DEPARTMENT OF VETERANS AFFAIRS Justification and Approval For Other Than Full and Open Competition 1.Contracting Activity: Department of Veterans Affairs, VISN 1, Boston VA Medical Center West Roxbury Campus, Cardiac Catheterization Lab on transaction # 523-12-1-7902-0009 2.Nature and/or Description of the Action Being Processed: Request to purchase direct patient care supply item EZ Steer Ultrasound Catheter and accessories from Johnson and Johnson Healthcare, Biosense Webster Division, 14201 NW 60th Ave. Miami Lakes, Fla.33014 Tel# 305-824-2900. 3.Description of Supplies/Services Required to Meet the Agency's Needs: The accessories are to be used in conjunction with the Carto XP Cardiac Electro anatomical Mapping System from Biosense-Webster, Incorporated. Estimated Cost $42,189.00 4.Statutory Authority Permitting Other than Full and Open Competition: (X) (2) Unusual and Compelling Urgency per FAR 6.302-2; 5.Demonstration that the Contractor's Unique Qualifications or Nature of the Acquisition Requires the Use of the Authority Cited Above (applicability of authority): The incorporation of a sophisticated technology such as Carto Sound will limit procedural times associated with patient and staff exposure to ionizing radiation. This cannot be over-emphasized secondary to the known medical fact that ionizing radiation is hazardous to humans and utilization of an alternative imaging format will minimize that procedural associate health risk. There are no other companies that manufacture these types of catheters which are compatible with the Carto XP Cardiac Electro anatomical Mapping System. 6.Description of Efforts Made to ensure that offers are solicited from as many potential sources as deemed practicable: The following requirement has a total value of $42,189.00. No other sources were solicited. Biosense Webster is the sole manufacturer and distributer of these types of supplies. These items are urgently needed for an upcoming surgical procedure in order to continue to provide comprehensive care to our veteran population. There are no other companies that manufacture these types of catheters which are compatible with the Carto XP Cardiac Electro anatomical Mapping System. 7.Determination by the Contracting Officer that the Anticipated Cost to the Government will be Fair and Reasonable: The anticipated dollar value of the proposed acquisition is $42,189.00. The Contracting Officer determined that the anticipated price will be fair and reasonable based on the fact that the cost to the VA represents the pricing offered by Biosense to all of its' commercial clients. In addition, the pricing is consistent with prior purchases. In addition, the vendor's past performance has always been exceptional and deliveries have always been on time. These are needed in stock for upcoming procedures. There are no other companies that manufacture these types of catheters which are compatible with the Carto XP Cardiac Electro anatomical Mapping System. 8.Description of the Market Research Conducted and the Results, or a Statement of the Reasons Market Research Was Not Conducted: Biosense Webster is the sole manufacturer and distributer of these types of supplies. There are no other companies that manufacture these types of catheters which are compatible with the Carto XP Cardiac Electro anatomical Mapping System. 9.Any Other Facts Supporting the Use of Other than Full and Open Competition: This catheter is only manufactured and sold by the Biosense Webster a division of Johnson and Johnson Healthcare. 10.Listing of Sources that Expressed, in Writing, an Interest in the Acquisition: See Section VI above 11.A Statement of the Actions, if any, the Agency May Take to Remove or Overcome any Barriers to Competition before Making subsequent acquisitions for the supplies or services required: Contracting Activity will continue to encourage brand name or equivalent specifications.
