- GENERAL SERVICES ADMINISTRATION GREAT LAKES REGION PUBLIC BUILDING SERVICES PROPERTY MANAGEMENT DIVISION Minnesota/Wisconsin Service Center 1. JUSTIFICATION AND APPROVAL FOR OTHER THAN FULL AND OPEN COMPETITION This document constitutes justification and approval for other than full and open competition for the acquisition described herein, under the authority of FAR 6.302-1. It is executed on behalf of the General Services Administration (GSA), JCK Federal Building, 230 S Dearborn Street, Chicago, IL and the Federal Bureau of Prisons, Federal Correctional Institute, Sandstone, MN. The Government is required to obtain electrical utility services for the subject location for continuity of daily operations. 2. DESCRIPTION OF SUPPLIES OR SERVICES TO BE PERFORMED This office proposes to procure by means of other than full and open competition, an order for electrical utility services. 3. DESCRIPTION OF SUPPLIES OR SERVICES REQUIRED TO MEET THE AGENCY'S NEEDS The service to be performed is for electrical service utilities for the period of December 1, 2011 through November 30, 2021 at an annual estimated cost of $479,048.00, and for the total escalated estimated price of $5,245,442.00. 4. IDENTIFICATION OF STATUTORY AUTHORITY PERMITTING OTHER THAN FULL AND OPEN COMPETITION. A. FAR 6.302-1, Only one responsible source and no other supplies or services will satisfy agency requirements. B. 41 U.S.C. 253(c). 5. DEMONSTRATE THAT THE NATURE OF THE ACQUISITION REQUIRES USE OF THE AUTHORITY CITED. The statutory authority cited is FAR 6.302-1, only one responsible source and no other supplies or services will satisfy agency requirements. Minnesota Power is the only utility company that can provide this service, and therefore, they are the sole source for these services. 6. DESCRIPTION OF EFFORTS MADE TO ENSURE THAT OFFERS ARE SOLICITED FROM AS MANY POTENTIAL SOURCES AS IS PRACTICABLE This is a sole-source utility procurement and only one provider is available. See #8 below. 7. DETERMINATION BY THE CONTRACTING OFFICER THAT THE ANTICIPATED COST TO THE GOVERNMENT FOR THE PROPOSED ACQUISITION WILL BE FAIR AND REASONABLE Minnesota Power is regulated by the Minnesota Public Utilities Commision, which regulates policies and regulations to ensure that utility services are provided in an efficient, reliable, economical, and safe manner to adequately meet the needs of Indianapolis residents. 8. DESCRIPTION OF MARKET SURVEY CONDUCTED AND THE RESULTS OR A STATEMENT OF THE REASONS THAT A MARKET SURVEY WAS NOT CONDUCTED A market survey was conducted. Examination of the Minnesota Public Utilities Commission website revealed that Minnesota Power is the only supplier of electrical services for this area. 9. ANY OTHER FACTS SUPPORTING THE USE OF OTHER THAN FULL AND OPEN COMPETITION None. 10. LISTING OF SOURCES THAT EXPRESSED AN INTEREST IN THE PROCUREMENT Minnesota Power is the only source available to satisfy this requirement. Therefore, it was not advertised on the FedBizOpps website and no additional interested parties were identified. 11. STATEMENT OF THE ACTIONS, IF ANY, TO REMOVE OR OVERCOME ANY BARRIERS TO COMPETITION N/A. 12. STATEMENT OF DELIVERY REQUIREMENTS The contract is for a 10-year period from December 1, 2011 through November 30, 2021.
