Description
Statement of Work THIS IS A NOTICE OF INTENT, NOT A SOLICITATION FOR COMPETITIVE PROPOSALS. A SOLICITATION DOCUMENT WILL NOT BE ISSUED AND PROPOSALS WILL NOT BE REQUESTED. The National Institutes of Health (NIH), Office of Technology Transfer (OTT), intends to negotiate on a sole source basis with Computer Packages, Inc for commercial items. This contract provides payment of patent maintenance and annuity fees for the patent protection of inventions of the NIH and Food and Drug Administration (FDA) employees in the United States and foreign countries. This sole source is to prevent a lapse in service for approximately a six (6) month period (estimated December 17, 2011 through June 16, 2012) during the acquisition planning, negotiation, and award of the Full and Open competitive requirement under Request for Proposal (RFP) No. NIHOD2011289 for the Payment of Patent Maintenance and Annuity Fees, which will be posted on or about December 6, 2011. The Full and Open competitive requirement will be awarded for a base period of one-year with four (4) one-year option periods. This action is under the authority 41 U.S.C. 253(c)(1) as set forth in FAR 6.302-1 as it is impracticable to seek competition for the six (6) month period while completing the acquisition process for the competitive requirement under RFP No. NIHOD2011289 are ongoing. Only the current Contractor is uniquely qualified to perform the services required within the six (6) month period. Based on the complexity and level of detail involved in the payment of patent maintenance and annuity fees, it is not feasible for a new Contractor to assume responsibility for such a brief period of time and meet the deadlines for paying the maintenance and annuity fees for the United States and foreign countries. The current Contractor, Computer Packages, Inc. has already undertaken on behalf of the Government the tracking of cases in order to maintain the patents in the United States and foreign countries and would continue to provide the service. The United States and each foreign country have different requirements, timeframes, and fees to pay. Failure to follow the appropriate steps will cause the U.S. Government to lose intellectual property rights in the United States and the foreign countries. Such a loss has a serious and direct effect on the Government. As noted above, this is not a solicitation for competitive proposals. However, if any other interested party believes that it can meet the requirements, it may submit a statement of capabilities. The capability statement and any other information furnished must be in writing, and must contain material in sufficient detail to allow the Government to determine if the party can meet all of the requirements of the Statement of Work and the terms and conditions of the current contract. Capability statements and related materials must be received by Sheryn N. Etti, Contracting Officer, no later than November 28, 2011, at 12:00 PM Eastern Time. Written responses received after November 28, 2011, at 12:00 PM Eastern Time will not be accepted. A determination by the Government not to compete this proposed contract based on responses to this notice is solely within the discretion of the Government.
