, then for purposes of determining small business status the applicable size standard applies to individual concerns (businesses), not to the combined assets of a Joint Venture or Teaming Arrangement. The NAICS code (541690) applicable to the small business set aside portion of the BioWatch SETA is a revenue based size standard ($7.0M) and the anticipated value of the contract is in excess of one-half the size standard. Accordingly, if a Joint Venture or Teaming Arrangement is formed for purposes of responding to the small business set aside portion of the BioWatch SETA, then the size standard will be applied to the individual businesses, not to the combined assets of the Joint Venture or Teaming Arrangement. That means that a Joint Venture or Teaming Arrangement between an Other than Small Business (large business) and small business is impermissible, and that in order for the Joint Venture or Teaming Arrangement to be considered small *ALL members of the Joint Venture or Team MUST BE small businesses.* Additionally, even if not part of a small business Joint Venture or Teaming Arrangement, a large business cannot be affiliated with a small business. If affiliation is found, small business size standards cannot be met. Business concerns are affiliates of each other if one has the potential to control the other. The limitations on forming Small Business Joint Ventures or Teaming Arrangements do not extend to subcontracts with large businesses. A Small Business Joint Venture or Teaming Arrangement entity may subcontract with large businesses subject to FAR 52.219-14, Limitations on Subcontracting, and retain its status as a small business.
