JUSTIFICATION AND APPROVAL FOR OTHER THAN FULL AND OPEN COMPETITION (OVERSEAS CONTRACTING ACTIVITIES) JUSTIFICATION AND APPROVAL FOR OTHER THAN FULL AND OPEN COMPETITION (OVERSEAS CONTRACTING ACTIVITIES) I recommend that the U.S. Embassy in Ouagadougou Burkina Faso use other than full and open competition for the acquisition of the Health Insurance Services for the Locally Engaged Staff (LES). The estimated cost is $340,500. This is a follow-on contract. This LES Health Insurance contract is a bridge extension starting five years and six months after the effective date of the current contract and continuing for a period of twelve months from January 1, 2012 through December 31, 2012. The American Embassy in Ouagadougou requires Health Insurance coverage for the LES employees in Ouagadougou, Burkina Faso. The US Embassy Ouagadougou has determined that the prevailing practice by employers in Ouagadougou, Burkina Faso is to provide for their employees health insurance protection and that the cost of such insurance protection is usually borne in full or in part by the employer. It has been determined that such health insurance protection is representative of local prevailing compensation practice; therefore it desires to adopt such locally prevailing practice as part of its compensation plan for LES. The contractor is the sole responsible vendor based on previous acceptable work. Post is taking all necessary steps to have a new contract signed by December 1, 2012. Post could not compete this "bridge" procurement due to the fact that the benefit levels are being re-evaluated for compliance with local practice and did an other than full and open competition authorized under 41 U.S.C.253(c)(1). There is only one responsible source for this current period. The current holder of the LES Heath Insurance Contract that expires November 30, 2011, is the sole vendor on the local market who can effectively continue the LES health insurance services while the new solicitation is completed. They are proven to be technically qualified to continue this service. It will be risky to award this contract to another vendor for this short period. The bridge contract will serve only for the period until the award of the new contract so it is not being competed. As the total estimate of this bridge contract is $340,500. As the total estimate of this bridge contract is $340,500 with a bi-weekly price of $37.78 (480 CFA/$1) per family premium and a bi-weekly price of $17.32 (480 CFA/$1) per single premium. Based on current market conditions and inflation, the anticipated cost for the U.S. Government is fair and reasonable. The price (premium rates) has been strictly negotiated in such a way that it remains the same. The premium rates in the contract extension are the same as the current rates. These rates have been in effect for five (5) years and six (6) months. It is not been affected by inflations. In preparation for the new contract award, a market survey is ongoing. The results of the market survey are not yet available. This bridge contract will just serve to cover the time period between termination of the current contract and award of a new contract.
