Description
The Department of Veterans Affairs, Veterans Integrated Service Network (VISN 3), James J. Peters VA Medical Center, Bronx New York, intends to award a Limited Sources contract under the authority of FAR 8.405-6 Limited Sources Justification to ETHICS RESOURCE CENTER INC., 2345 Crystal DR. STE 201, Arlington, VA 22202-4807 due to the fact that they have copyrighted survey questions and receive associated ERC benchmarks that will allow VHA to evaluate progress toward improved ethics and compliance practices against external standards. ETHICS RESOURCE CENTER INC. Furnish all survey questions and benchmarks/year services, updates. The place of performance is the Office of Compliance and Business, Secaucus, New Jersey 070124. This action will result in a Firm-Fixed Price contract with a period of performance of twelve (12) months. This notice of intent is not a request for quotations; interested parties may express their interest by providing a capabilities statement NLT December 12, 2011 at 12:00 PM EST. The capabilities statement must provide clear and unambiguous evidence to substantiate the capability of the party to provide the required services. A determination not to compete this proposed contract upon responses to this notice is solely within the discretion of the Government. Verbal responses are not acceptable and will not be considered. When responding to this announcement, respondents should refer to Announcement VA243-12-R-03312 Notice of Intent. If after December 12, 2011, no viable responses have been received in response to this announcement, Dept of VA shall negotiate solely with ETHICS RESOURCE CENTER INC. This notice of intent to award a sole source contract is not a request for competitive quotes. There will be no solicitation available for competitive quotes. Phone calls will not be accepted. The point of contact for this action is Contract Specialist, David Shemtob who can be reached at david.shemtob@va.gov The Government anticipates the award of a firm-fixed- price contract. A determination by the Government whether to compete this proposed requirement based upon responses to this notice is solely within the discretion of the government. Information received will normally be considered solely for the purpose of determining whether to conduct a competition. TASKS TO BE COMPLETED The following tasks will be performed by the contractor. Contractor will furnish no services related to any task unless and until the Contracting Officer issues a written Task Order for the specified task. Task 1. Planning Meeting Within 20 calendar days of contract award, the contractor will meet with the representatives of the Office of Compliance and Business Integrity, the National Center for Ethics in Health Care, and the Office of Management Support. The deliverable from this meeting will be an agreed Schedule of Performance under this contract, prepared by the contractor and delivered to the Contracting Officer within five working days of the meeting, and subject to approval by the Contracting Officer, containing the following elements: a.Questions: 1.A listing of validated questions and question sets, in the areas set forth under the headings "Measurements" and "Indicators", above. 2.Specification of required format for delivery of the validated questions and question sets, 3.Specification of the required format for license to use any questions or question sets as to which the contractor claims ownership or any proprietary rights or interests ("ownership"), 4.A schedule for delivery of the questions and, if required, license, in the specified formats. b.Benchmarking: 1.Specification of benchmarks available for each of the validated question sets, and up to a maximum of five (5) demographic or other characteristics available for stratification. 2.Specification of required format for the delivery of the benchmarks 3.Specification of the required format for license to use any benchmarks as to which the contractor claims ownership or any proprietary rights or interests ("ownership"), 4.A schedule for delivery of the benchmarks and, if required, license, in the specified formats. c.Confidentiality, Use and Non-Use Agreements 1.Specifications of VHA's obligations related to the confidentiality of any licensed or proprietary property as to which contractor has any ownership or claim of ownership. 2.Specification of VHA's permissible use of any licensed or proprietary property as to which contractor has any ownership or claim of ownership. 3.Specification of contractor's obligations related to the confidentiality of any information which it does or may receive from VHA during the course of this contract or identification of VHA as a participant in any survey program. 4.Specification of contractor's permissible use of any information which it does or may receive from VHA during the course of this contract or identification of VHA as a participant in any survey program. NOTE: All Confidentiality, Use, and Non-Use Agreements are subject to approval by the VHA Office of General Counsel and the VA Office of Information, Division of Cybersecurity. Task 2. Delivery of Questions and License The contractor will delivery all questions and question sets, license documents if any, and confidentiality, use and non-use agreements as set forth in the agreed Schedule of Performance. VHA will deliver all confidentiality, use, and non-use agreements as set forth in the agreed Schedule of Performance. Task 3. Provision of non-VHA Benchmarking Data The contractor will deliver all benchmarking data from non-VHA sources as set forth in the agreed Schedule of Performance. PERIOD OF PERFORMANCE The period of performance for this contract is one base year, effective December 112, 2011. MILESTONES/DELIVERABLE SCHEDULE Base Year: Task 1: Planning Meeting will occur within 20 calendar days of contract award. The deliverable from the Planning Meeting will be delivered to the Contracting Officer within five business days of the conclusion of the Planning Meeting. Task 2-3 will be delivered upon issuance of individual Task Orders for each task, and delivery of each task will be as set forth in the agreed Schedule of Performance.
